  1. Hello, I'm new and I have often stalked these really helpful threads for advice over the years, however I can't quite get the answer I need in searching. I am grateful for any help received in advance. I received a letter from Bryan Carter on Friday and also N1 forms on Saturday chasing for an old welcome finance debt. The debt was originally taken out in 2007 and was for 4 years, I made payment for 2 years and then was made redundant - I buried my head and 'forgot' about it. In 2009 I know Welcome went into administration, but I never heard from them again until August 2012, when I received a letter saying the debt was 'satisfied' - no obviously I didn't save this letter because I'm stupid. But now this is the first letter I have had and it's with court forms. Also it only lists me on the court form, but this was a joint application. I am loathe to just stump up this money when I thought this debt was gone. Also on my credit file, it shows a blue s as satisfied from August 2012. I am wondering if I should put in a CCA request, or considering I have now got the N1 forms, whether I have a defence at all or I just have to pay to stop the CCJ? I'm sorry if this made no sense at all. TIA x
  2. Hi Long time lerker first time poster. Ive had a read through previous threads to see if could get my questions answered but havent really seen anything that relates to my query so im putting out there on here for a response. Right basically went to uni in 1999 took a student account out with lloyds tsb with an over draft of £1500 all was fine. Finished uni brought an house happy days overdraft remained. Gets to 2008 still with the overdraft in place but still within its limits i get a letter from lloyds telling me that as i am no longer a student i have to change accounts and pay back the overdraft. Having never been overdrawn in an unauthorised way and still using the bank everyday for wages bills etc i was a bit miffed but understood so i contacted them and said i cant pay that much all in one go but if you reduce my overdraft by £100 a month ill pay it off in 15 months. Both parties were happy with this with an agreement that it would be looked at in 6 months time. And so it continued. I then get a on the 24th of December 2008 advising me that as it was my 6 month review my overdraft had been removed and now i was being charged at £100 a day for an unauthorised overdraft as my account was £900 overdrawn. With the date being christmas eve and this being a friday if i remember rightly the banks were shut the 25th (saturday) 26th (sunday) 27th (bank holiday) so i was charged 4x £100 until the banks reopened again in the mean time my mother had paid £100 for xmas into my bank meaning this got swollwed up in charges. Anyway i immediately created a complaint as again i understand but the timing of it and the fact the letter was sent in xmas post was disgraceful... as advised by lloyds i put my complaint in writing, advising that i would not make any further payments until this complaint was addressed, i finally got a response in April confirming that the complaint had been found in my favour and i would have all the charges wiped clean mentioned in the complaint but would still have all the charges in place after that ie again charged at a daft daily rate (this figure has slipped my mind) any way i again spoke to the complaints department and they advised that they would not budge on this so i just adavised as far as i am aware the debt is still £936 or what ever the exact figure was and if we could continue with the arrangement id clear it in 9 months but lloyds insisted that the charges are to be paid. Anyway to cut a long story short i advised i wouldnt pay and they can jump for the rest. Ive had various debit collectors send me stuff over the years all ignored Fast forward to last week and i gets a letter sent to my mums house...from good old Bryan Carter sols We have been instructed by fredrickson internation on behalf of Lowell fincial Limited to issue court proceedings on 17th March 2014 if payment of this debit (£1701.02) is not receievd by that date. Etc So basically the debit has jumped up from £900 odd quid to £1701.02 I just need some advice from here as with it being an overdraft i think its a bit different to just a nornal loan isnt it? Im so close to statue barred id rather see if i can see it out but theres just something about this letter and it being from good old Bryan Carter that has got me worried. I currently live with my girlfriend who owns the house we live in, im not on the mortgage or deeds or anything and i dont have any documentation coming to this address and as pointed out the letters are going to my parents house who are happy to go with what ever i want to do ie sending good old Bryan a letter this individual doesn't live here but i need advice from your good selves if possible first.   