  2. Good point. It had only been recently that i had become aware that the original creditor did not add the default themselves. I had 5 defaults in total from Motormile, i managed to get 2 removed as they were for statutory barred debts that i had already payed off to other DCAs, who then sold them on to MMF.It takes a lot of effort/time/stress to get defaults removed.
  3. Recently checked my credit report and noticed that my 3no Defaults with Motormile have dissapeared from my Credit report. From reading other threads i have noticed this has happened to others as well. Just to let everyone know that my 3 defaults from Motormile, contained incorrect default dates and were entered onto my credit report by them and not the original creditor. They have been deleted in the last 7 days. I may now finally be able to get a blooming mortgage!
  4. MMF have recently sent an email regarding an old PTP debt to myself. I owed and still have paperwork £200 they now want just over £1200. Again this debt goes back to late 2008/09 and will soon be stat barred.Word of warning though MMF do enter Default Notices with credit agencys where the original lender failed to do so. I have 4 defaults on my credit rating from MMF, they all expire within the next 18months, so i wont be losing too much sleep. However they did issue a County Court Claim against me in respect of one debt which i had sett aside. So be very careful, they may get a CCJ against you in particular if they do not know your current address or if they register a claim against you at a previous property you have lived at.
  5. Congratulations Pippa!! I have heard absolutely nothing from MMF/Optima, although i found some paperwork from mine which showed approx 60% of their claim is made up of unknown charges. Makes you wonder the reason why they have discontinued proceedings, maybe their claims under say £1000 are not worth them perservering with (time/effort/costs) if the Defendant enters a defence. But there is probably a large percentage of individuals whom pay up or enter mediation when they receive a county court claim against them. Have you checked your Credit Report? As MMF have listed a default against me, mine dissapears in 2years so it will not have any implications on myself.

  7. Hi Pippa. I have not received anything from Optima at this moment in time. But im pretty sure something may arrive soon as the debt will be stat barred in 9months.
  8. Hi Pippa Im in exactly the same position as yourself, i have not heard anything back. the CC action is on hold, i do not want to tempt my luck by applying for a stay. Reading on other forums, MMF have issued quite a lot of court claims recently. It could be the case, that 90% of people just accept the claims and pay up or get a CCJ against them and if the other 10% put a defence against their claim, it may not be worth them seeking judgement as they obviously have some kind of issue with their paperwork. It is also worth noting that Quickquid are an American company and when me and you applied for these QQ loans 3-5years ago, maybe the paperwork we signed/electronic signature although compliant with USA law may not comply with UK law. Just a thought.

  11. My defence needs to be submitted by Wednesday, so will undertake that duty tomorrow. The defence will be very short and will make mention that i am unable to plead as the claim is both vague and generic. The Claimant has not provided information under CPR 31 .14 for copies of all documents mentioned in the POC. Therefore the defendant believes that the Cliamant has issued proceedings without legal basis and in this circumstance, the claimants actions are wholly unreasonable. I will also mention that the Claimant has not complied with Sections iii and iv of the practice direction on Pre Action Conduct, as they have sent correspondence to an incorrect address. Im new to this and i feel im getting this almost right, so if im doing anything glaringly obviously incorrect, i would be grateful if you could respond. i will post my Defence tomorrow. Best wishes.
  12. Letter received from MMF solicitors stating they are contacting MMF in respect to my CPR31.14 request. But nothing received after the 7 days. Do i now have to submit a Defence to the claim as there is only a few days left to undertake this? Be grateful for any advice.
  13. Acknowledgement of service filed 24/07/2013.CPR 31.14 sent by 1st class recorded delivery (guaranteed next day) 24/07/2013.Be interesting to see what they come back with in respect to documents and info relating to the particulars of claim.
  14. Many thanks CitizenB, i will have a good look at what you have suggested over the weekend. Just out of interest would you know if it is possible/advisable to contact Motormile Finance directly and suggest a repayment plan over 3 months to stop court action?Or is it possible to get the claim sett aside due to the inaccurate address (i live at flat 4, the mail they have sent to me has been addressed flat 2-4 and has been delivered incorrectly)?Again i appreciate your help.

