I have recently made a successful claim for missold PPI from EGG I have concerns about the conditions they have placed on the claim payout Part payment by cheque and part into the account but long since defaulted and gone from CRA files, should i be wary of this payment into the "still open" account ? I have also done a SAR since the remaining amounts owed are charges and interest or penalties and i await an outcome I will scan and post the letters later today Many thanks
  2. Hello, I'm new to this website so apologies in advance for any poor etiquette. Last year Egg sold my credit card account (started in 2004) to Barclaycard. At the time the account was in dispute as Egg had been agressively rate-jacking the account. Because I had been writing to Egg to complain at one point I checked my account online and saw that the balance was £0.00 so I thought that Egg had accepted my complaint. However they had 'transferred' their rights and duties to Barclaycard who immediately started pursuing me for outstanding balance of approx £4500. I refused to enter into any agreement with Barclaycard as I believed my account with Egg was in dispute at the time they sold it to Barclaycard. Well you can imagine the following months. Barclaycard have sent every kind of letter - I've been contacted by at least six different DCAs all claiming to have some kind of right to collect the 'debt'. It's been pretty tiresome. Furthermore Barclaycard have registered that my account is in Default with the credit reference agencies. This particularly upset me as my credit rating - up to that point - was excellent. Also when you look at my Equifax file the default is stated as a default on a 'Barclaycard Agreement' - there is no mention of my Egg card agreement which was up to date and in good order when they sold it - the Egg card agreement has been erased?? So I requested a copy of my 'agreement' with Barclaycard under 1974 act and received a bad copy of my Egg agreement? and also they sent me their new terms and conditions which mad no sense as I had informed them I didn't wish to enter into an agreement with them - especially as their actions surrounding the Libor scandal showed them to be untrustworthy. So no agreement there. I wrote to Equifax asking for proof of the 'agreement' that they were saying I had defaulted on. In fact I sent them a very strongly worded statutory demand that they remove the information unless proof was provided as a precursor to my being able to take court action for libel. Equifax sent me an email saying they had spoken to Barclaycard and Barclaycard had told them the information was correct - So no agreement there. I am now nearing the end of a complaint with the Financial Ombudsman Sevrice regarding the above and this morning I received the following in an email from a FOS adjudicator: Dear Mr XXXX Many thanks for your e-mail and the attached documents. I have added the documents to your file ahead of a final decision by an Ombudsman. Generally businesses are obliged to report a true and accurate reflection of how an account is being managed to credit reference agencies. Whilst you have stated that the account is in dispute, payments have not been made towards the account for quite some time. Therefore, this has to be reflected on credit file. Barclaycard is not required to provide any proof of an agreement. As stated in my email dated 20 September 2012, the terms and conditions of your Egg account allowed Egg to transfer its rights and duties under the agreement to any other person or business. Egg transferred your agreement to Barclaycard and it is under this agreement which payments are due. If you do not wish to be in an agreement with Barclaycard you would need to pay off the outstanding balance first. It's the line 'Barclaycard is not required to provide any proof of an agreement' that disturbs me. How can the FOS stand up for impartiality when a bank harasses somebody for money without any proof of any agreement. Has anyone got any advice about how I can force/persuade the FOS to come to a fair decision about whether there is an agreement. Also I would appreciate any advice knowledge on whether there is an agreement. Is there one? What does it mean that Egg can transfer rights and duties when the third party (Barclaycard) are not named on the original agreement. Does my refusal to consent to enter into an agreement count for anything? I mean if Egg sold my credit card account to a criminal organisation I wouldn't be expected to contract with them would I? What is surprising to me is that when you look up Credit Card Agreement Law in google there is no wiki entry that deals with what kind of an agreement/contract a CCA is? Well - any help or advice would be hugely appreciated.
  3. Hi Ive have received a reply from Egg saying “After carrying out a full review of your account. I have etablished that you purchased the insurance through the egg website on XX Nov 2001 Our online sales process: - Does not require you to take repayment protecection insurance as a condition of obtaining the credit card. - Does not provide an advisory service - Required you to positiviely confirm that you wished to purchas this policy during the online application - Provided full terms and conditions of the policy and requested you read them before submitting” I was unhappy with this response particularly with the use of present tense and not past tense “does NOT require you to take repayment protection…” Can you please tell me my what the next step should be as I believ that the box was pre ticked or you could not go further unless you ticked the box. I have looked on the site and seen lots of answers but after reading so many Im a bit confuse. Thank you
