  1. I have a question that maybe someone could help me with. My father died just over 4 years ago and he left a will but I never got sight of it. My brother is the executor of the will and when I asked him what the will contained he told me not to worry about it. My mother is still alive and her will, will mirror my fathers. I rang up the Solictors who hold my fathers will and asked them if I could obtain a copy of his will and was told that he wrote a letter to the effect that I was not to see it and only my mother and my brother were to have sight of it. I was hurt by this and still am. I understand through other members of the family that I was cut out of the will and everything will go to my brother on my mothers death. I am not out to cause trouble for my elderly mother or brother but for the life of me I don't understand why and would like to obtain a copy of my fathers will just to reassure myself I suppose. Can anyone help me?

  3. My car was stolen from outside my house last night - I still have the original 2 sets of keys, so no idea how it was stolen. Today I've spoken to the insurance company and am due to speak to them again tomorrow. I've been looking through my paperwork and realise I didn't declare a speeding ticket from 2 years ago - will the insurance company still cover my loss or is my car insurance invalid? Many thanks for any help

Hi After reading various articles on this site (thanks everybody), i sent a cca request to debt recovery company they didn't send a cca agreement and after a couple of phone calls of them i explained i very politely i wouldn't talk to them via the phone until they provided it. This was approx 3 months ago and up until the last week i didn't hear anything off them. This last week ive had 2 letters the latest threatening me with Data being passed to our internal investigation department Your account will be approved by way of judgement/decree securred in a local court The debt will be transferred to a Debt Collection Agent who may call at your home Then inviting me to contact them. Few questions really, is this just a scare tactic? What do i do next? It was my understanding (limited) after reading various posts that without the cca theres not a lot this company can do Thanks for any help
  5. Howdy all! Long and short of it is, for years I had an account with Abbey National, then changed to Abbey obviously. I went to Uni and had an overdraft with them of about £1500. When I left uni I didn't have the money to pay off the overdraft, but stupidly had my pay put into another basic savings account which eventually Abbey decided to swipe £700 pounds out of to service the other debt which by now had defaulted (I believe). After that I didn't go near Abbey accounts again and set up one elsewhere. The question I have is, the debt hasn't been transferred to a DCA but I get yearly statements from Santander saying that the balance is "X" and the letter says they have to send me this yearly to keep me up to date. I'm certain there are charges on this account that I could claim back but not enough to wipe out the debt, so I'm wondering if the debt is unenforceable despite the fact it's only an overdraft - does it work the same as a credit agreement? An overdraft is a form of credit, no? Any advice would be great and I'll try and answer any questions as best I can. Thanks
  6. Hi All, Just been reading another thread and thought I would re-post about my problem with Welcome Finance. I took out a secured loan in 2006, the property was repo'd by the original mortgage lender (I gave them the keys instead of going to court). Welcome got a payout of 10G from the sale, I thought that was that. About two years ago they came back to me demanding a further 10G as it was a shortfall, so began a very long and inevitably fruitless complaint with Welcome. All until the last letter that I had which stated: "The loan was pre-paid, which means the loan was in CREDIT at that time not necessarily settled" I've sent my complaint to the FSCS on the advice of the FOS, however am I right in thinking that they should have settled the loan and gone no further? As they are a failed company guess they are trying to get as much money off people as possible.
  7. Hello all. Been a while. Had the letter from Apex to say they have "purchased (my) account with all rights ...". Included in the envelope was a bw letter supposed to be from Egg saying it was "notice of the assignment of the debt due to us ..." First thing should I start this thread here as I live in Scotland - or start one on another of the more general debt or DCA forums? Other thing is just to start by saying I'd an Egg Loan and an Egg credit card. CCAs sent for both well over a year ago. Got nothing for ages then two copies of a muliple page computer printout relating to the loan. There's a signature but everying is on separate pages. It also arrived well after the deadline. I have pointed out that the accounts are IN DISPUTE in all communication since. I have been making small monthly voluntary payments via standing order (in the interests of goodwill). Settled with all other creditors apart from Egg and one other for amounts between 40% and 70%. That money is now all gone - I warned Egg that would be the case. My goodwill is now gone with this Apex nonsense. (1) Thread in the Scotland forum or...? (2) Account passed to Apex (so they claim) but was IN DISPUTE. Should I aim to get it back to Egg but pointing out it can't be sold while IN DISPUTE - or get Egg to confirm that's what they've done then stop all apayments (both Egg accounts card and loan) and CCA Apex and see what happens? Many thanks in advice for any help/advice. This place is great, really great.

Hi all, I have received a letter today from Hamptons legal regarding a debt I have with O2 - although I have never made any payment and have a SAR or the equivelant you receive for a mobile debt. Basically the jist of the letter is thus - We are now going to request a copy of your credit file from Experian the credit reference agency, which will help us decide what form of litigation is best for us to recover the monies that are due. Any ideas folks?
  9. Just under 2 years ago my Barclaycard went to Mercers, and I received a default notice on Mercers headed paper. The account was then transferred back to Barclaycard. I've been trying to keep up with the reduced payments (£50+ per month) they then agreed with no interest, but having been back to CCCS with my current situation they advise a £1 token payment at present. Things are due to improve once priority debts are paid off but this will take about 12 months, and I am now on a payscale ladder so things will improve next year. Barclaycard have refused this offer and their previous letter said they would send a default notice if I didn't send the £50+ payment in 7 days, and will add interest again, their current letter says they will send a default letter if I don't contact them (no timescale given, but it is strongly implied that I telephone) Can someone knowledgeable please advise the 'rules' and implications about a second default notice for the same account? Thank you in advance.

  11. Hello, I moved property 3 months ago. When I chose this location, there were several factors which were very important to me. 1) A NTL connection had to be available, which the estate agent told me was available, and they even showed me the NTL connection. 2) That there was CCTV around the entire property, which there appears to be by various cameras placed around the property. Since I have moved there, I have found out that: 1) The NTL connection is infact a dummy and does not work. I approached the letting agent about this and got the following response: ********** Response: With regards to the NTL. This is the first ive heard about it. And as far as i am aware if you are in a non serviceable area then NTL would'nt install a connection point. If there is a connection point Joseph would assume like anybody else would, that NTL would supply a connection there. ********** 2) The CCTV camera's are ALSO dummies... I also approached them about this and they came back with the following: ********** Response: With regard to the CCTV this would be down to the Managment Company (SLM) TEL: 01482 328068. ********** Now why do I feel like I'm being fobbed off here and that the buck is being passed on. What options do I have to sort this out? Also in light of this, can I dispute the £120.00 administration cost which they said was for 'administration and credit checking'? Thanks and Regards Adrian
