  1. It happened to me. I rung the number on the letter they sent me and told them I refuse to sign anything. They told me to confirm my ID by answering security questions. I answered the questions. They then proceeded with the SAR. I received it within two weeks! You don't have to sign! Hope that helps

Hi,I received a response to my prelim letter of which I used the standard template giving them 14 days to pay.They have asked for 4 weeks to investigate (my account closed with them 5 years ago), although they had no problem providing the SAR previously.They go on to say if they do not respond within 4 weeks I should contact them to find out why.Should I give them the 4 weeks they request or should I proceed as normal, after 14 days (make claim)?Regards
  6. Hi thanks, They applied interest each month. Do I calculate it and add the total figure, or do I just add the contractual percentage (around 19%) to the total of the overdraft charges? Thanks in advance
  7. Hi, I received my SAR last week and am now ready to make a claim for overdue charges and Late Fees. Due to the sites new format, I am a little lost. Please could someone advise me: 1) what I should do next and what are the steps to making and receiving my claim? 2)Which Templates should I use and where can I find them 3) How can I calculate interest?   8. Thank you for your assistance. Surely what you are saying is that CO have to process my SAR now they have taken payment. Eitherway if I now sign the letter the 40 days would not need to start again as they have taken payment. Therefore is there a template or a part of the DPA I can quote which proves to CO that they are breach of their obligation as they have taken payment but have not processed my payment? In addition, will the information commisioner force them to oblige and if so how long should it take for a resolution? Would it not be quicker to sign the letter and wait for 40 days or at least prove they are in breach and therefore they should process as soon as they have received my signature?

  10. Hi guys, Coincidentaly, when I arrived home from work yesterday, there was a letter waiting for me from Captial One. They have said they want me to send a signed letter and that the 40 days will start from the day when they recieve it. They obviously diliberately waited for the 40 days to expire before responding as delaying tactic. I am aware that CAG generally advise not to sign letters, So I followed the template and signed in italics. However they refuse to process my SAR, unless it's signed. Do you think I should sign the letter and if not, is there a template which they will accept otherwise? Do you believe they could forward my signed letter to the designated DCA, who could then potentially misuse my signature? However it does appear as though CO are taking responsibility for the SAR. regards
  11. Hi the forty days have passed on my SAR and unsurprisingly Capital One have not as much as issued me with an acknowldgement letter. I am assuming that if I contact them they will redirect me to the desingated DCA, seeing as my account closed in 2008. Please could you advise me where to chase up my request
