  1. Thanks but ive already paid it now, but I cant see how the posts will be able to negate the fact I was still parked across a dropped footway, I knew I was in the wrong to start with but it was worth a try to look into it.

I had a ticket on my windscreen of my vehicle on 12/07/08 whilst I was a work for being parked at a dropped footway, Contravention Code 27 Where I was parked was an entrance/exit for a private car park but it had metal posts concreted into the entrance so in otherwords it was unused There were double yellow lines on the road but not within the bit where my car was parked, there is also no signs up around the area where I had parked There were yellow dropped curbs that cross the area where my car was parked The ticket states that my Tax disk was obscured when I know that to be false as I have one of them aluminium holder fixed to the lower nearsisde part of my windscreen, (the correct place for tax disks) Have I got any grounds as with regards to no signs being in the area, or my ticket saying my tax was obscured? I was thinking if they have photos of my vehicle as they always take photos then there would be a conflict between my vehicle and the ticket as in the photo my tax would be clearly displayed This is a £120 fine, or £60 payable within 14 days and printed out on by computer from Barking & Dagenham Council Thanks for you help if you are able to offer some advice (except do not park there again)
  4. A friend of mine that I am helping to claim back unlawful charges has sent off S.A.R - (Subject Access Request) so far Helifax have only 11 days left! She phoned Halifax and they denied receiving the S.A.R - (Subject Access Request) even though the £10 cheque had been cashed 29 days ago. She told them how can they say they not received the S.A.R - (Subject Access Request) when they cashed the £10 cheque? The customer advisor then hung up, my friend phoned back and spoke to someone else who was slightly more helpful and now they should be ringing back in 5 days to discuss the charges. I will create a seperate thread on this one as soon as I hear any more
  5. I have not received anything from CRS as of yet, if they can not supply me with my original signed contract then CRS and Golds Gym can go whistle lol.

  7. Still no reply from Vodaphone but my CCA request was received on 05/02/2007. I know they are not covered by the CCA so I will send them SAR tomorow.
  8. I have still not received any response from Egg Banking, But they have received my SAR on 06/02/2007 so has been 44 days!! They have not banked the three £10.00 cheques I sent them. Any sugestions...

  10. OK I had a reply regarding my CCA. The letter I received from these pirates (CRS) stated that Golds Gym does not come under the consumer credit act and I had signed an agreement with them and that they will obtain a copy then sent it to me. Any more tips? I just hope that they no longer have the agreement
  11. Not had any reply from Close Motor Finance but to my suprise the default has been removed from my account?!

Ok Just had a cigarette and getting my head around this now it's becoming clear LOL the six year bank charges are about £1,950 and they offered me £1,700 so that is good and I am happy with that. Liz Farmen from Halifax whom I spoke to said that the money will be deposited in my account within 14 days and I will receive a letter of acceptance so I can't say that I have wont yet 'It's not over until the fat lady sings' I have already received £952.00 which Halifax deposited in my account the same day they sent the letter so I can't see why they don't just deposit the money now, it's a good feeling to know my bank is in the green rather than in the red.. which it has been for the last 5 years, This is a life changing moment for me As soon as I receive the money and letter I will email the moderators to move this thread to Completed Claims and I will donate to CAG. Liz didn't mention closing my account but did say that any more bank charges they will not refund... reading in between the lines they don't refund any bank charges anyway but they do offer compensation for them so to us its the same thing I will keep you posted! Thanks to all of you who have helped me and a big thank you goes to CAG.. if it wasn't for CAG I would have not claimed 'Who gives you extra CAG CAG CAG!'
  14. I phoned them and provisionally accepted £1,700 over the phone they said as it was over the 6 year they can not make an offer based on the £2,085 I have already has £952 is this good or have a screwed things up by saying yes on the phone?? LOL

  16. Not had a reply yet but as dayglo said they are not covered by the CCA, but strangely enough, the default was removed and then put back on the same day?? I will wait for them to return the letter and £1 postal order then I will send a SAR
  17. Update... Still have not heard anything from Halifax! despite yesterday was file in court day which I have not yet done due to work commitments I am going to phone them this morning am feeling a bit nervous about it now (I will actually admit that) not about the court but just phoning them I don't want to slip up and say something wrong... I will phone at 12pm or before so hopefully someone can give me a little bit of advice as to what to say other than you owe me money blah blah blah...

  19. Hi, I have read the small print on the back of the contract and it does not state what hapens if it is passed on to a DCA, I will try and scan in a portion of the small print to put on the forum.

Someone I know has a default on their credit file with Equifax, the problem is that the first name, last name is incorrect as well as the date of birth this was defaulted in 2001 and the contract started in 2000. Would it be best for them to send off a SAR or just speak to Equifax and deny ever having the mobile contract?
  21. Thanks for the advice, I have the original agreement which I have signed, yes I do owe 150 as I cancelled my membership within 6 months, should I send them a CCA anyway in the hope they can not find my agreement?

I was a member of Golds Gym for about 3 months when I moved out of the area and sent a letter to say so to cancel my membership, a little while later I received a letter from a company called CRS Credit Resolution, the text in red is my main issue as I can't see how they can do this, isn't this extortion? -------------------------------------------------------------- 22 Jan 2007 We write to advise you that a debt of £150.00 has been passed to us by Golds Gym. This debt has arisen as you did not fully comply with Golds Gym cancellation procedure. You have also now become responsible for our fees in recovering this outstanding amount. Our standard charge of £80.00 has therefore been applied bringing the full outstanding balance to £230.00 You can only speak to us about this debt. Gold Gym will simply refer you back to us if you contact them. ----------------------------------------------------------------- I then phoned them and said that I could only afford to pay £10.00 per month which they did not feel was enough, I then asked about the £80.00 fee added to the debt and said I wanted a breakdown of the costs so I received this letter: 21 Feb 2007 We refer to our telephone conversation today As requested, the breakdown of your debt is as follows: £150.00 Membership Fees, due under the terms of your contract. £50.00 Recovery Fee, Incurred as your file was passed to CRS. £30.00 Trace Fee, charge incurred in tracing you to your new address £230.00 TOTAL DEBT We are prepared to accept repayments of your outstanding balance by instalments, however, additional amounts would be added. These depend on the method of payment and number of instalments to be collected.   23. Hi docannie, thanks for the post. I have had the account for 6 years and 7 months but if they only pay 6 years I will loose about £50 so not worried about that. I was surprised to see the £952 extra in my account but it's dirty money and I won't touch it until they pay me a reasonable amount at least £2,000 they can keep the £83 as a gesture of good will I've decided not to have any contact via phone and everything done in writing as I am fully prepared to go to court, I would love to see a disclosure order on Halifax Good luck with your claim I will look forward to hearing how they respond to your phone call
