  1. Hi ,can anybody help my situation. I am a newby I had a kitchen company apply to the courts for a payment to which they said I owed, this first started in 2013 they claimed I owed on several invoices over a period of time I phoned them on several occasions to state that I have never had or authorised anybody to have these items. I even phoned head office but they would not have any of it so it went on until in dec last year I phoned head office and after getting nowhere they said they would refer it to the legal dept to which I said see you in court, that's where I am at . I had a letter from the courts asking if I wanted mediation , which I phoned but because I wasn't prepared to pay anything that was not the way forward , then I went on holiday with my family ,when we came back there was a n149a,b,c judgment or order form that stated I had to return by 29th july when we came back off holiday the date had passed. ive tried filling the n244 in but not sure I have done it right and don't know where to send payment can anybody help in any way hanks.
  2. Hi Everyone, I am after a quick bit of help. I won a CCJ against a company that owes me money for unpaid invoices. I won the case in default because they did not respond. I have found out they are applying to have it set aside on the grounds they did not receive the forms which is a blatant lie. I am a bit confused because they have selected the "without a hearing" option. Obviously I want to object to this at a hearing because I have evidence they did receive the forms. I worry that their application will be granted without chance for me to dispute it. Is there anything I can do? can I send some information/forms to the court? Many thanks!
  3. My daughter has type 1 Diabetes. She received DLA with the lower mobility allowance up to the beginning of this year. We then had to re-apply in about March and in about June we were informed that she was no longer eligible to receive the allowance. Nothing has changed in her outlook, though. So far as I can remember, there was no mention on the letter of the ability to appeal the decision. When she had her latest hospital appointment, last week (she has to have them every three months), I mentioned the situation to her doctor and he said we should appeal. I am concerned that because it is almost 6 months since we received the letter removing her entitlement, that we would not be allowed to appeal. Do we have to reapply because of the lapsed time or can we still appeal and ask them to reconsider the decision? Mark
  4. Hi guys, new to the forum. I'm looking for some information regarding the retraction of witness statements in a civil case. I'm due in court next week to defend a claim over a business dispute. I have been informed via a third party, that one of the claimants witnesses is considering retraction their statement as it was 'mostly compiled by the claimant and they are no longer comfortable with it's contents.' The pre trial hearing has already been completed along with court bundles containing the statement. I have been asked by the third party if there is a way out for the witness Not to sure if i'ved posted this in the rigth section. Regards Chelsea Blue
  5. Hello all, How are you? I hope you are fine Recently my employer is reducing the workforce and offered the affected employees a voluntary redundancy via expression of wish. I am one of the affected people and will receive under the voluntary a payment in lieu of notice. As far as I understand this has an effect as if I would work the time for which this payment is made. Is this correct? My next question is then: When should I apply/register for the JSA, in my last 3 working days or 3 days before the time, for which the payment in lieu of notice is, runs out? PS: I am convinced, that I will get a new job within this timeframe anyway, but I would like to know this just in case Best regards
  6. Hi all, i have asked on here about my ppi and very grateful for the advice and templates given to me. I am in the process of filling out the fos questionnaire and doing the letter then i came accross the "WHICH" website and i fill in 1 form on there and they email my complaint to my bank and i have receivced a letter from my bank saying they are looking into my claim. I just thought i share this with you all but i hate filling in forms but this seem really simple so check their website out and see if your bank is willing to accept claims by emailing. Saved me alot of time. Bear in mind i knew my Loan application number so they had that info to process the claim..
  7. Just found a post on here that would suggest you have to wait 2 weeks after a sanction before you can apply for a crisis loan, my sanction ends tomorrow and i don't sign till next week hence i have a week to wait but looks like i won't be able to even apply for a loan, anybody know?
  8. Sanction finishes next week. But don't sign on again till week after so will be waiting 1.5 weeks(after the start of next week) to get any money. Just wondering though, as have been rejected for a crisis loan in the past, will they not say to you how have you survived during your sanction, which i used food banks and the very little food i had here, also my elec will run out next week. Will they not say well you lasted during your sanction so you can just wait a while longer, what's the best way of presenting your case? Technically i could keep using food banks but i will have no elec soon.
  9. My dad has a charging order on his house for around 5k, and for the last few years he has been trying to get info, as he didnt know it had been applied for, or a ccj given or anything of that nature. Having finally found from the dca who the orginal creditor was allegedly, the original creditor is adamant that my father has never had an account with them. The fos was due due have a final adjudication on this friday, which we will hopefully hear about this week, but how do we stand with having the charging order and ccj set aside in these circumstances, should they rule that the account never existed?
