  1. Hi, Recently joined, so please go easy on me. I received an email from MMF recently, so called them. They claimed I owed a payday loan debt and they now have the rights to the debt. Having recently just cleared my credit file of all defaults, I was anxious about them reporting another default, so being naive I paid them £100 to stop them reporting to the CRA's. However, having done a little digging since, I am sure the debt was statute barred. Does anyone know where I now stand, and what my next course of action should be. If it makes any difference, I live in Scotland, where our debt laws are a little different from the rest of the UK. Thanks in advance for your help
  2. hi i have a aggrement with moneybarn and i fallen behind with payments i rang them in the begining of january and came up with a aggrement i got a phone call last night telling me that if i didnt pay 675 by 10am today they will cancel my aggrement what are my options i have gone round and got 300 and i get payed next week help
  3. Been renting a property for about 5yrs, never had an increase in the rent. Replaced fridge at our own expense with LL permission (They didnt want the hassle) got oven repaired at own expense wasnt worth the hassle of getting LL to pay but now the dishwasher has gone kaputt. Agents sent a guy out cant be repaired so need a new one, and this is something we are not prepared to replace and then take with us if we move, so insisting that LL replaces. In view of this wouldnt be a shock if we get a rent increase but i was just wondering if there is a percentage that it would normally go up by? Dont actually mind an increase as quite happy where we are and we can afford one but at the same time dont want to end up paying more than is reasonable. To be fair we dont have any real problems with LL who although they have a few houses we also know socially and although they go through an agent with the house we do speak to them directly when we want to do somthing to the gardens etc just to check they are ok. House is unfurnished, but fitted kitchen, I would expect an increase of no more than 20% if in fact we do get one but i like to be prepared. Thank You
  4. I should know this but the deeper I read the more unsure I am which to use. Under which section of the CCA should I request an agreement with the £1 postal order. 6. Helloo people, So my aunty had atos assessment today she was really not well but forced her to go there for assessment. She required an interpreter to translate throughout the assessment. She walked few steps, confused as hell, became quite tearful and made her comfortable in the room. The person who assessed seemed very caring and sympathetic till the end. she asked about few simple question and asked to go home in about 15 minutes total assessment. Now Question is why was it so quick? Is that something to worry about?? :|
  7. Finally I'm admitting that I cant keep paying back each month only to borrow again the next to replace the money I need for bills. I sent both companys and email saying I am not in a position to pay the full amount outstanding and wish to set up payment plans. I've read a bit on various websites that looks like I'm going to be in for a lot of hassle. Can anyone advise what to do now and tell me what to expect? They are both due to be paid this Friday so what should I be doing to cancel them?. I'm starting to panic now expecting to be hassled at my work which I can get in a lot of trouble for etc. Any advice would be much appreciated!
  8. Hi Guys I need a question answering can the original company you have a debt with and the DCA dealing with it can they both default your credit file for the same debt? Thanks guys

  10. F I L is looking at claiming back PPI and i just want someone to check this letter is OK ---------------------- I am currently looking at reclaiming PPI on the Credit cards, Loans and if there was any on my morgage. At the time of taking out these agreements the insurance would have been unnecessary as I was covered for injury/illness through a workplace scheme and feel that this insurance was therefore miss-sold to me. As i am also a type 1 insulin dependent diabetic the insurance was also miss-sold as i would not have been able to claim off it. Therefore I would like all the details on any of the above that I have held with you, I have only just been made aware through the news about the possibility of reclaiming these so the back limit of 6 years does not apply. Please provide all details of any Payment protection I have made on my various accounts, if you feel these records have been destroyed from age then I would like proof of destruction from your registered data controller, I am aware that you will need to hold this under the civil evidence act (1995). However I would like to point out that I am happy with my accounts and would like to continue banking with yourselves and may consider a percentage offer of whatever I have paid in previously. I look forward to your reply ----------- he also had a loan with purple loans that had PPI on it but has no details for these if anyone can give details that would be great
  11. It's the old Hippy again with just a quick question. If like myself me and ex have a joint liability i.e. we had a secured loan which is now become unsecured and the creditor goes for a CCJ do they do it on an individual case or Jointly, ???? or would they go after the one they think they can get the most out of. I am not really worried about it as I have my BR money ready if needed. I have seen off most of my creditors from the naughty 90s who could not supply any CCAs but I know in a few months time the lovely people at Barclays First Plus will come wanting there cash Hi to all my friends on here, life is good, health good and really enjoying not worrying about anything but life.... Letting go of house was a life changer, difficult at first but hey family grown up take the good memories with me. Nice rented detached and never been happier. Mainly thanks to you guy's on here. Hippy:smile::smile:
  12. Hi Have just purchased some furniture through harveys and took finance out through Ikano finance. I have my copy of the credit agreement and have signed twice, once for customer declaration and consent and the other that i agree to purchase the goods on credit. Underneath that there is a signature and date box for on and behalf of Ikano financial services limited. This is blank and has no signature or date in it. I was wondering should this be signed and dated to make this a legally binding agreement? Im sure someone will have signed the copy that was left at the store but if my copy has nothing on it signed by the creditor is this agreement enforceable?
