I purchased a system from this company in February 2012. In July 2012 a fault developed with the disc drive. I reported the fault on 12-07-12. I was asked to fit the replacement drive myself, which I agreed to. This was sent to me nearly two months later on 07-09-12. It did not work so I sent it back. After months of promising that he was going to get me a new part, the owner advised me that if he does not hear anything by the end of Feb 13 he will send me a totally new unit. By 07-03-13 I had not heard anything so I emailed to request my new unit. He emailed me back saying he was expecting a new disc drive for my unit in the next week. I advised him that he had said I could have a new unit, but he stated he was within the 'consumer code' to try and repair the unit before sending me a replacement. Over the past few weeks he has been saying that the new disc drive is comming. But it hasn't arrived yet. Where do I stand? Its been over eight months now since I reported the fault. I have already been sent a disc drive replacement that didnt work, so he has already tried a repair. Am I within my rights to ask for a replacement of the system? Is there a case to take to a small claims court? What part of the Sale of Goods Act 1979 can I quote to try and force him into giving me a replacement system? I dont know if its worth mentioning, but the way this company works is a little strange. They do not keep stock of the systems they sell. You pay them for a system, then they order on from their Chinese supplier.
