  1. It has often been said on here that a claimant cannot claim the above interest if the action is brought under the remit of the CCA. Well section 69 certainly does not say that. Now I know people will say yes but look here The County Courts (Interest on Judgment Debts) Order 1991 This appears however to relate to section 74 of the 1984 act not 69 am I missing something here???
  2. Same old story I'm afraid..... We had a loan via GE Money/Home lending for £5500 and had only managed to make a few payments on the account when i lost my job. We spoke to GE and advised them of the situation, that the problems were only temporary and that we would make arrangements for the arrears to be cleared as soon as possible. The call taker insisted we make a payment arrangement but as we were living off thin air I was unable to do this. I offered £5 a month token payment which was refused and advised i couldnt do anymore at the present time. The debt was subsequently sold to Link Financial and shortly after recieving a letter from them we received a very rude call from someone at link who advised me "We own the debt, you owe us £6600 (or thereabouts) can you make full payment now?" I advised that I didnt have £6600 knocking about and that we would be able to make a payment offer but was just advised "we'll be sending you court forms" and the call was ended by them. Duly the court forms arrived and unfortunately due to fighting repossession we did not attend the hearing. CCJ granted and now they are going for charging order THIS FRIDAY 12th (in a court 60 miles from our nearest court!) . How can i avoid a charging order? Postpone the hearing?? It is in our mortgage terms that if someone applies for second charge they can cancel the mortgage/sell our house!!! I have just started a new job and could not get the time off to attend. Any payment would have to be small due to arrears on water/elec/gas etc and we do not currently have the money to pay court fees to have set aside???
  3. Hi, I currently have a credit agreement (loan) with Lloyds TSB and I am wondering if it is unenforcable? I really have been treated appallingly by the above company as I asked them 3 times for help and they refused (claiming interest rates) even though I was struggling financially (to which they just shrugged their shoulders). I then had to go with a debt management plan through another company. But Lloyds TSB still harassed me even when I was in the plan. I read the unenforcable credit agreement thread, but I had difficulty understanding it and am wondering if someone could help me to understand it? I have recently won a case against them for missold PPI (I don't know if this is relevant?) I would be extremely grateful for any help. Thanks
  4. Hi I made a complaint to the financial ombudsman regarding the charges that this company had applied to our mortgage. (we are no longer with this company). The ombudsman have come to a decision that SPML must pay us 1500 pounds by the 28th August. SPML have not complied with the ombudsman when they have requested any paper work connected to our old mortgage. I dont think that they will pay up by this Thursday, so what will happen? will we have to take it to court? Can the ombudsman step in or because they ahve made a final decision is this as far as the ombudsman will go? Has anyone else been paid up when the ombudsman has dealt with their complaint? Thanks
  5. as above, CCA'd egg on 16/07/08. They responded with an unsigned agreement and nothing else, no terms, no other info. Wrote back to them to tell them account in dispute as they have failed to provide etc. put in the dispute letter the usual about "you may not pass this account on" etc but they've completely ignored it and sent a letter back saying the account is now closed and will be passed to a DCA for collection what do I do now?