  4. Hi folks, I'm enquiring on behalf of my wife, we wrote to egg 6 months ago and they said we had no PPI. We were going through some statements and found that there was PPI and wrote again. It seems that Canada Square Operations are looking after this now and acknowledged that PPI was taken out. The thing is she did cancel the PPI before the end of the PPI term. The offer has come as follows. Total PPI premiums which you have paid £xxxx PLus interest on premiums paid £ xxxx Plus 8% interest £xxxx Sub total £xxxx The Sub total is quite a healthy sum but the next line reads as follows Less any previous rebate paid £xxxx Now this reduces the total by quite alot, the thing is she has received any previous rebates or had any money back when she re structured the loan a few years back. Is it the case of the total premiums paid is the total amount of the policy if you were to full fill the whole term of payments? And the said rebate was the amount left of unpaid payments as she cancelled it early and never did the full term. The offer that is left is quite good, is it worth trying to get the rebate back as it is worded ' premiums which you have paid' or is it just the case of how the policies work that i outlined above?? Also does anyone have a phone number to contact them as it seems strictly writing as i can't find a number anywhere. Many Thanks in advance. Olliepup.
  5. Hi, Sorry to start a new thread but can't find any of my old ones! So, following on from my previous post which was something along these lines: I sent Egg my FOS Questionnaire and SOC and they responded very quickly with a "NO". I had some fab advice here and DX wrote me a template which I sent telling them to prove the box wasn't pre-ticked and that I could have continued if I'd un-ticked, respectfully refer them to the news article of them being fined blah blah. well the 8 weeks is up and still no reply to my "prove it" letter so shall I send a LBA or go straight to FOS?? It's only £300 so was hoping they'd cough up rather than me take to FOS. Citi paid me out and the PPI was same time and same reasons given. Citi and Egg are SAME COMPANY! even the addresses that I write to are exactly the same and the same person always signs for my recorded letters. Is there a template to send or is FOS my best course of action?? Thanks in advance
  6. Hi, Getting some money back from Egg - not much about £600 - but the clowns seem to be taking much longer than the promised 15 days. Cannot get through to anyone as it cuts you off and tried calling Barclays who are just rude. Know Barclaycard took over Egg but need contact details of the loan bit - email or phone that gets through!
  7. Hi Everyone, I'm not sure where my original post have gone to, so a brief background. I have been trying to obtain information from Barclaycard for an old Barclaycard, opened 2001 and closed in 2005. In addition to this, I am also doing the same for an old Egg card taken out in Oct 2004 and defaulted in 2006 and I'm still paying off. My mission started in March. I have sent four SAR requests, initially advising that there was no information relating to me on their records. Second attempt included a single statement for the Barclaycard and the details of my repayment plan for the EGG card, I was sent a form that highlighted the dates during which I had PPI on the Barclaycard, but nothing for the EGG card. Also the response stated that as I was requesting information purely for PPI they were returning my £10 and if ther were wrong write back. I had sent a full SAR request, so wrote back advising this. Again, no information was sent as they had no records of me - despite me including their print out of my PPI history (no premiums, just start and end date customer number etc. At this point I phoned and got passed from pillar to post, eventually I was passed to a helpful lady in the EGG collections team who agreed to me faxing the info and she said that she would pass it through their internal post. Today I have received the EGG information, 4 £20 charges and a years premiums of £30ish pm - I cancelled it after the first year. Much to my joy, the EGG application that they sent to me did state "N" against payment protection insurance, so this should be a pretty easy win . It's scarey to see though that at the time I had a salary of £13k, net income of under £900 and they instantly gaem me a £4,000 limit, I'm not sure that that is entirely what I would class as responsible lending!!! I'm still waiting for the Barclaycard information, which I know will contain a lot more charges (3x£20 on the one statement I still have, althought the card limit was only £300 so I dont expect the PPI to be much. I will also be trying to reclaim the Barclaycard FAP premiums as I was bullied into this. Any advice before I proceed?
  8. Hi, I've successfully made a PPI reclaim but I'm not sure if what they are offering is correct. The loan was for £7500 with £872 PPI added to be repayed over the term of the loan. The loan has been repayed in full but 15 months before the end of the loan term I entered into a debt management plan. Egg have offered me the interest on the premium paid plus the 8% compensation interest. They are not refunding the £872 premium paid as they claim this was rebated when the PPI was cancelled. I have the loan statements and I can't see any rebate listed, only payments I made. Arrears were cleared after 6 months and the loan was repayed in the normal loan term (54 months). The Egg loan PPI claim number is now fully automated and I can't speak to anyone, only write to them. Has anyone else had an issue like this? You'd think that if the case has been reviewed by someone then the decision would be correct s o am I just delaying getting the £526 they are offering by writing to them or is there a good chance they are hoping I'd accept and not question it? Any advice would be grately appreciated!
  9. Hi, I used to have an Egg Credit Card that was taken over by the delightful BarclayCard last year. As BarclayCard have taken over my Egg Card, who do I put te request to for a SAR. How would I ensure the who ever replies send all details of previous Credit Cards, for exmple I think I had a replacement card due to losing one. Regards

