  1. Hi I have been asked to attend the Justice of the Peace court in a few weeks after a citation to attend for enquiry letter relating to unpaid parking fines. I was paying back the debt at £40 a month (I'm on incapacity benefit so it's all I could afford) and I was paying it back until I missed a few payments due to illness and financial difficulty. I've now received this citation to attend for enquiry - and I'm worried about what to expect. The debt is current £390 and by the time it reaches court I expect to have raised enough to lower that debt to about £190 but I cannot raise the full amount to pay by the date requested. Do I need to consult a lawyer? What can I expect to happen? I am extremely stressed about this, given that I'm already ill and on benefits, this is adding to existing stress and depression. The court have offered no advice other than if I don't turn up, I will be issued with a warrant for my arrest. Can anyone offer any advice or help? Thanks L

  3. I received a letter this morning from the Scottish Court Service regarding outstanding parking fines. They say I have 7 days to pay or further action will be taken. I am on incapacity benefit and there's no way I can pay the amount they are asking in the time period. Plus - the parking fines are in dispute as they relate to a period of time when I was in hospital or recovering from surgery and had no way of putting parking tickets on my car. Furthermore - the parking is in further dispute as the council does not provide adequate residents parking spaces, forcing us to park in very expensive council run car parks - which we've complained numerous times about to local councillors and MSPs. I am worried sick and need some advice. Parking fines relate to periods between 2005-2006. Pls help. Thanks. L x
  4. here we are again. I sent in the LBA, and have received a letter back about this ongoing OFT case saying that the bank aren't going to do anything until after the case. I have a form to send to the ombudsman - I'm claiming over £4000 and I'm in Scotland - so my question is - can I still send it to the ombudsman and stick to my schedule or do I have to sit on my hands and twiddle my thumbs (which might be difficult if I'm sitting on them!) and wait for the court case ruling. Any advice, guidance, words of wisdom etc are appreciated as always. Lx
  5. Many thanks to everyone for your comments and advice. I've not been back to the practise in question, I'm scared to but I have decided that rather than coming down heavy handed I am going to write the senior partners a letter explaining the situation and take it from there as essentially the practise is great - except for the moronic behaviour of a locum.   6. yes miss blooz, but going camping with you and mr blooz is, as you know, highly jinxed so I didn't want to take my chances! Going to fire the LBA off to them today anyway, just to cover all bases.
  7. Just to clarify where I'm at. Sar sent Statements received back Prelim sent Standard letter back - complaint closed, if we don't hear from you in 8 weeks then we'll assume you are happy (yeah..we're all happy little campers on CAG!) SO now which one.... LBA etc etc.... or Straight to the ombudsman..... I'm actually inclined to fire off the LBA anyway so they know that I'm not a happy camper...and then write to the ombudsman. Ms Blooz - glad harry potter went well for you, i can't remember the last potter book I read...I think I'm maybe 2 behind. No idea. lol.
  8. thanks for the advice guys. Someone else has told me that as my complaint was declined and closed that I should now go to the ombudsman. I'm a bit confused....
  9. Thanks for the advice guys. My husband has phoned the senior partners at the GP's and put in a verbal complaint. They agreed that it should not have happened and they've said I can come in for a complaint form and submit my complaint in writing. I'm still completely overwhelmed by the whole incident.

  12. I would hang in for the full amount, it's nothing less than you are entitled to and nothing less than what they've charged you. Good luck, dig your heels in!