4. I received a letter from Bryan Carter stating court proceedings will be issued on the 10th March 2014 - Obviously panicked but luckily found this site. I have looked up my credit report and Noodle shows a default notice for 17 April 2008 - this I believe is wrong as im sure i ceased payments (personal reasons etc) before this. However, Equifax shows no default notice - how can one credit report show one thing and another something else? Very confusing. Which one is correct? This would mean (i think) its Statute barred and thanks to this site have downloaded template and will post recorded delivery monday. Any advice re: credit report differences much appreciated Also according to the default notice date on Noodle ive around a month before its been a debt for 6 years - should i still send the SB letter? Hi , please help in 2011 around july Vodafone charged me £95 on my bill which l disputed as my contract was about 25£ a month , they told me l went over the limit which l still disagreed as l knew it wouldn't have been that much , they then disconnected my phone , which l then contacted them to end my contract if they didn't seem to have any solution about my bill , After four months l then got a letter from Vodafone saying they have disconnected my phone and l owed a £441 bill still l contacted them wondering how my bill had gone from £95 to £441, they told me it was monthly charges , and cancelation fee , which l did not understand how this went up to £441 unless assuming there were still charging me for a phone which was disconnected even though l had told them to cancel it if they did not seem to have a solution for my bill therefore they put a default on me in May last year Beginning of this year l received a letters from Lowell buying my vodafone bill which l have ignored because l though t it must have been fraud, today l have received a letter from fredrickson stating they have been authorised by Lowell to secure repayment debt, and that l should contact them as soon as possible to discuss this matter , if lm unable to come to an agreement with them on behalf of their client, they intend to instruct Bryan Carter Solicitors LLP to take legal action against me to recover the debt they state if proceedings are issued additional charges will be claimed which will increase the existing balance that is ; an extra £30 court fees and Solicitor cost £50 which in total it will be £521.86 please help ; l have no idea what to do now Hoping l wont get another default with these people : thanx
  6. Hi and thanks ahead to anyone who can take the time to advise me. Firstly im not even sure how to use this but im hoping someone can direct me in the right direction. I recieved a letter from Bryan Carter a few days ago telling me that they have applied to the court to issue me for a outstanding balance with jd williams, but on behalf of Lowell Finacial. Myself and husband struggled a few years ago and did have a few accounts but to be honest this one does not ring a bell and definetly not for £1365 as they are stating we owe. Iv never had a credit limit over 250. After reading many posts on hear i decided to wait for the arrival of the ccc and sure it arrived today . I acknowledged the claim on line and said that i am defending the whole thing. ( sorry not good with the correct terminology).or spelling lol . Anyway i have copied out the cpr letter and intend to send it asap recorded del in the morning. My questions are what is the next step . I have no correspondance from this account and cant even recall it , and on the cc papers it states this:- THE CLAIM IS FOR 1365.88 THE AMOUNT DUE UNDER AN AGREEMENT BETWEEN THE ORIGINAL CREDITOR AND THE DEFENDANT TO PROVIDE FINANCE AND / OR SERVICES AND / OR GOODS. THIS DEBT WAS ASSIGNED TO / PURCHASED BY LOWELL PORTFOLIO LTD ON 20/12/12 AND NOTICE SERVED PURSAUANT TO THE LAW OF PROPERTY ACT 1925 , PARTICULARS JDWILLIAMS , THE CLAIMANT ALSO CLAIMS INTEREST PURSUANT TO S69 COUNTY COURT ACT 1984 FROM 20/12/2012 TO DATE AT 8% PER ANNUM AMOUNTING TO 87.89. Any advice will be gratly recieved. I also would like to add i am a person who never signs agreements so i know this definetly would be the case. They wont have a signiture off me . kind reguards

Hope someone can help, i have had an ongoing debt with 02 for a couple of years, the original debt started out £51 but i refused to pay it as i believed that it was a fault on there part, over time the debt got passed to bryan carter, and at some point without me know he managed to get a ccj against me with northampton court, (i have checked this on experian). This morning i have had a letter from bryan carter telling me that there is a warrant of execution and that bailiffs will be visiting my house, the judgement balance is now at£378. i was wondering what i should do about this should i pay it off? can i haggle with bryan carter to half the debt? Any help would be appreciated. Thankyou
  8. Hi there, I hope someone can help me. being Newbie I am stuck Yesterday I received 2 letters from Bryan Carter solicitors. One Letter and the Other Court forms I have a debt with Lowell who bought the debt from shop direct/LX I defaulted in 2010, and due to having breakdown and being out of work I simply couldn't cope at the time. ( to tell you the truth its all a bit of a blur) I am now getting myself up on my feet and this lands on my doorstep. I don't know what to do? ! I really don't want this to end up as a CCJ... as trying to sort myself out and hoping for a mortgage next year. do I admit to it? can I try to ask for a settlement figure? do I ask for extra time as most of the Debt is due to Charges on the original account with the cataloge company So I can claim them back? who do I contact the solictors? court or Lowell? Sorry for all the Questions but I am in meltdown over this.

