  1. Hi I've received an out of the blue letter from Intrum saying they've passed a historic debt to Resolvecall who will be visiting our property if we don't get in touch. I am certain this is statute barred and designed to scare us. Do we ignore it?
  2. Hi all, Many moons ago (2012) I had a Virgin credit card (issued by MBNA) that defaulted. They did provide a valid CCA so I was advised by the good folks on CAG to make small payments to keep them quiet - I set up a standing order to pay them £5 a month, and it's been that way ever since. The debt has been sold on a million times, but £5 is nothing so I've paid no attention to it. I received a letter from Capquest (who must be the current owners of the debt) back in March asking me to contact them to discuss a suitable repayment option, and the account will now be managed by Resolvecall. Now £5 a month IS a suitable repayment option I ignored their letter. A few days/weeks later, I received a letter from Resolvecall, acting for Capquest wanting me to contact them and threatening a home visit if I ignored their letter. Obviously I DID ignore their letter, and last week a lady knocked on the door (unanswered) and put a card through asking me to contact Resolvecall. Interestingly, their letter said if I didn't reply within 7 days from the date of the letter, and...you guessed it, there was no date on the letter! Out of curiosity, I logged in to Resolvecall's account, and it shows my two most recent £5 payments, so they ARE receiving my money but clearly want more - which they're not getting. Now - do I play silly b*ggers with them, and ask them to provide the true copy of the CCA to see if they can come up with the goods? Do I just ignore them and carry on paying my £5? Do I stop paying altogether? I know the case isn't SB as I've been paying regularly, but not sure how to play going forward? Any suggestions gang? Thanks you!
  3. I've just received a letter from Resolvecall threatening a visit etc. This debt has had no action on it in over 20 years. I've not acknowledged the debt either in writing or verbally; this is the first letter I've had in over 10 years. Do I need to be worried, is there something I should do? I understand the debt is statute-barred now. Thanks

Hi everyone, I've received a random text message from a company called Resolvecall asking if I am the person they named in the text and 'to stop a doorstep visit I must respond yes or no to the text'. No other information has been given but I've googled them and understand they are a debt collection agency. I do not owe anything, have a good credit rating and the only debt I can think of goes back to 2007/2008 when I had a truly awful life event and nervous breakdown. As far as I understood that debt was statute barred as over 6 years old and I have heard nothing for years about it. This is now causing me a lot of worry and I do not know what to do next. Is it best if I respond 'yes' and ask for more information? Should I contact a solicitor? I am not a homeowner and stay with friends so do not want any doorstep visits to trouble them at their home as threatened on the text. I've also just had a major bereavement so this couldn't have come at a worse time to have to deal with. Any advice would be very welcome as this has made me feel so ill and stressed. Thank you
  5. Well after 13 years of no communication with any of my old creditors/ DMC's, today I had a call from Capquest about a Capital One debt!!! They said a CCJ was registered in 12/07. I didnt acknowledge anything, I merely obtained a reference and postal address. Section 2.4 of The Limitation Act states no action can be taken after 6 years. Am I correct and what's the best letter to send them? Thanks

Hi, I today received a letter from intrum advising that my debt will now be managed by a company called Resolvecall, and that they also specialise in home visits to discuss a repayment plan going forward? I did send DCA a CCA request in 2020 and heard nothing since. I am certain that the debt is now Statute Barred. Do I send the usual letter to intrum?