  13. Hi, I have posted before about my problems with payday loans and I still don't feel like I'm getting anywhere! Each one of the payday companies i owe money to, knows that I am on Jobseekers Allowance and only get £56.25 a week. I have even faxed proof of this to a couple of the companies who have asked for it. I keep trying to come up with a repayment plan for each one but they're all coming back with £100, £80 a month which clearly I can't afford! Speedcredit started off at £100, I said I couldnt afford it, they lowered it to £80 which I again said I couldnt afford, they then lowered it to £50 and said thats as far as they will go. How can I possibly afford to pay that when I have other things to pay off and that is a weeks money for me! My question is can I say anything to them to make them lower it even more? I really can't afford to pay that when I don't work! Thank you!
  14. Hi guys, been battling my payday loans and im down to my final loan which is with QuickQuid. I took out £450 and the total repayable is £583. I opted for the two part loan where i pay the interest of £133 on the 1/11/12 (TOMORROW) and then the full £583 on the 29/11/12 This then somehow changed for the second instalment to the 15/11/12 which is only 2 weeks! Which wont be my payday! Is there a way i can avoid paying the £133 tomorrow as it seems like i'm literally throwing this money away! What will happen if i default this payment tomorrow. I could possibly pay them the £533 in one instead tomorrow but cant really afford to.. I will then have nothing left and wont have travel money, rent etc Whats the best way to go about paying only the £583. If i default tommorow and ask for a repayment plan? Thanks
  15. I have a quick question and wondered if anyone can help. If a debt collection agency writes a letter to you, do they need to have some form of proof of delivery in order to demonstrate to a judge that the letter was delivered? I can see a situation where a firm cannot prove delivery of correspondence and therefore could be judged to have not communicated in an appropriate manner before a final demand. This is all theoretical - I don't actually have any debts.
  16. hi i stupidly took out a loan with quick quid im due them 325 im just wondering what length of time do they do repayment plans over ive read they dont do long term plans anybody had any experience with this? thanks
  17. Say a company has a returns period of 30 days and will collect an item at their own expense. However they charge a 25% restocking fee. If something is returned after the first seven working days, but within the 30 days, are they allowed to charge the restocking fee? Thanks
  18. I defaulted on Barclaycard about 18 months ago I heard very little other than the odd letter about account termnination There was a letter about debt going to a DCA some months bac and endlesss phone calls I did not answer. Then Saturday a County court letter from Northampton arrived with a DCA I don't recognise out of the blue with no warning so I 14/28 days to defend. I am going to try and defend the action I am also going to ask for a SAR but unlikely to get that before the court hearing One thing I can determine is that as I took out the barclaycard in 1973 or maybe 72 they have no record of the original agreement. Is this a valid line of defence? The CCJ refers only to the acct number I think with nothing else. Please some wise advice! time is running out.....