    Egg Loan - Help

    Hi, I had an Egg loan in 2001 which was defaulted late in 2002 for various reasons. The balance was around 3.5k. I have since then rebuilt my credit history and on checking my reports i am in good health and have been able to obtain credit. It is now 10 years on and i have not heard anything about this loan - what could have happened to it? Is there anyone i can contact to find out as i would like peace of mind.

    Egg and Apex

    I had a debt assigned from Egg to Apex about 20 months ago. When it was assigned to Apex I sent off for CCA which I received back from Apex. I don't know if the CCA was enforceable or not as I never really looked into the matter. I have never given Apex a payment and I stopped paying Egg again about 20 months ago. I have never heard anything from Egg or Apex since. On one hand it is great and on the other it feels like it could creep out the woodwork at any moment in time. I own my own home with small amount of equity so I don't want to risk that. As far as I am aware Egg went bust. Can anyone tell me why it is I haven't heard anything for all this time. If I could get an insight into what is going on then I can decided whether to contact Apex and sort something. Thank you.

And is the letter and address below still OK? Under the Data Protection Act 1984 and 1998, and including the right of subject access under these acts, I hereby request that you supply me with any and all historical data in your possession which relates to me and I am entitled to under section 7(1) of the Act. If you store any of the older records on microfiche, please be aware that the Information Commissioner deems this to be a relevant filing system under the Act. As such, any microfiche data must be sent to me in fully legible and comprehensible form. Additionally, where there has been any event in my account history over this period which has required manual intervention by any member of your staff, or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention, or other evidence of that manual intervention in relation to my business with you.   13. Hi everyone, Thanks to all your help I have received an offer from Barclaycard in acceptance of my PPI claim. I requested a SAR and got loads of documents that confirmed that I did not take out a PPI policy until 2 years into my card. By the contact details in the SAR it was also clear that no contact had been made with me anywhere near the time that I took out the policy. I do not recollect taking it out and their details would appear to show that no contact was made and so I think that it was applied to my account without my knowledge (and Barclaycard seem to agree). The offer consists of a refund of payments made + interest charged + 8% of simple interest per annum. Whilst this would seem to quite good I was annoyed when I looked through all the SAR statements that I was put over my credit limit on a very large number of occasions by an amount less than the premiums. I was basically charged £20 a time for many months. I realise that I do not have to accept the offer but would like to know what happens in the offer process. Would it take a long time to process (I do need this money and it would make a big difference so if it would take a long time then I will just accept). Also, do you think that I should be pushing for more due to the questionable circumstances of the PPI policy being added to my account. Many thanks for all your help in getting me to this position.
  14. Hi, all I'm new to this site. Hope you can help. I used to have an Egg card (from the late 90's, I'm sure I had it for 5 years at least and there was probably about £5k balance ). I am no longer with Egg. I have written to B/Card who have taken over Egg, asking them to investigate my PPI complaint. Received a letter back from B/card regarding the egg cc account, saying they can't find a CRP (Card Repayment Protection Policy) in my name but if i can provide them with further information relating to the policy or a copy of the policy document, they will re-open my complaint and investigate further. As Egg was on-line, I never needed to print the statements and just read them off the computer. As a result, I don't have any hard paper copies and can't check if I did in fact pay PPI. Could anyone on this forum please tell me how I would be able to view my statements or get a copy of them? Unfortunately, I don't have access to my old email address that was associated with my account. Any help would be really appreciated Many thanks in advance. Sam
  15. Hi, I was wondering if anyone can help me with this. I have received a letter from Egg regarding my PPI complaint, they have upheld the complaint and are stating an amount to refund me. That is all perfectly fine. However they say later on "As you account is still open, your account will be credited with £xxx to put your loan in the position it would have been if you had not taken PPI. This is in line with the FSA guidelines." The account went into an IVA in November 2005 and I have the certificate of completion of the IVA dated June 2011. So effectively the account is closed? They are wanting to credit over 50% of the refund back to this account that now i think is closed, is my thinking right? I have started a letter to them asking for clarification, as the phone number they supplied is only a recorded message, but wanted to check that my thinking is correct - or if not just accept what they have offered.   16. Hi All Just had a letter from Barclaycard/Egg and they have upheld my complaint. This was for PPI that was added to my account when i was self employed (and also not in good health) won't bore you with all the details but i basically sent a generic complaint form from the web. They acknowledged reciept. After not hearing anything again for approx 50 days i sent a letter chasing it up and politely asking if i should go through the FOS. Got a letter of apology within 4 days requesting more time (which i granted) 2 weeks later got an offer letter together with an acceptance form. God only knows why i ever thought about using a no win no fee company for this, if I had it would of cost me £2000+ and it was a sinch even though i had no paperwork and i am pretty fick! The offer is for the refund of all my payments plus 'simple interest' the interest works out at twice the amount of the payment refund. I know that compound interest would calculate to more but finding myself in financial difficulty at the moment i have wimped out. The only down side is that they have suspended a totally differant credit card account which is a bit of a bumma and they have also demanded that they clear the balance of the previous egg card account from the awarded funds (but i would've done that anyway) One last point, i have given them 14 days to pay the funds directly in to my account, they have earnt enough interest off me by now. I informed them that if it isn't done by then i will pursue compound interest for the whole amount from day 1. Sorry if i've waffled, but hopefully the ease of which i have won will spur people on to get back what they are entitled to. All the best, Bad G