Hi all, Got a letter from Bryan Carter this morning, dated 29/08/13 informing me that as I had not paid the monies owed to Lowell financial, they have issued litigation proceedings in the county court . I will receive the claim forms in the next 48 hours. What does this mean? Have no idea what this debt is for and not had any previous communication Any ideas? Thanks
  10. As some of you are aware I have been in the process of dealing with some of my debts. Largely due to a misspent youth. I am now trying to deal with each of these debts. I have 5 CCJ’s in total of which I have settled 2 in full. Amount £1794 I phoned Brian carter regarding the two judgements that I had received for claims ending 901 & 4449 in October and made two separate £50.00 payments via direct debit from October 2007 monthly until May 08 when the direct debit was returned and I buried my head in the sand. Because the original claim ending 901 was only for part of the debt £297 by my reckoning I’ve paid more than was due because BC split the debt? Also it appears Egg then sold the debt to Arrow Global who then issued a Separate CCJ for the whole debt again through Brian Carter. One further piece of information as that both these debts have subsequently been sold by Arrow to Lowell Financial who have closed their files because Egg could not comply with my CCA Request. What should my next course of action be? As always I’m very grateful to you all for your help. I’m not as concerned about case ending 4448 because it should ‘Drop off in a couple of months) Thanks again. Kev
  11. Hi all I am new to this so please bear with me. Other than this case I am in good finacial standing with no debt or credit issues. I have been sent court summons from Northhampton CCBC from Lowell Portfolio ltd fronted by Bryan Carter "Solicitors" The summons came on 29th October I have roughly under 14 days to respond. I am in the process of writing to Bryan with a CPR 31.14 but I understand I have to respond to the Court first? Also I am out of the country till January so this is a royal pain in the posterior so to speak. Any advice will be gratfully carried out. As background I payed my 02 contract fully every month and at the at the allotted time[12 months] I asked to cancel the contract . They agreed. They then took out 160 pounds without asking as a cancellation fee. This wound me up and I rang to get my money back. After a while they returned it. Twice.... They realised mistake later but I had moved and didnt know about it. This brings me to present day with me getting debt letters from moorcroft then lowell. Now court. They are taking me to court on the agreement of providing finance,goods or services . I had payed contract fully with out debt up to this point. This is somthing I have ignored rather then dealt with. Bryan is claiming 39 pounds interest and a 50 pound fee which brings it to 270 pounds. Please advise ps the contract was in 2010.
  12. Hi Folks, I received a claim form from Northampton of a debt from Argos. I knew i owe them £400 ish but have no idea of Bryan carter until 2 days ago where he sent a letter that a proceeding had been issued. Any help will be appreciated. I intend to avoid CCJ. Cheers
  13. Hi there, I'm very new to this and I'm probs a little late with things... I have an old debt with Orange. Long story short, I've received a letter from Bryan Carter acting for Lowells. They have now issued me with a Claim Form. At first I was a little confused because the debt that I have with orange, I've been paying a totally different debt agency. But looking further in to this, I must have two separate contracts. I can't get a CCJ because I won't get a job that I'm applying for in the new year. So, I rang Bryan Carter up and said is there anything we can do to stop this CCJ. I was told that I could either pay it in full, which I can't afford [£480]. I could return the admision form back to the Court and offer what I could afford, but would have the CCJ against me [which I can't get the job I want]. I could arrange to pay the debt off in three months, but then they said that I could pay it off in six months if I agree to £80 a month, which I have done today. However, I have now since been reading many threads on here where people are stating that Bryan Carter don't always have the correct paperwork if I defend the claim. I was wanting to know how I find out if the orange contract is mine or not. Saying that, I think I've left this too late in the day because in the morning I've to ring up with my first payment of £80 and I've given them my bank details to set up the direct debit for the second payment to come out of my account in January. Looking forward to hearing from you all
  14. I have been approached by Rockwell for a debt that util 5/7/13 i was paying monthly by DD. Formerly this was HSBC and collected by B Carter before it went to Fredericksons, then Pheonix. At some Point Arrow took over but have no idea when. Anyway, the DD's stopped in July 13 and as I have SO much debt, i didn't realise this was a "live" debt and should have continued. Am i right in thinking that (despite being a 2007 debt), this wont be statute barred as my last action was only 5 months ago and that really, i should contact Rockwell or Arrow to renegotiate affordable payments?