  7. Hello, I just have a really quick question regarding Statute Barred Letters. I recently received a letter from resovlecall regarding a old Amazon credit card/Halifax that I had in 2007. In the letter it said that resolvecall was working on behalf of Intrum, who do I send the SB letter to? Resovlecall, Intrum or both? Thank you in advance for any help I may receive. Choccie
  8. Hi, can someone please confirm when my debt became statute barred. It was a car hire purchase my credit file shows last payment was June 2017. The car was repossessed and auctioned off in 2017. My credit file shows updated as satisfied 01/02/18. The default date just says n/a. This has been through debt managers solutions then passed to intrum who have asked resolve call to get in touch. I have made no payments or acknowledged the since September 2017. Thanks

Hello everyone I've received a letter from Moon Beever Solicitors on behalf of 1st Credit (Finance) Limited for an outstanding Halifax debt of £2,254.03 Letter reads as follows "We are instructed on behalf of 1st Credit (Finance) Limited of The Omnibus Building, Lesbourne Road, Reigate, RH2 7JP. This letter is sent in compliance with the Pre-Action Protocol on Debt Claims ("the Protocol"). It is part of the requirements of the Protocol that we refer you to Annex 1 of the same and supply you with an information sheet and reply form. A copy of Annex 1 and those documents are provided with this letter. Our client has a claim for monies owed on your Bank Of Scotland Plc Bank account reference xxxxxxxxxxxxxx, which was opened on or around 3rd July 2006 ("the Agreement"). The account was assigned to our client on 18th November 2013 and a notice of assignment was sent to you on 10th August 2015 confirming our client as the new legal owner. The sums owed to Bank Of Scotland Plc must now be paid to our client" It then goes on to say that I can request a written copy of the agreement (if applicable) which the client will request from the original creditor and send to me upon receipt. As well as providing as reply form and a income/outgoing form I had some bad credit problems in the past and I understood that they were now statute barred. This debt doesn't appear on my credit report, which I check every month after being a victim of identity theft. I'm not sure what to do next, so any advice will be gratefully received. Thanks, Al
  10. I recently received a letter from Capquest informing me that they are transferring a debt that they claim I owe to Capital One, from themselves to another company called Resolvecall. Today another letter arrives and I received a text message stating that they would be sending someone to my home address. About twenty years ago I defaulted on some unsecured debt, I genuinely do not remember having a credit card with Capital One, in fact I have an account with them that I opened about four years ago which is in credit and I’ve always paid off in full every month. I have emailed them a standard prove it letter today and received a reply about half an hour later which contained this gem: “Unfortunately, it has come to our attention that there are certain websites purporting to provide information which will allow their users to avoid repayment or discussion of debts. It is our belief these sites are disseminating misinformation which is both unhelpful and harmful to the consumer. The letter you have sent is one of these templates. It appears to be a letter of dispute but simply lists the regulations around disputed debt and it does not explain to us why you are specifically disputing this debt.” I absolutely won’t be paying them anything, however I do not want any letters or visits as this would cause me terrible problems at home. I’ve replied to their email stating clearly that I don’t recognise the debt and that it would be statute barred anyway and not to contact me again. What can I do if they persist in chasing me? This is causing me considerable alarm and distress - I’ve made huge efforts to sort my life out and become a responsible and productive member of society over the last decade.
  11. Hi, had another knock at the door today from resolve call I didn't answer but they spoke to my neighbour giving my name and asking who lives at the address. I feel so embarrassed I know they have no power but it's not very nice having someone knocking at your door. This is an old catalogue debt from about 10 years ago which is statue barred. How can I get them to stop? Should I contact them? I did try to contact Capquest who say they no longer manage the debt.
  12. Hi Consumer Action Group. Looking for some advice regarding my wifes old student loans. She took out three student loans in 1996/97/98. she has never earned the threshold for repayment. she deferred her repayments for a few years maybe till 2005ish, then she stopped. There has certainly been no contact from her in the last ten years for certain. She continues to get 'notice of sums in arrears' which go to her mothers house where she lived as a student. All was quiet until the beginning of this year when she had a letter from capquest saying they were instructing Resolvecall. Sure enough Resolvecall wrote saying we're sending someone 'to make a personal visit to your home', which they did and we're told she no longer lives there. Three months later another threat letter from Resolvecall about a 'personal visit', that was 5 months ago. I think it time to try and nip this up once and for all. My feeling is to send a SB letter but I'm just so confused of the new rules regarding 'cause of action', I have no idea if she has ever been defaulted. So is SB letter way to go? who do i send it to? and when does the 6yrs run from with regard 'cause of action'? sry for the long post and look forward to hearing your wisdom!
