  1. I'm replying to a SD, and would I appreciate some help as to which format the set aside should take. Is there a specific template to be used or can it take the form of a standard letter, laid out with the disputed points? Is there any particular wording that must be used. And lastly, which court does it go to, the original CCJ was county court bulk centre, but the SD seems to say that I should send it to my local county court - I don't want to send it to the wrong place and I don't trust the issuer of the SD to have given me the correct information. Also, should it be addressed for any particular department to ensure it gets to the appropriate place? Thanks in advance.
  2. Had Tribunal in Sep 12 and place into WRAG group. Dec 12 Tribunal Service inform me that my Decision Notice of that Tribunal was incorrect as had incorrect NI Number. Send me a copy with rough written in correction. Have, ever since been in conflict with Tribunal Service to get a corrected Decision Notice showing my correct NI Number. As, of March 13 now have corrected copy. DWP aware and had no comments. I am now asking them for reimbursement of my admin costs as it was their error. I have a letter from them saying sorry and their clerk made errors. I, want to get the matter sorted as my ESA ends at end of April 13 because of 365 limit. (Contributions based) You, may wonder why I took the trouble to chase this matter. Well, it was because of the Tribunal Service making so many errors. SO, PLEASE CHECK ALL YOUR PAPERWORK THAT YOU RECEIVE FROM THE TRIBUNAL SERVICE AND COMPLAINT, IF NEED BE. I am, very worried as to my future and wonder what will happen after my 365 days are up. DWP, has not contacted me. Its making my depression worse and I have bowel problems because of stress. I, may well take a break after my 365 day limit is up and job hunt myself without any pressure from the Job Centre. (This I fear) Live off my savings and re-apply for ESA later, after say 12 weeks. My GP is currently still supplying me with sick notes and my current one lasts until 13th June. Happy days. Thanks all for reading this. I really feel for the rest of you suffering at the moment because of the DWP.
  3. A friend bought a commercial fishing boat which will continue to be used in a business venture . The year old boat was advertised at 150k so he phoned to ask if that was the full price or is there vat to be paid . 150k covered everything he was told . All the correct paperwork from the vessel registery and departments of fishing etc were duly signed by both seller and buyer (a process that took months posting forms that needed both to sign back and forth) . But now he's told by the vat office he could claim vat back if he had an invoice and the sellers vat number . He has niether . The seller has long been a fisherman so is obviously vat registered and had the boat built only a year before . As the seller almost definately claimed vat back on the build my friend believes the vat man would send him a bill when the boat was sold (is that how it works ?) Hence my friends business should be able to reclaim the vat . The seller has always been good to respond to letters but never answers the phone . His general attitude is "if you need something signed just post it to me and i'll sign it" and has been true to his word every time . I wonder if someone could offer a template bill of sale that will not set alarm bells off when the seller sees it , that will also satisfy the vat man so the money can be reclaimed ?
  4. Hello all, This is my other debt issue, apart from the Equidebt one. I moved to Ireland 2001, inadvertently leaving a debt to PCWorld, and returned to the UK in 2007. Ruthbridge sent me a letter, I called them, there was an inconsistency in the details they held, and my recollections (the address they had was slightly different to what I remember, but having checked later, I'm pretty sure they are right). Because of this, they were going to send me (and I quote) 'the signed paperwork'. This was in May, I still have not received it, they insist they have sent me letters which I haven't received. They've called me three times, and I refuse to answer their security questions (which I feel is a sensible precaution no matter who calls me!). I've now diverted their number to voicemail. As I understand it, the fact that I have not received this paperwork (I assume it's the CCA) is an offence on their part? As it stands, am I quite within my rights to refuse to engage with them at all?
  5. Hi all wonder if anyone can help. I took out a secured loan several years back for £15k and have no paperwork other than an agreement number that is on an old bank statement. We paid off the loan when we remortgaged and moved house, is there a time limit as it is over ten years ago that I took the loan out... and if not presumably I will have to write to them for a copy of our loan agreement? Any help would be great x
  6. Hi all, first off, sorry if this is posted elsewhere. I could only find old posts, posts relating to, but not quite this question. I had an HP loan back in early 2000. Satander (Wagon finance) recently rejected my claim, saying basically: 'it was over 6 years ago, and since you have no paperwork - sod off'. (or words to that affect) Is there anything I can do?   7. Hi, I am hoping someone may be able to help me to decide on a course of action with a problem. The background is that an account for a business was opened using my fathers name last year, everything was fine and we have been actively using the account. In January of this year my father withdrew from the business and so we wrote to all the companies we held accounts with to say that he was no longer involved in the business and that I was now running it. This company acknowledged this verbally, changed the address on the account and also my name was on any paperwork that consequently came through. I have fallen into problems with the business and the situation has escalated to the point that Thomas Higgins Solicitors wrote to me (using my name) trading as my company name to ask for payment. I was still speaking to the creditor and telling them that I had every intention of paying the £5000 that we owed but needed time. The next thing that arrived in the post was court papers from Thomas Higgins looking to issue a CCJ but the forms are in my fathers name trading as the company name and not mine. I have rung Thomas Higgins and the creditor to explain but neither of them seem concerned. I am very concerned because although I am not denying that I owe this money I cannot afford for a CCJ to be issued in my fathers name. I questioned Thomas Higgins about the difference between their letter to me and the CCJ in my fathers name and they just said they are acting on their clients instructions. The creditor will no longer discuss this with me. So, should I acknowledge the claim but in my name trading as my company, make an offer of payment and then hope that if they issue it, it is in my name or should I argue it as it's not in the right name. I have my sneaking suspicions that because they changed the name over without us filling out any paperwork they are now panicking because they don't have a signed application form in my name. I am not disputing that I owe the money and never have I just cannot afford for them to issue in my fathers name.... I'm more scared of him than the courts I hope that someone can help as I have never dealt with anything like this before.
  8. I took out a credit card with lloyds in 1998 with ppi that was misold. I did a balance transfer to egg in 2003 but have no paperwork. I have also moved address a few times and got married. Where do i start in reclaiaming the ppi. I'm not sure what to do as it is off a long time ago. any help would be greatly appreciated.