  15. Hi, Particular of Claim: The claim is for £1665.21 . The amount is due under an agreement between the original creditor and the defendant to provide finance. This debt was assigned / purchased by Lowell on 21/08/12. and noticed served. Th claimant also claims 8%. The issue date is : 15 Nov. I have acknowledged the form and intend to defend this. Please help with the next steps. Many thanks.

Hi everyone hope I can get the right help and advice, received these 2 letters through the post today, I checked on my credit report on Experian and the default date was on 18/01/2008 with LOWELL PORTFOLIO I LTD, however I haven't acknowledged this debt since then and I have only just been getting my credit score back to scratch - the last thing I need is a ccj on my file for another 6 years! is there anyway I can fight the case? or maybe request the original credit agreement with Lowell? and what to do with bryan carter? I don't even know where to start in regards to the 'claim' and 'response' forms from Northampton county court, if anyone can help any advice/help is greatly appreciated

Bryan Carter have written to me saying they have been instructed by Fredrickson (acting on behalf of Lowell re. an old pre-2006 Barclaycard account) to issue court proceedings in a few days if payment is not made. I dispute this account and wanted to check what I need to do. Presumably I need to a) inform Lowell the account is in dispute in writing (I have only done this by telephone a couple of years ago) b) CCA Lowell and c) inform Carter of the account being in dispute? Is this course of action correct? Any advice would be appreciated. Also, I can't find the Lowell letters - is there a particular address I need to use?
  18. Please help. I have been receiving letters for some time from Lowell and then Bryan Carter about a debt I know nothing about. The account number means nothing to me and the debt is for about £1000. I have just ignored them tbh as I just assumed they'd sent them round to everyone of the same name etc to try and fish out the persoin they want. Today I have had a letter from Bryan Carter Solicitors to say that they have issued litigation proceedings and that I should expect to hear from the court in the next 48 hrs. Can they do this of they re not sure of who they are looking for? Have been racking my brains and all I can think of is a catalogue which my exH bought something from which was in my name.. ...he paid the installments and I haven't had anything to say this was not continued. That was about 4 years ago.. ..but the account number is not the one which Lowell etc are quoting. Where do I go from here and who do I contact first? Is it Bryaan Carter or is it Lowell? What do I ask? No debts to my knowledge and am on benefits as my child is disabled. If it IS this catalogue (don't think it is) then how much will a court make me pay?
  19. I recently received letter from them about trying to obtain ccj against me and the claim form from northampton county court. The debt itself is related to capital one credit card which i had till roughly 2006. On the claim it states this debt was assigned to Lowell Portfolio on 07/09/2006. Can they still obtain cccj against me as it's over 6 years and i don't remember acknowledging it in any way? What I should do now? Thanks

Hi, I am looking for any help or advice: I ran up a large amount of debt more than 10 years ago on a Barclaycard, after my business failed - I tried to pay it off over a few years, but with all the interest charges, I found it impossible and gave up - with the last payment / default @ July 2008. The debt with Barclayard was just over £15,000 (!!). I buried my head in the sand for the last 5 years after searching the internet a few years ago and satisfying myself that the debt was un-enforceable and as such have never replied to any of the multitude of phone calls and letter received from many debt collectors over that time. Of course, I now realise that this is probably not the truth! A few months ago, I started getting letters from Lowells, Fredriksons and now Bryan Carter. I checked my Experian File and noted that Barclaycard wrote off my debt last year / sold it to Lowells (without notification). The letters of the last couple of months have been quite aggressive, leading to the last letter, where (on Bryan Carter headed paper), they are notifying me that if I do not pay in full by the 26th August, they will issue court proceedings. I have had these types of letters before - but this one seems to be worded differently from the usual we 'may' issue proceedings. Needless to say, I am worried, as I have absolutely no means of paying this large amount of money. I have so many questions (sorry!) to anyone who can help. On one hand I am tempted to just ignore it as usual and see if they actual issue proceedings. On the other - after reading about these jokers - I have started to think about what if they just try for an uncontested CCJ - especially if I never reply to anything. Does anyone have any further clues as to how many of these letters from BC actually end up with proceedings issued? The amount they say I now owe is £16,078 (which is more than what I owed Barclaycard). Does anyone have any suggestions as to a next move (if any?). Do I send a 'prove it' letter or a letter saying I have no clue about the debt (after all - I have not idea where they got the actual amount from). Any help of advice would be most welcome and thanks in advance (sorry for the long rambling post!).
