  1. Letter received today, 11/01/07 dated 09/01/07, [6 days after receipt of my initial letter], stating they disagree but as a goodwill gesture offering £720. I am returning the offer with a thanks but no thanks, am i right in saying i write as, I accept your offer of £720 as partial settlement to my claim to recover charges but will be continuing action to recover the remainder.... any other advice is welcomed before i commit myself,

  3. oooh also, my claim is for two accounts, my recent letter only refers to one, does that make a difference, do they need to acknowledge my claim for both?

Hi guys, update, I received a letter from Barclays [Mike Brophy, CR Manager] stating they are unable to reach a decision within my timescale, they state they will reply within four weeks or reply with a letter stating why there is a delay. Do I continue with my course of action and send my second letter, 'failure to respond' after 17/01/07 which is 14 days after they received the letter or wait for the four weeks?
  5. sounds like a no win situation here, The seller is obv a stubborn retailer and unless YOU are willing to fight it to the end, i.e in court, then a solution must be found between the two of you. Tell him you will return the goods once he has agreed to cover costs. that way you cant be accused of theft - theft is taking goods not belonging to you with the intention of depriving the rightful owner, this is thin ice anyway and i dont think your case would stand up in court as theft cos you didnt obtain the goods 'dishonestly' {The Theft Act 1968 Section1}. If you havent already received your item, tell him you want a refund, if you have paid by credit card or paypal, you may be able to get it refunded as non delivery. Im in the same situation but reversed, a company received my item in error and have destroyed it, after complaining [politely, LOL] i received a phone call after the deadline of LBA saying they wanted to resolve the matter, [still waiting tho] These days it seems the customer is never RIGHT doesnt it?   6. from past experience, reading previous posts, send letter back saying you accept the amount only as a part settlement and require the full amount. have a read of WELSHMANS thread, his has helped me out a lot, and he won. good luck

Hi, I might be wrong on this as im only following what has been advised in previous posts, charges can be unpaids out, unauth o/d fee or referral fees [as in my claim]. from what i gather, at this stage you simply claim back the £20's, £25's £30's from the charges, once your case progresses to court stage then you add the interest, [using the spreadsheet on here]. I actually calculated the whole lot [&8%] on my spreadsheet, forwarded it to the bank but saying at this stage was claimimg for the amount LESS interest [which will be added later]. Prob pay you to read 'WELSHMANS' thread who actually won his case recently. he gives a blow by blow account from strat to finish. hope thats helped, if not, tell me to get lost LOL

  9. with reference to missing Sandy12, lets just hope she hasnt done something stupid, after all she did appear very ashamed and at a low point in the early posts, a very sad story, lessons to be learnt if nothing else, and in all probablilty if she had mentioned that she had £6000 he would have needed £5000 and so on.   12. Okay confused now, got the letter to send off but where to? Does it go to my branch address or the Head Office in London? i suppose it doesnt really matter, im going to send it recorded so they cant deny receipt but if it goes to my branch only to be forwarded after a number of days sat on someones desk then its more delay, I want to hit them hard and fast. GGRRrrrrrrr!!! I also came across a thread with a zip file attached to help out with the court bundle preparation, cant find it now, anyone got any ideas?
  13. Buzby, Interesting comment about the SIM being switched off. Ive just called the number and received the following automated response. " The number you have dialled cannot accept this call " To me this sounds like its under suspension, what dyu think?
  14. Cheers Ray, I know what youre saying about 3GC, it was just annoying with their attitude, a case of not their problem - go away!. If I get the replacement value of the phone back from o2 I will be happy, at least then i can credit it to the 3G account to help out with the costs. SIM card was returned with the handset and has since been suspended by 3GC.
  15. I was looking on Will your bank charge you fees? | This is Money after reading about banks considering charging us for accounts under £2000. Has anyone heard of this action actually being put into practice yet? Looks like there will be a lot of people shopping around for a new bank if this becomes the norm.
  16. My last communication with them stated I will give them until 07/01/07 to offer compensation or replacement, failing that then it will be passed to the small claims courts. We will see. Could you imagine if the situation was reversed, if i had admitted receiving goods delivered to my door in error, all hell would break loose if i told them i'd thrown it away cos it wasnt mine. The idiots at 3G Communications are no better, they just keep saying because they have not had the handset returned within the 14 days then i am obliged to keep the contract running. £25 per month for 18 months - yeh great!. They did say I could purchase a NEW handset at a cost of £300 in order to make use of the contract. (HA!) or close the account at a cost of £550 (PMSL)

Thanks for the input, I have tried all of this, thro emails, telephone calls, in writing and their final answer is, "It was my error - they are not responsible" - They admit they have destroyed the handset as a security measure (yeh right!). I have threatened with small claims but to no avail. Its annoying because theyve actually documented details of the handset in their possession but say returned goods sent in error are not their responsibility.
  18. i have a problem with O2 destroying a handset that was returned to them in error. it was supposed to go to 3G Connections but i accidently put the label for the o2 sim card returns on the box. I admit it was my error, they acknowledge receipt of the handset but say because it wasnt one of theirs they will not return it or compensate me, now saying the matter is closed as the handset has been destroyed. they go on to say their scanning system would not have recognised it and it would have been destroyed as a security measure, BUT they clearly admit they have records of the SIM card being returned [in the same box] AND they have the phones IMEI Number on the goods received data. My prob is because 3G havent had their handset returned they will not let me close the account, at a cost to me of over £500 over the 18 months. The handset was a brand new Motorola A1000 SAT NAV phone which I find hard to believe that some idiot would destroy it, more likely keep it for themselves. i have threatened with small claims court but they wont comment. any advice out there?
  19. Hi, This claiming charges back was brought to my attention through a link someone sent as a general email so I thought I'd take a look. Knowing my bank have slapped these charges on my account I thought I'd have a go at getting some of it back. So here I go, I have calculated the amount taken over the last 6 years after a simple request to have all records sent to me. I have two accounts I am claiming on and have submitted them as a single claim [hope thats okay] I have used the standard notification letter to inform the bank of my intentions and attached the two spreadsheets with the amounts in question. Personally Im not bothered about the interest accrued but if they pay it out that will be a bonus. Just the charges alone amount to £1385. Annoying thing was, when I received the statements, in the same post was a letter of a further £30 charge! Why dont they just stop charging this stupid amount if they know people are on to them? Just got to wait and see what their reply is now. by the way, my charges are listed as different things through the 6 years, they start of as 'Unpaids Out', then 'Unauth O/D Fee' and more recently 'Paid Referral'. Are these all submittable? fingers crossed, the missus has already spent the money LOL
