  1. Hi. I have read posts on here previously which have been similar to my situation. I signed up for a 2 year membership of toning suite, part of a gym. The credit agreement is with Ashburn and gives no way out! I think their agreement is probably all legal and valid. I wrote to the gym explaining that due to worsening medical problems with my hands I would be stopping work and therefore unable to afford the second year but would pay the difference between a one year membership and half a two year one. At first my letter was ignored so I wrote again and have now heard back from the finance company (as the gym had contacted them) basically saying they may only consider a cancellation (goodwill) on production of letter from consultant saying unable to exercise which isn't really the point. I had mentioned the OFT 2011 case and also the fact that it had been ruled(?) that contracts for more than 1 year were unfair and should provide for cancellation. I am trying to compose a reply and would be glad of any help
  2. I informed (in writing) my local Bannatynes gym I was leaving. I was under the impression that under the new OFT ruling the cancellation period was 30 days. This would have meant my contract ended on 14 February. However I received a letter from Bannatynes informing me my membership would not end until 28th February as its 30 calendar days. When I called Bannatynes they explained this was in my contract. I'm sure I have the contract somewhere so I haven't checked yet but surely any ruling would supercede this? I know it's only 14 days but I've already made plans to join another gym on 14 Feb and do not wish them to overlap. Is the 30 day calendar rule valid or is this another case of them trying it on?
  3. Dear Forum Members Need your help to cancel an order I placed with SCS on 28/12/2013. I placed a sofa order worth £2789.00 with SCS in Rotherham on 28/12/2013(with delivery scheduled after 8 weeks). The salesperson very cunningly got our signature while we were viewing and never gave me the chance of reading the terms, that the order is non-cancellable. He also talked me into paying the whole after offering me discount. I was given all the paperwork including the invoice(which has terms written on it) after I made the payment. After I reached home and after a huge debate at home with family I decided to cancel the order. Now I went to the store on 03/01/2012 and asked to cancel the order. The salesperson told me that the order is NON-cancellable and can only be amended within 7 days. I was shocked to hear this. I asked what about the cooling off period as it was only 5 days since i placed the order the delivery is scheduled after another 7 weeks. He was very rude & obviously told me that we'll not cancel your order. The fact is that even the salesperson refused to accept that he did not tell us that the order in NON-cancellable and non-refundable. Guys please advice on how can i cancel this order. Regards MS
  4. Hi, just looking for a bit of advice. My mobile contact is due up first week in February, so contacted orange last night to see what deals they had. I was offered an upgrade deal which I accepted however speaking to friends I could get a better deal elsewhere therefore phoned them this morning to say was going to be cancelling the upgrade and was giving them their 30 days notice to move elsewhere. I was told no problem if I declined delivery of the handset (which is likely to be tomorrow) once they have received it and logged back into their inventory I would then be able to give my 30 days notice. I was advised this could take 10 working days. This doesn't seem right to me. I've asked for it to be noted I'm giving my 30 days notice form today. I know it's only 10 days but that practice seems wrong to me. Is this correct? Thanks
  5. Hi guys I have a stupid idea the other day to buy a new washing machine from Brighthouse. After I'd come home and thought about it (after the staff in store where lets say... pushy and I fell into their trap!) I realised that paying £1068 for a washing machine on sale in Currys for £349.99 is ludicrious. I phoned Brighthouse and asked to cancel my order, they told me I cannot, I explained that the hire purchase agreement I'd signed and that is sat in front of me said I had 14 days to change my mind - They've told me that I can only change my mind once the product has been delivered. I have a feeling they're trying to get me to have the washing machine delivered and then tell me because it's been delivered I cannot cancel? This is stressing me out, I simply do not want to be in this agreement with Brighthouse anymore, I'm not bothered about the £8 I paid to them already.. Thanks in advance
  6. I took out a 12 month gym contract which is being dealt with through Harlands. I have called the gym and they just said 'no worries just give your membership card back and cancel your direct debit with your bank and call Harlands to cancel' but I fear it may be a little more complex than that??! My 12 month contract is until August 2014 but I have since been diagnosed with agoraphobia amongst other mental health conditions so, needless to say I cannot go to the gym. Im awaiting therapy but the wait is currently approx 15 months so my health is not likely to improve any time soon. So, I have emailed Harlands explaining my situation and advising them I can forward a copy of my letter from my Consultant Clinical Psychologist detailing the conditions he has diagnosed me with. My query... What are my chances of them cancelling the membership? Will I end up having to pay loads of money out? (Im not working due to my illness at the moment also so cant afford it either) And, If they tell me to go forth... is there anything else I can do or try to get out of the membership? Any help or advice greatly appreciated.