  13. RC knocked at the door to speak to my husband. He was quite unhelpful with the guy so was just handed a piece of paper with details to contact the Resolve office. Afterwards, my husband admitted to me that he has ignored a few letters from them for £1100 which is an old credit card debt which he defaulted on 16 years ago. I knew he'd left behind a bit of debt from his younger years, and had 1 ccj (neither of us can remember what it was for) when we moved abroad 12 years ago We've been back in the UK for several years now. He's not been chased for any of the debts until this. We have a mortgage and clear credit files which I've seen and re checked today. Anyway the knock on the door has totally stressed me out! We're not able to pay that sort of money and I do worry this could tip hubby back into depression? Don't know what we should do now? I really don't want them knocking again. I'd be really grateful for any advice on what to do next?
  14. Hi, I received a letter from Resolve saying they would visit my home in 7 days to which they did, although I only got the letter 3 days beforehand. The Original Creditor was Bluestone finance for a motor vehicle, then Cabot got it and tried various attempts etc, Then it all went quiet for a number of years until the resolve letter arrived. This Account is over 15 yr old and no payments have been made in this time either. Thank you Is there a letter I can hand to the resolve Rep when they come knocking again? or what is the best way of dealing with this The letter is as below. Resolve Ref......... Acc Num Balance ........ Original Creditor Bluestone HP Conditional Sale Re Cabot Financial We are acting on behalf of Cabot who have purchased the account from Bluestone and we have been instructed by them to collect the balance. It is in your interest to contact resolve to help us understand your circumstances etc etc, if you don't we will call to your home to discuss and enable us to discuss the account and your options to resolve this matter.
  15. Hi, hope everyone is well. Just received a letter from Resolvecall who are working on behalf of Cabot regarding a RBS Credit card account they have brought. Saying the usual please contact within 7 days or we will come to you etc. No payments have been made since mid 2015 and was defaulted Jan 2016, no CCA has been asked for. At the moment I don't want anyone turning up at my door, how is the best way to handle this. Thanks JJ
  16. I received another letter from capquest today, the same wording as the first one telling me that resolvecall will now be managing my account etc but this is for £319 Shop Direct. I have no idea what is going on. My question @dx100uk should I just send another SB letter to them for this? x
  17. I have been receiving text messages from Capquest for a while now and I just thought it was a scam. I received a letter a few weeks ago stating I had a debt with Shop Direct which I don't recognise, I have never had a catalogue or had anything from very ect.. I received a letter from Resolvecall stating they are acting on Capquest behalf, they have also stated that I have 7 days to contact them or "Capquest will instruct them to arrange a visit to your property". The letter is dated 20th I only received it this morning.

