  3. As outlined in this thread (http://www.consumeractiongroup.co.uk/forum/showthread.php?112421-Abbey-s-Allocation-Questionnaire/page2) I have been awaiting repayment of charges since July 2007. Obviously most of this time the case was stayed, but this morning I have received a letter from Santander in which the bank proposed an Unless Order. I'm slightly baffled by what this means and how I can react to this. Any suggestions appreciated. Slightly concerned as I did a search of CAG and couldn't find anything that seemed relevant.

Hi After filing my various letters of complaint last year and eventually receiving a small amount of money (£255 of a claim of over £1400) which I advised that I was refusing to accept as anything other than a goodwill/gratia gesture. After learning of the Hardship Rules last week I contacted Abbey to push forward down this avenue, only to receive a letter this morning. This letter tells me that Abbey are unable to offer a refund as I have already received refunds during the last 12 months. It appears to have little to do with the issue that I contacted them about - what I want to know is: is this a standard Abbey tactic? And also, am I able to attempt to claim under the hardship rules if I have accepted the gratia payment? Thanks Christian
  7. bit baffled now, as the magistrate has ruled that the case be stayed as per the test case. I don't know too much about this, and it's hurting my head trying to take it in. I understand that there is a blanket or wholseale stay on cases; however I had requested that the case not be stayed, using one ofthe templates (http://www.consumeractiongroup.co.uk/forum/bank-templates-library/17065-application-removal-stay-updated.html?highlight=stay) So that's why I'm baffled.   10. Has anyone else had a banks AQ be as unusual as mine? I'd really appreciate some assistance here with regards to any action I can take in response to this, if I can use it, etc.

  12. Hi Sorry about the multiple threads :/ The reference number is the same on AQ as it is on mine. they've also completed section G (£2000 costs!) after stating they wish the case to take the small claims track. I'm completely baffled by all of this.
  13. Hello! I've received a copy of Abbey's Allcoation Questionnaire, and there seems to be some strange anomalies on it - is this common? Abbey seem to be under the impression that I am claiming £5000 (I'm claiming around £1500) and have requested that the case is fast tracked as a small claim - according to the instructions that I completed, you don't need to make this distinction on claims below £5000. I'm also baffled that they say they have sent me copies of supporting documents that they say I received the day before their AQ is signed (I haven't heard anything for a few weeks from them) and I'm also confused that I am being asked to supply a schedule of the claim. What's happening here? Thanks Christian
  14. Hi again Jo The county court would be my own local one, right - or can I choose another? Because I live in a unitary authority (Redcar & Cleveland) and I don't believe we have County County Court since Cleveland was abolished. Regards, Christian

Actually there is sometyhing else I need to ask about the form - what do I put in the box that says "In the" at the top right, and do I fill in the "Defandant's name and address" box at the bottom right (i'm assuming i fill in the amount claimed box etc with the same as in the value paragraph)?

Would I be correct then in assuming I should be completing the form as such: Charges £1248+£270.74 Overdraft Interest £0 Interest under s.69 County Courts Act 1984 £0 Court Fee £120 Is this right?   19. hi Finally got my overdraft interest calculations added to the spreadsheet (which I omitted from my initial letters to Abbey), but when I come to add the figures to the n1_0102.pdf, I'm lost! Charges £xxx.xx Overdraft Interest £xxx.xx Interest under s.69 County Courts Act 1984 £xxx.xx Court Fee £xx.xx Obviously "Court Fee" is self explanatory - but what goes in "charges"? As far as I can see, I have four figures - £1248 in penalties, £270.74 which is the 8% on penalties, £112.94 is the interest on penalties and £12.07 is the 8% on interest on penalties. So I'm a bit baffled with these four figures - should I be adding some together? Thanks Christian
  20. Hi - I've received a letter from Barclaycard staing tht as a goodwill gesture they are offering me £264 of my £900+ claim. The thing is, I don't have a Barclaycard account any more, and I feel uncertain how to progress. At this stage with Abbey, I accepted the money while advising that I was still pressing forward with my claim - but I don't see how I can do this with Barclaycard as I must contact them to process the "refund". If anyone can point me in the right direction here it would be appreciated. Cheers Christian

  22. My question though is about whether I should be (have?) claiming for the additional interst originally, and whether I should now, not about how to complete the form (I've already based my completion of the form on the notes in the library section)

Hi - I initially sent my schedule of payments to Abbey (using the complex .xls file) without completing the Interest Date, Interest Charged, Account Balance at Interest Date and Interest Free Overdraft columns. As such I'm scratching my head a bit as to what information I should be entering in my n1_0102 form. I *think* I should be detailing the particulars of the claim along the lines of what I have already informed Abbey of, but would appreciate assistance to clear this up in my head. Thanks Christian
  24. Hi - sorry to add to such a humongous thread, but I just don't seem to be able to find the answer. I'm compiling my charges on my Barclaycard account, but don't follow the instructions (which is a concern as I have already done this for my Abbey current account). Firstly, on my statement dates march 2001, the only interest listed is at 1.42%, and I suspect there is another interest rate not listed as later statements have a far higher figure Secondly, I don't understand the instructions: How can I know from the current statement what the amount paid is without checking the next statement? Any help will be gratefully received, thanks in advance if I'm not around to check back today:)
  25. Hi Lula On some of them it is accomanied with "Over Cash". over the counter might be right, but where would the "S" come in to it?