  7. Hi guys, bit new to this area. I have my car insurance, which i prefer to pay all at once, annually. Im now looking at getting another car. i paid my insurance, £243 at the end of may, for commencing cover on 4/6/13. Now, i realise there is a cost to cancelling, but when i looked online, they reckon i will owe them 72 quid, bearing in mind i will have had less than 6 months cover. they state that they will refund pro rata, but with the 75 quid admin charge, but surely less than six months at that price means they should be paying me back some? any ideas?
  8. So there is quite a big thing about banks having to cancel CPAs and giving your money immediately back. My question is how immediate is immediate? And some banks aren't playing ball. Does anyone know if lloyds tsb are ok with this? I also wondered if it did actually work? Is it worth cancelling the card at the same time? Can they (PDL lenders) get into your account any other way? I was thnking of getting a new bank account completely but I'd really rather not unless I have to. any advise would be great

I have not paid any deposit or given any financial details as yet - is it possible to refuse to give my financial details and get the order cancelled? Many thanks.
  10. I was recently declined a visa for travel to the US after I had booked my flight with United Airlines through an agency here in the UK. The date of travel for which I paid my fare was mid august 2013 yet I have to wait a further 6 months for my application with the US embassy to go through all the procedure before I can reschedule my holiday for next year. I have contacted United Airlines about this asking if I can have a coupon to spend with them within the next 12 months from the date I purchased my original ticket. As I bought my ticket through an agent they have referred me to the agent but the agent is not helpful saying that my only option is to reschedule the flight at an additional cost of £350. My problem is I dont have a date of travel until I have sorted out permission to enter the US, yet the agent will not offer another solution. I would either have to set a date and pay the additional £350, or lose the £800 or so I paid for the flight. Is this all the agency and/or airline can offer me as a consumer? Here is the email that United Airlines responded to me: "Thank you for contacting United Airlines. Your ticket was purchased through a Travel Agency. We are unable to determine all of the terms and conditions that apply to this ticket. Please contact them regarding your inquiry. Most tickets are valid for one year from the date of purchase. We appreciate your business and look forward to welcoming you on board a future United Airlines flight. Regards" Any suggestions to what I can do will be greatly appreciated. Thanks
  11. This is the first time I've come across this. I cancelled/withdrawn authorisation for CPA with peachy (I also informed bank so I think I'm safe) and I thought it was sorted. About a month later I got an email saying they had failed to collect the payment from my card and they would keep trying. I sent them a reply back stating that I had withdrawn authorisation for CPA and any payments would be returned by my bank etc. They then sent me this in the reply: Please note that a continuous-payment authority is not covered by any bank guarantee and can only be cancelled by the business that holds the authority (and we did so for 30 days which we are bound to do by law and no longer).Is this true? When you cancel CPA with a lender are you in fact only suspending it for 30 days? What about if you tell the bank not to allow these payments, is that for 30 days or permanantly? Thanks, Albert

Hello I'm looking into cancelling my membership for three reasons: - I can no longer fork out £60. - There is ALWAYS something faulty, out of order, or just poorly maintained - They have moved the work out areas around and it now looks like it's aimed at young men who enjoy using the weight room! I'd never joined a gym before, with the Chafford Hundred Bannatyne being the first time. I really wish I hadn't as it's one thing after the other causing the regret! First of all, I was made redundant a month after I joined, and my new salary is less than I was previously paid so after having to make a few cut backs, hoping this is going to be one of them. £60 is quite steep, and I may look into contract free gyms that cost a third the price of Bannatyne. Then after being there since December, I realise why people moan so much about the inside of the gym. Don't get me wrong their cardio equipment is great, and there's a lot of it. But the so called luxury spa facilities, well that's a joke. And I won't go into detail with the disgusting state of the changing rooms, but maybe they need to hire more cleaners. I expect showers to get cleaned daily, not see what looks like black mould everywhere, untreated and leaving black stuff against walls. Something always breaks, or the water temperatures change every time you shower, the steam room is out of use... And just recently, they have had a move around (definitely not a refurbishment) which means their Gym 3 which was lower lighting area and a bit more chilled out is now full of young blokes wearing tight vests tag teaming all the equipment. When I was originally given the tour, Gym 1 was basically all the weight area, and cardio machines. It had loud music and bright lights and what looked like contestants of the World's Strongest Man. This was not where I wanted to work out. Gym 2 was basically just around the corner, power plates and the slightly older cardio equipment (no TVs on them) but Gym 3 was the reason I joined. You went through a set of double doors, and aside from the Chart show channel playing on TV and someone occasionally using the boxing bag, it was nice. Calmer. But more peaceful. I actually dread going now. I don't like exercising in this brightly lit area. I realise it sounds stupid, but I don't feel comfortable. I have a contract until December 28th. Is there anything I can do? Advice appreciated!!
