  1. Hi I was recently made unemployed at the end of May. My wife is still working 33 hours a week and we still have 2 children, 18 and 15, living at home, both are in full time education. I was advised to claim for tax credits but on looking through the application it only makes provision for earnings in 2011/12 ( when we were both working) but i can't see anywhere where i can record earnings for this year? It's kinda concerning me cos having checked the tax credit estimator using last years figures we are not eligible for tax credits but using this years figures we are?? If i'm missing something and the estimate is right then i will stand corrected cos i inly want whatever i am entitled too, but it does seem a bit odd that they base the outcome on last years figures. If anyone could shed any light on this or offer some advice it would be greatly appreciated Thanks in advance
  2. Can anyone explain what this means? I'm in an ongoing case and the costs order was made very early on, i now notice that the solictors are now including items for pre action in their costs and thought that these had been wiped out by the order made but now i'm not so sure so if anyonecan explain the above wording i would be very grateful.
  3. Hi, this is my first post. I have a problem. Me and my boyfriend are in the process of renting a flat, it's the first time for both. Our situation is a bit complicated. We were living with his mum until October, she was the tenant, then she was evicted. His sister is now putting us up. I moved here in the UK in November 2010. I haven't found a job here yet, I don't have a bank account as I don't have an income and I am not entitled to JSA anyway. My boyfriend is working full time so he was supporting me and he is now as well. The agency requires two proofs of current address not older than 3 months but how am I supposed to have what they want (like bank statement and so on) due to my circumstances and since this is a temporarily accommodation? I am not even sure my boyfriend can supply 2 proofs of this address, maybe a bank statement, but we don't get utility bills obviously as it's not our house, I couldn't anyway since I don't have any income and I didn't have my own house and he didn't either. I do have letters from DWP regarding my NIN, but they're much older than 3 months and have the old address we were evicted from. I was thinking of discussing this with the agent himself, but first I'd like some sort of advice, mainly I wanna know if this can be a big problem. Is there a way I can get a letter from some authority in like 5 days to have as a proof of address? Many thanks in advance
  4. I agreed to a Tomlin Order and they haven't paid! The court told me I have to fill in form N244 and apply to have a CCJ entered against them, then and only then can I commence enforcement of the Tomlin Order Schedule. Does anyone know how to fill in form N244 to do this? I know these things need to be specific and I've found lots of advice on the net about filling in applications to set aside Judgements but this is completely different. Any help would be appreciated!! Thanks in Advance!
  5. Hi. I have received a court claim from Link, for an old MBNA account. Ages ago I asked to see a copy of my credit agreement etc and they sent me, after months of waiting, a crappy photocopy of something which says credit agreement on it. They also sent me a letter stating they are charging me £102 for litigation fees, which they are required to do by law. I guess as they have 'proved' the debt then I would be wasting my time trying to argue with them?
  6. More for getting my own thoughts straight on defective D/N's I understand that the DN must specify a date for settlement and not "28 days ( or whatever) from the date of this letter. So, if a DN is deficient and defective can any DCA be told to get knotted on this or should it be initially via the CCA route/"Bemused" letter? and presumably it is not a good idea to tell the OC that their DN is rubbish? perhaps, if it ever gets that far, to wave it in Court? In addition, I presume that being sent a specimen pro- forma DN letter, with no specific personal details, never mind exactitude of dates is also to be regarded as worthless? Sorry if this appears silly questions, I am preparing a flow chart guide and want to get all aspects covered, I am very comfortable with CCA, bemused, defaulted, and all the other template letters so helpfully found here Many thanks
  7. Although RobWay have failed to provide me with a enforceable credit agreement (just an application form) , and despite several letters to them telling them the account is in dispute they sent me an email the other day asking me to contact them. Well, I'm not too bothered about the contents of the email, but how on earth did they get my email address? I can forsee worrying consequences if DCA's start emailing all on sundry, especially if they are work email addresses. So, just how did they get my email address? Been dealing with them for years, and never emailed before.