I've been receiving letters/e-mails/texts and phone calls from Mackenzie Hall over the past couple of months all saying the same thing, i.e. we ned to contact the named person in relation to a personal matter etc but nothing more. I've recently come back from holiday and have received a letter from them finally detailing what they're chasing me for, the letter is below: Date of Letter: 28th August 2012 Ref: M******** Client Ref: ******* Pursuers: Cabot Financial (Europe) Limited Original Creditor: Egg Principal Sum: £****.** FAILURE TO RESPOND NOTICE Dear Mr ******, Despite previous correspondences you have failed to respond. We have obtained this alternative address as a financial link, linking this address to the previous abode. The financial link information was supplied by a credit reference agency. We have been instructed by our client to recover this overdue amount on their behalf. Our clients have informed us that they are unaware of any legitimate reason for non-payment of their account and although they would prefer an amicable settlement, they will not hesitate to take further action as may be appropriate. We trust that this will not be necessary and would request that you send your payment by the deadline below: ------------------------------------------------------------------------------------------------------------------------------- Payment Deadline: Noon, 4th September 2012 ------------------------------------------------------------------------------------------------------------------------------- If you have recently forwarded payment or if there is any issue you would like to bring to our attention then we would ask you to contact this office immediately by telephone on 0844 411 5068 Important: If you are not the named person above please contact us quoting Address ID: CM******** to stop any further communication. Now there are a couple of things I'm not sure about, I've checked my credit file (Check my file and Noddle) and they both have the same thing on there, namely, Egg have a default on there against me which shows payment history ok until August 2006 (When I started having trouble) 1st missed payment in September 2006 and then it shows debt assignment in October 2009. Then there's an entry from Cabot starting on October 2009 and it's still showing as default now. Both entries are obviously for the same Egg card and they both say they're reported until October 2012. My questions are this: 1. Is it normal to have 2 entries for the same account by 2 separate companies like this? 2. Can I send the Statute Barred letter now, or should I wait until October? 3. The date of default on the Egg entry states 26/10/2006 but the entry for Cabot says 01/10/2006, isn't the date of default usually a few months after the actual last contact/payment? I'm confident that I've not paid/acknowledged or contacted Egg in any way since the very beginning of August 2006 so I know that 6 years has passed but I'm worried that if I send the statute barred letter now just before it comes off my credit file will the timer reset?   18. Hi I took out an Egg loan in 2005 to consolidate some credit cards. The original loan was for £9000 and the ppi single premium was £2085. My monthly repayments were £170. I felt pressured at the time into taking out the policy but I don't believe I knew what I was buying and was just happy someone would lend me money. In about 2007/8 I refinanced with Egg with a new loan which was £13000 at 12.5%. This loan has since been taken over by Moorgate but when I called them they said I didn't have ppi. I have my paperwork for the original loan but not the more recent one. I have written to Egg to complain and request my money back plus interest etc using the template letter. My question is how much should I expect to be offered? I can't open your spreadsheet as I don't have the right version of excel to do the calculations. Just a ball park figure would do. I think I am owed the original £2085 premium plus 8% interest on that plus the 18.9% of each of the payments of £170 per month I made which I calculate to be about another £2600. What would be a reasonable offer from Egg? C
  19. Hi After a lot letters Egg have finally sent me my SAR information. It appears that I had been paying PPI since I opened the card account in 1999. However, it mysteriously stopped without my having cancelled it in March 2005, I am not sure how I would have asked them to stop paying something I didn't know I was paying. I closed the Egg account in 2007. It says that I applied via the internet for my card, I cannot remember ticking any box saying that I wanted PPI. I was reading something about this box being pre ticked on the Egg website in the early days, do you know if this happened in 1999??? If so did this mean I was mis-sold? I have calculated the amount to be £2277 paid in PPI on my credit card so you will understand that I am keen to pursue this claim. Can anyone help me with my case, I have got this far with the template letters on this site, but just need a bit of help. Many thanks
  20. Bit of a long shot here but does anyone have details of the main man still at Egg Derby. If there is such a person nowdays. Was going to proceed with a claim for unfair charges but suddenly realised who exactly am I after for these charges. Account is an old Credit Card. It was sold pre Barclaycard to a DCA so this would I believe let Barclaycard off the hook. I have never seen anyone trying to claim back charges from a DCA that they have not put on themselves (By that not seen anyone on here trying to get a DCA to cough for OC's unfair charges) The remainder of Egg was sold to Yorkshire Bank after the Credit Cards were sold on. Would anyone have any idea's as to who I should be chasing or is this dead in the water and not worth the stamps and paper to try and reclaim now? Many thanks for any idea's.
  21. Hello there - I had an Egg credit card which had PPI from 2004 to 2006 - inappropriately sold to me. I complained and Barclaycard have offered me a settlement. I'm confused about the compound interest quoted though - they seem to have calculated the compound interest from 2004 to 2006 - whereas I had thought that given they have wrongly had this money since 2004 till now, the calculation of compound interest should run till now. Who is right? Really grateful in advance for any advice!
  22. I took out an Egg Loan in 2002 for 60 months to consolidate cards etc and have some work done at home. The loan was £15900 and £3452 was then added on top for PPI - total amount £19352 !! I don't recall adding ppi or being asked the question / given the choice. What value would be the anticipated reimbursement, should I brace myself for a battle ?