  13. I am having enourmous problems cancelling our gym membership and have had a major falling out with Harlands. The basic premise is that a DD payment was taken on the 8th February and we also gave 3 months notice (or as Harlands put it 3 further DD payments) on the same day - 8th February. I consider the 3 months notice would take us to the 8th May therefore the last 3 payments would be 8th Feb, 8 Mar and 8 Apr. I therefore cancelled our DD on 28 April. Harlands disagree and say notice being given on the same day as a payment means that the 8 February payment was taken before notice was given. Harlands therefore maintain that the 3 final payments are actually 8 Mar, 8 Apr and 8 May meaning our gym membership expires 8 June. Neither of us are budging and we've received the first debt collection letter with £25 additional fee. I am now expecting another letter (and admin fee) following a recent conversation. They are rude and obnoxious and i have no wish to make any further payment if that can be avoided. I have not put much in writing as yet. I did however reply to their original email saying that the final payments were 8 Mar, 8 Apr and 8 May. My reply said that i disputed this and (as stated above) I consider the 3 final payments to be 8 Feb, 8 Mar and 8 Apr. Harlands did not respond to this. I would appreciate any advice people have. I am now at the stage where i wish to put something in writing but would appreciate any guidance about what that should be. I'm also interested in whether members consider that my viewpoint or Harlands is legally correct (ie is notice valid on the same day as a payment is taken). I did not have home insurance at the time of signing my agreement but I do now, am I therefore able to cancel Perfect Home's?   15. Morning All. A bit of a strange one this and I can not find any direction so turned to you for help. Due to my work in 2009 I took out additional Life Insurance FP Level Life. However, in November 2011, as my job role changed it was no longer required and as my wife was made redundant, the money would be best utilised in the family pot. As time marched on I thought no more, foolish. I have recently been contacted by a firm of solicitors acting for the company I had the agreement with claiming their 'Commission Clawback' I wrote back asking for some additional information to save money e.g whether there was a fee agreement, as one is not mentioned in any paperwork I have, because I have read commission is sometimes offset against this and only the commission to the value of this fee may be requested therefore maybe only liable for the difference. I also believe on reading the FSA Website on Unfair Terms in Consumer Contracts the Terms of Business (TOB) agreement I signed may be unfair and in particular reasons for believing this when you use an IFA you should have a choice how you want to pay for the services - I was not given this, and the terms do not state clearly when and how much me, the customer has to pay the IFA so therefore not aware of the full cost of the financial advice. In addition I believe that my TOB agreement allowed the firm to reclaim an amount from me, the customer, if I stopped paying premiums and the IFA had to refund commission to the product provider as appears in this case. my interpretation of the FSA guidelines also leads my to think that this charge is a disproportionately large sum as I have not fulfilled part of my obligations under the contract. Surely a court would not enforce this over and above my rights to cancel this policy. I have also asked these Sols for my cancellation rights to which after a period of 1 month got nothing except a MCOL from Northampton. I also sent them a S10 DPA request as other members from the IFA had tried to contact me via text and email touting for business. In total the sum claimed is £1261 + Court fee made up of original debt £997.31 plus interest, a tracing agents fee because I moved and not told them £42 plus Sol fees £210 plus future interest. So, apart from acknowledging service can I assume this falls under CCA rules or send a CPR 31.14 request. Any help greatly appreciated.