Resolve Call & A Statue Barred Debt! - Debt Collection Agencies - Consumer Action Group I have just had exactly the same situation occur, I got home on friday to my wife telling me a man with a ID badge on a string around his neck banged on our front door and after she told him I was not home and closed the door, he proceeded to write a paper out and post through our front door,, I had a letter from a debt company about 2 weeks ago telling me they have either passed on the debt or have instructed resolve? I cant remeber the company as I threw it straight in the bin, I am sure they are referring to a debt from 2006 which has well gone past any kind of hope they can expect to get anything from myself ,, could anyone please direct me in the direction of which letter i send them , ie statuary barred ,, also when i do the letter should i put my name on it or just the ref number and also do i sign it or just leave it, I really am pretty disgusted these people (who seemed to be bully boy according to my wife) have the cheek to visit me for a debt from 16 years ago,, well 10 years stature barred,, Any advise most welcome thank you ! Just to add after reading another post I remember the original debt was for a credit card from american express that capquest had obtained, I never had any kind of CC and no communication with anyone for 16 years ,, any letters which have come to me have gone straight into the bin, I guess i should send a letter and get it finished with ,,
  20. Hi, I have an old defaulted Halifax Credit Card. It's dropped off credit report now, I am making £2 payment towards Cabot, last payment Aug 22. Halifax sold this account to Cabot atleast Jan 2020, or earlier, and I've had Resolvecall chasing me as DCAs for Cabot earlier in the year Since this debt is covered by the Consumer Credit Act I will be sending CCA request to Cabot and ResolveCall. Do let me know if you think otherwise, Thanks in advance for your time on this!!   21. Hi all, Many years ago I took a Citi Credit Card and defaulted on it (at least 14 years ago). It wasn't a huge amount and a little over half remained unpaid, but the last COA on the debt was over 11 years ago, so would be statutory barred by now. I received a couple of letters recently related to the debt (and was advised on here a while ago to ignore such letters and not engage with the DCA's, even when I knew the debt was statutory barred). In the last few days, I received a visit from someone from Resolvecall, who didn't ring the bell (We have a video doorbell) but pushed a note through the door to call them regarding the debt. I know the debt isn't legally enforceable anymore. What is the best way to tell them where to go without getting into a spat with them where they dispute my version of events, and try to fob me with off that is enforceable etc.? I don't want them at my house again. Many thanks.
  22. Advice please, Received a letter yesterday from Capquest, regarding an old EGG credit card debt, this would have been from 2001/02 at the latest. Dryden Fairfax sent a couple of letters on their behalf chasing payment in 2019, the last one being in 2020, but nothing since (yeah I know I should have sorted it back then) They have now handed the claim over to Resolvecall. Resolvecall letter received today. My credit record is clear and no CCJ's show up on Trustonline. looking through the other forum posts I'm assuming if they had anything enforceable they would have done so by now? So my question is which is the best way forward, CCA letter or SB Letter? Debt is absolutely SB but I don't want to do the wrong thing. All advise welcome Many Thanks D.
  23. Hi, Capquest have been chasing me for several years regarding debt from 2009, defaulted Circa 2010. The debts in question were bought from Lloyds (Loan) and Orange telecoms. I have treated Resolvecall as irrelevant since Capquest recently threatened me with them. Doorknockers don't bother me, and I'm certain no payments have been made in far greater than 6 years. However, my memory is a little bit shaky regarding any written comms I might have sent to DCA over the years and to who. I am 95% certain that no contact has been made, as most of my letters from DCAs from my old life go into the shredder without response. Do I use a SAR to Arrow to be certain before sending them SB notices? If so, is SAR acknowledgement of any debt?

I've been following threads as I've been in exactly the same position with a Students Loans debt that I have not acknowledged for over 12 years, receiving exactly the same communication that you have received from Capquest. I sent off the statute barred letter yet have heard nothing back from Capquest, today I got a letter from Resolvecall saying someone is going to visit. Does anyone know the next steps I should take now? Can I sent the same statute barred letter to Resolvecall? Thank you
  25. Hi, I'm hoping someone can help me. I took out a student loan in 1997 for £1385 when I was doing my degree, which I stopped due to my Mum dying. I deferred it for years as never earned enough to have to pay it back. I moved in 2010 after deferring again, and although I had my post forwarded, didn't hear from them again until a few years ago started having automated phone calls and text messages from Capquest. I should have dealt with it at the time, but until a few months ago, still didn't earn enough to be eligible to repay. This morning I've received a letter from them stating if I don't make contact by 26th January they will instruct Resolvecall Ltd to visit my home. I've read some advice from different debt advice companies online, but wasn't sure if I should ask Capquest to prove the debt, or try to argue it is statute barred due to the age. I know the rules for student loans did change, but not 100% sure what the change was. Has anyone had something similar? What would you suggest I do to try to resolve? The debt now stands at £2037.43 according to today's letter. thank you Becky