  19. Hi guys i have just cleared some debt off the past month and am now debt free but vodafone, o2, t mobile etc are declining me credit and im guessing it was related to this debt i have paid up. I have paid my Virgin Media bills every month on time if not before the pay date and keep getting mithered to take out a deal in my virgin media account i want a samsung galaxy s3 on virgin but bit worried they might also decline me
  20. I obtained a £500 loan in September 2009 with FLM quick only to discover to my horror that I have actually paid £1800!! I am not working at present and I cannot afford the monthly interest charge and I don't want to cause bad feeling between myself and the guarantor as we are family friends. Is there anything that I can do?? This company are threatening court action if the payments aren't made, any advice? £518 still owed, the mind boggles....
  21. Hi, I just have a quick question about the Wonga Repayment Plan. I'm in my second month and on Monday they'll take the second installment out of my account. Now my question is: If I manage to get some money to either pay the installment a bit earlier or pay the remaining balance off, can I just go to their website and pay it off like that and would I need to let them know I did? I send them an e-mail about this but they haven't replied yet and I don't want to call unless I have no other choice. If I can do that, that would be wonderfull cuz then I'll be debt free quicker! Thanks for the help in advance
  22. I am getting lovely offers from Marlins over an old YB overdraft. Now I sent a SAR to YB way back in 2010. YB kept charging £25 for a returned DD even though the account were closed, they transferred my old joint account to a single account but did not move over the Direct Debits. Now between September 2009 - November 2009 total costs £275, now in the charges calculator does the interest go to the date the account was sold / closed i.e should I put in Sept 2009 - Dec 2009 or is it to the date of claim. ??? Excuse me for being dumb but this could nearly wipe out my debt with Marlins.
  23. Hi, been a long time since I last posted in CAG... I have a coupe of quick question about my credit file I'm hoping someone can answer. I have a default marked on my CR from December 2006, which was settled in May 2011. I understand the default period ends 6 years after the date of registration, in my case, December 2012 but I wondered how it would show on my credit report, as Equifax states: "The information will stay on your Credit Report for 6 years from the date the account was ended." - does this mean the date of default or the date of settlement? I really don't want this hovering on my CR for another 5 years. Second, I have a settled account from June 2011 that was never defaulted, but was operated 4 months in arrears for several months prior to the settlement. I know this has a bad affect on my Credit Score (which is gubbed atm anyway, thanks to the default!) but how do lenders view this as time passes and the arrears age? Do they still take them into consideration, even though they're over 12 months old and the account has settled, or do they lose potency over time until they are a non-issue? Thanks.
  24. Hi all. As some might know, ive been having calls off capquest the last few weeks for a debt i have no knowledge of. I know i have to send the Prove it letter and i will be doing so. However, would me sending them the letter along with my name and address put me on some kind of list. Like with what happens when someone answers their "security questions" on the phone? I'm pretty up to date with DCA's and their tactics, i'd just like to know where i stand with the letter and this outfit. http://www.consumeractiongroup.co.uk/forum/showthread.php?358672-Capquest-fun(5-Viewing)-nbsp is the thread with the info.
  25. A Mate living up in North Yorks has had his first ever visit from a rent-a-thug, it turns out the guy has his own one man band ltd bailiff firm and is being subcontracted warrants to enforce by Jacobs. His certificate however claims him to be an employee of Jacobs, and the Court he is certified have confirmed this. Does that make any difference, ie, is he still able to visit and attempt to enforce, if his certificate is wrong? I cannot remember at all re cert's its too hot for my brain to work properly At the moment, he has not managed to make any levy's. This is for a parking ticket from a Council "pay and display" park. It seemed weird from the info until mate got Jacobs to confirm it was subcontracting. This guy and his "registered office" (probably his home) is in Durham, he is enforcing in North Yorks, and his certificate authorising him to work for Jacobs is with Birkenhead Court. Our unwanted guest is the proud owner and director of A&C Bailiff's ltd. Company number 07459065