  16. Hi all, I've landed here following a bit of a google to find some information regarding Vodafone and credit file defaults. I've only recently discovered the default after checking my Equifax report in preparation for a mortgage application. The default was posted on 03/08/2008 for a sum of £28 and it is recorded as Satisfied on 03/04/2009. As it was so long ago I've had to rack my brain to recall the details of this contract! I seem to remember when I ended my contract there was some confusion between myself and Vodafone regarding outstanding payments and contract end dates. I initially called Vodafone to cancel my contract with the required notice, I also wrote to them as advised to do so. I was told in my phone call to cancel my direct debit, as I would be issued a final bill which I could settle when I received it. From what I recall I wasn't issued a final bill, as Vodafone had not cancelled my contract, for which they tried to take a payment which didn't go through. I seem to remember it taking quite a few conversations to reach a resolution on this contract, by which time my account was classed as defaulted. As you can probably tell, the details are a little sketchy in my mind. I also have no records of what was said over the time. Do you think it is likely that records of this will still be recorded by Vodafone and they will be able to look into it? I do know at the time that I was very annoyed by the way I was treated - in fact i will still not entertain a Vodafone service, neither will my family. However I never looked into my credit file as I had no need to. Fast forward and I have £28 sat there potentially stopping me buying my own house! Sorry for rambling a little, just hoping some people on here can offer a bit of advice....? Many thanks, Craig.
  17. Me and some friends booked a Thomas Cook holiday through a Thomson store. We took out insurance with them, which we now wish to cancel (it's day 14 today). I've phoned the shop this morning but they seem to be taking their time with it, I've since phoned again and stressed the importance of it being cancelled, "we are really quite busy, we'll do it as soon as we can" My fear, if they don't action my request by 5pm tonight then they will close and we'll be stuck with the insurance? Insurance is provided by AXA. Can I cancel by phoning axa direct? Many thanks, S update: I've contacted AXA direct who say I need to contact the store in which I purchased the insurance. If the insurance wasn't cancelled then they would investigate it and refund if it turned out we had tried to cancel within the 14 days. Sadly I can't imagine my telephone call acting as proof.
  18. My wife called our bank to cancel the authority for a PDL company to take any further money from the account. Now we should have been suspicious as the person was very helpful. They confirmed that the instruction had been cancelled and that they were sending out forms to reclaim the last payment made in December, despite telling them that we are not disputing the last payment. So this was the 17 Jan and the payment was due for 20 Jan. However, what we didn't realise is that the company was taking the payment earlier due to the payment date being a Sunday and that there was less than 24 hours. The bank didn't inform us of this either. So I spoke to a few people today, still not realising that the reason it went out was due to it being collected earlier due to the 20th being on a Sunday. These people were the most unhelpful people ever. They somehow think I can see that is on their systems. Anyway, it turns out that we now have to reclaim the payment so it's good that we're getting the dispute forms meant for the December's payment as we can use these. However, I was also told that I can't go down to the bank and hand in my instruction in writing as I offered to do. I have to fill in certain forms for this particular type of transaction to get the instruction cancelled, which the original person failed to mention as they were assuring my wife the instruction had been cancelled. Not only that, but the person we spoke to today even said that after completing the forms they cannot guarantee the payments would be stopped!! Does it really need to be this difficult? I also get the impression from the people that I spoke to that if one of their colleagues makes a mistake then it stops with that colleague. No one was taking responsibility of the problem it seemed. What was most irritating was the first person I called kept saying 'you're only hearing what you want to hear' every time I or my wife didn't agree with her. She even used the phrase when she told my wife the money might not go out and my wife had to point out it had already left, that's why she was calling! Anyway rant over. With the process involved it's more than likely that next month will come and go again before we get the form, complete them, return them and they eventually pull their fingers out.
  19. A friends area is expecting snow tomorrow, schools may be closed etc, she is stressing about what to do about her ATOS appointment. Is it a bad idea to cancel & reschedule those appointments? I told her they may even cancel if they have a problem getting there. But if the school is closed & they expect her to go still, can she take her children to the appointment?