    EGG Loan Info

    Hi, Firstly, this is my first post so hello I had an EGG loan about 11 years ago, and I was sold PPI. I'm trying to claim, but like an idiot I threw any paperwork once the loan was cleared, and its not detailed on my Experian report as I cannot remember the address I was living at the time. Does anyone know if I can call anyone to find the info, or if I can submit the PPI Claim without that important info? I have tried calling Egg but I just get an automated message. Thanks Tom

Hi I posted another thread today regarding an old MBNA loan with PPI added, and I've now found on my credit file printed in 2008 a further loan from Egg dated from late 2003, which I'm pretty certain had PPI. Has anyone had any experience with Egg in regard to how far they provide data for a SAR? Do they only provide the necessary 6 years or do they go back further? I still had a credit card with them in 2007 so they would be obliged to provide details in regard to that, but has anyone had anything from before the 6 years they are obliged to provide? Thanks Further, , what would my position be if I'd reached a Full and Final settlement with a credit card lender - not Egg - and have a letter to confirm they won't pursue for the remaining balance, but then discover that i'd paid them PPI on the card over a few years? Would that be worth pursuing, or would they just turn around and say we'll deduct whatever might be awarded to you from the shortfall in the settlement... Thanks
  25. Hi Everyone!, Not sure if anyone can help at all but here goes! My husband had an Egg credit card for years which was taken over by Barclaycard. We paid this account off in full November last year. We want to check if we had PPI on this account. We have tried calling Egg (as we only have thier ref number) and they say we have to call Barclaycard. Called Barclaycard today and was told we never had PPI whilst with them. I want to just double check that this is the case as (unsurpisingly!) I'm a little sceptical of banks. Not sure how to get the information or where to get the information I know someeone must hold it?! Any help/advice is gratefully recieved.