  21. I received these letters - fredrickson/lowell one last month and bryan carter one a couple of weeks ago... I pretty much have no idea what to do so all help is appreciated. .. I think I need to send a section78 request? I have two separate debts, both from about 7 years ago and this is one of them. I havent been paying much attention to them and have been just throwing the letters in the bin. One has been passed around various debt collectors, maybe about 7 or 8 different ones, and one (i think) has just been passed on from Halifax (both are originally from halifax) but I'm not sure which one this is :/
  22. Hi Everybody I have been an avid reader of threads in this sub-forum but have never posted or commented until now. I had a claim from Northampton Court Bulk, I acknowledged the service, I submitted my defence. MCOL lists my defence as received on the 22nd October. I had sent BC a CPUTR letter and he replied with "contact Lowells with a Section 77-79 request" As I believed there was no actual agreement I sent a "prove it" letter instead. Lowell responded with the last item ordered and when the last payment was received and which catalogue it was. Again it rings no bells, however it is on my credit file as a default so there must be something in it! However 38 calendar days have elapsed since my claim was received by MCOL and I am now wondering what to do or more to the point what BC is brewing up!! I have tried to decipher the CP rules which seem to state that 28 days go by then a reminder to proceed is issued by NCBC which if not answered in 7 days leads to a strike out? Is this true? Any advice would be gratefully received. Thank you in anticipation.
  23. Hi all, I am new to posting on this site so please bear with me regards any missing information etc.. I received a letter from Bryan Carter dated the 22nd of Nov regarding a debt that had been passed onto them from Lowell. They have given me until the 6th Dec to make payment/contact them or I will be going to court. Obviously I want to avoid this but have a couple of questions on what I should really be doing next. The debt in question (I believe) is an old overdraft, but I have no paperwork to try and track it down and if I have worked things out properly according to advice given on various forums, the debt was due to become statute barred in May. I was wondering if there are any specific letters I should be sending out or any key questions I should be asking so I am able to find out more about this debt. Thanks in advance
  24. Hi all, I really need some urgent advice! I've had a letter from Bryan Carter Solicitors, dated 22/11/13. "we have been instructed by Fredrickson International Limited, on behalf of Lowell Financial Limited to issue court proceedings if payment of this debt is not received by us by that date". It relates to a Capital One credit card debt of approx. £450 I can't remember the date the card was taken out, but I've found an email saying I'd activated "Verified by Visa" for that card, back in Sep 2009, so I guess I would have applied for the card around Aug/Sep 2009. The last time I made a payment on the account was in 2011. I have other debts, totalling around £11'000. Just defaults, no bankrupty, CCJ's, DRO etc (yet!). Only the Capital One card above and a Barclays bank account (£2'200) have been purchased by Lowell, and they've said nothing about the Barclays account for some time, although I guess it's only a matter of time before it gets passed on to Bryan Carter? I know I signed a credit agreement, just can't remember when. I just checked my equifax credit report and it's not on there (but I know it was on one of the other ones, like experian). I'm a full-time mature student. I receive student finance and have no other income except child benefit and child tax credit. Too busy with the course to do a part time job. My wife owns a property in London (bought recently) and gets around £1000 per month (after expenses/mortgage from renting it out and managing another property which she doesn't own). She's in the process of registering with HMRC to pay tax on her earnings, but hasn't done so yet. I need to know what I can do? And more importantly, what can Bryan Carter do? I've heard that they can't take my wife's house or money as the debt is mine, but surely the courts will look at my wife's earnings as well as my own, in terms of assessing household income and what I can afford to pay? The reality is, our outgoings basically match the money coming in. If you discount my wife's earnings, then I don't even have enough money to support myself (ongoing dispute with student finance england, MP involved; I should be getting around £11'000 per year, but they've awarded me £3'700 for this year!) I'm studying in order to become a professional (the jobs I'm applying for will credit check all prospective employees), so I cannot afford to have any CCJ's or court actions against me! Defaults are bad enough. I do want and plan to pay everything off, ideally through income gained from doing internships throughout my course, so that by the time I graduate, I will have satisfied all the defaults on my credit file. However, I'm not eligible to do any such internships until the summer of 2015. So I need to keep the wolves from my door and avoid any legal action against me until after then! I've heard something about sending 3 letters to the DCA/Bryan Carter, but is that only for statute barred accounts, or for credit agreements taken out prior to 2007? Please advise what I should do, and thanks for reading!