  20. Hi, Hastings have cancelled my insurance policy for my car due to non payment. Problem is, payment was taken, in full, after a total loss claim around 8 months ago. They are awaiting to see if they can reinstate, but I am not insured at the moment. Can they do this and should they reinstate my policy? Regards Matt
  21. Hi im new on here so not sure if this is the correct place. I am a member of bannatynes gym in Darlington i joined in October at the time i was working for the Bannatyne hotel within the town so i received discount on my membership, however since then i have moved to Newcastle i received a job offer in Newcastle so i have had to move out of the town therefore i am unable to attend the gym and i simply cant afford the membership. The problem is when i enquired about terminating my contract they have simply told me no and that as i am no longer an employee they will be increasing my monthly fee. This is a company i worked for, for 4 years. I really need to cancel this membership. Any information on how to cancel please let me know thanks, Jay
  22. Help anyone have I done this right. My husband finished work and we applied for penison credit till he gets his state pension in Jan. I was told we are entiltleid and he should claim carers allowance for looking after me. I presumed to do this now and filled the form in online. Now I think I jumped the gun and should have left it till he goes on state pension. I don't have his payslips so would have to get in touch with his ex employer for new ones so by the time all this is sorted he would be on state pension anyway ( we don't really want to ask for these). From what I can see it wouldn't make any difference to anything we will be entitled to anyway so too much messing about.(knowing our luck we would end up worse off with council tax etc. ) I have emailed them to cancel this transaction so hopefully I have stopped this and can just carry on till he retires then see if and what we are entitled to then. Will they be able to jsut cancel this before any payment if any are made. Thanks for your help.
  23. Hi everyone, I recently bought a car from carcraft on finance, and I was mis-sold the extended guarantee ( I was told it was free, but on looking closely at the paperwork I've been charged). I want to cancel the guarantee, Im still in the time limit to do so, but to cancel it I have been told I need to go in and re-sign the finance documents. I really dont want to do this because I have really bad credit, and I'm afraid if I cancel my current agreement I might not be able to get finance again for the new agreement. Is it possible to be refunded a diffrent way, i.e. cash, cheque?
  24. Hi, I think I already know the answer/solution to this but I'll go ahead anyway... I moved to a new area in October last year and joined the local Nuffield gym in January, signed up for 12 months and started using the facilities. Around April/May when the temperature began to increase it dawned on me that the air conditioning was absolutely useless and the sun would shine in through a wall of windows turning the gym into a green house. The air con system is not what you would find in an office but more the type you would see in a sports hall or swimming pool, more of a ventilation system than air conditioning. Either way it doesn't work and was far to hot to train in there. I spoke to reception who informed me one months notice was required to cancel. I fired them an e-mail notifiying them I wished to cancel and would like them to waive the one month notice as I did not deem it fair that I would have to pay for facilities I cannot use. I mentioned If they could reply before the next debit is taken I could cancel the debit directly with my bank. I heard nothing back so cancelled my debit at my bank. I since received a letter stating they could cancel my membership from when my contract period ends in January 2013 and that their engineers had been notified and were fixing the problem. A problem that was an inherent inadequacy of the system in place so much so that instructors their confirmed it was pants. So I replied by e-mail expressing that this would never been remedied and I would never be satisfied and if he (the gym manager) could use his managerial discretion to make an exception and terminate my membership with immediate effect I would be grateful. I received no reply so presumed everything was hunky dorey. But since received one or two letters requesting payment for £53 (one months charge) and that if it was not received it would be passed to their solicitors. I received a letter from their solicitors this week for the balance of £106 (two months charge) and 7 days to make payment or further legal action etc. My lodger happened to have done this with them also and said they eventually stopped chasing. So do I respond by recorder letter reitterating I am repudiating the contract and keep hassling the manager to make an exception? Ignore the letters? or settle up the remaining 6 months £318? There is the option of freezing the membership but this required one months notice and would effectively just extend the termination date of my contract. I would really like not to pay them (out of principle) but am aware I signed a contract but can't use their facilities as it is simply too hot and actually dangerous for me to train in those temperatures.