  16. Thanks for the replies everyone. 1. Date of issue of the claim is 8th July 2013, so plenty of time to acknowledge. 3. I do acknowledge i owe them some money. At the time i was constantly borrowing off them and paying them back and rolling over the loan etc. Then lost my job and hence could'nt afford the repayments. I was unable to enter a payment agreement with them as they would'nt stop the interest on the loan, so i paid a rollover charge of about £120 approx one last time, then cancelled my card and closed my bank account down. I then tried to negotiate a payment arrangement with them for the £525 to pay this off within approx 6months, but this was never agreed. Fortunately i am now in steady employment and acknowledge i owe the 525+£12 default charge so i can pay this amount in probably 2 monthly instalments. But i do not want to pay Motormile the hidden charges that bring the debt up to 772. Also i have not received any correspondence from Motormile, a neighbour whom has newly moved into my block of Apartments whom lives at Flat 2 gave me the letter. I live at flat 4, but the court documents have been sent to Flat 2-4 (although they are obviously in my name. It seems all the correspondence from Motormile has been sent to Flat 2-4 as i have never received any in the past. Flat 2 was empty and had Builders working in there for approx 3 years so it was quite likely my corresponce from Motormile was going there. Would be grateful for any assistance and hopefully this thread will become useful to many others if Motormile start using this as a new approach. Again im not trying to hide from this debt and fully intend to repay what i owe, i just dont want a CCJ on my credit rating.
  17. Hi GuysJust received from Northampton County Court a claim from Motormile Finance for a debt from Quickquid from approx 5years ago. MMF are claiming XXX amount of which half appears to be made up of unknown charges. I do acknowledge that i owe approx half of this debt and i certainly do not want a CCJ appearing on my credit history. However i have also received an email today from Quickquid requesting payment and both QQ and MMF are claiming they own the debt. Obviously i want to avoid at all costs paying MMF there version of the outstanding balance and would much prefer to pay QQ the amount i actually owe. Just wanted some advice really as i have not seen anyone have a county court claim against them on this forum? Would appreciate any input.
  18. Further to above sound advice. After you have cancelled your debit card and if you have opened a parachute account. DO NOT give your card details to your payday lenders. Set up standing orders (as Robjams advice) for each lender. Take their Sort Code, Account Number etc.. Otherwise they will empty your account! Looking at your Lenders most will probably pass to a DCA (debt collection agency) after 3/4 months and they will accept repayments for low amounts i.e £15-£20 per month.
  19. I think you are out of luck here.Your insurance company will pay the Creditor prior to you receiving any money due. I would contact MM and ask them what the outstanding sum owed on the vehicle is. (MM charge 10% interest per month). If you settle the loan early then there is no need to pay all of the interest. I would get MM to e mail you the outstanding sum or even pop into their local office and get a letter from them and fax/send this to your insurance company. The reason for this is that when the insurance company do a HP search on the car it may list the total outstanding finance on the vehicle and not the amount owed if it is settled early. (im 80% certain im right). Good luck!
  20. I have 5 payday loans at the moment that i am unable to pay the full rollover amounts on. This has been the case for the last 3mths. I am unable to pay the said amount due to a drop in income/salary. Listed below are the 5 loan providers that i have and each has been defaulted on. Uncle Buck. These have been the easiest to deal with, i set up via e-mail a 6 month repayment plan. They accepted no questions asked. They added 1mth loan interest only on the outstanding amount and freezed the remainder. Be careful they will set up a Direct Debit to try and take money from your account. QUICKQUID When they phone (American company) they are courteous and polite. But trying to nePayday Ukgotiate a repayment plan has been impossible to date. They will not accept any repayment plan i propose to them via phone or e mail. They just request i pay the minimun rollover amount. PAYDAY UK Unwilling to accept a repayment plan based over 6mths to repay outstanding debt. Passed debt onto DCA after approx 50 days. I did try to negotiate a repayment plan by phone and e mail to no avail. PAYDAY EXPRESS I have spoken by phone only. They have freezed interest but at this time are unwilling to accept a 6mth repayment plan. Occasional phone call on mobile and at work. 1MONTHLOAN Accepted a repayment plan over 2mths (only owed them £100. All of the above have had attempted negotiations to repay the full sum of the loan plus one months interest. I have not attempted to get the debt reduced. Hope this helps anyone dealing with these companies. Regards RIDDICK
  21. They would just change the locks (does'nt cost much). Be careful if they know where you work as i believe before i got my new car, they turned up one day.
  22. When i say hide. Don't put it in your garage, on your drive etc. The clamping team mobile money send out will drive around the area you live in searching for it, after knocking on your door. They will call very early in the morning 6-7 and usually late in the evening (also weekends). (i.e when you are not at work). Don't answer the door if they knock, they have no powers to enter your premises as they are not employed by the county court. Ignore them till they go away, they may shout threats through your letterbox, again ignore them. If i were in your position i would keep it at least 3miles from your current residence. Also judging by the amount of loan you received from them i would assume your vehicle is worth a few thousand. This will ensure they will continually look for your car. I've hidden an old car of mine from them for over 6mths now. But im fortunate as i keep it in my parents locked garage about 400m from where i live.
  23. Hide the car so they can't tow it away. If they try and enforce the debt through the county court (unlikely due to amount you have already repaid) the judge will possibly rule in your favour.
  24. Kittykat if you need money quick and you have no other sources of getting cash. I would do one of the following. 1. Go to The Money Shop or cash converters. This is only if you have a cheque guarantee card and chequebook. You will probably have to pay them £15 per £100 borrowed. 2. If you want to use a payday loan company on the internet and require payment today or tomorrow i would use PAYDAYUK (charge 25 per 100 borrowed) or PAYDAY EXPRESS (charge 20 per 100 borrowed). None of these are advisable, but option 1 is your best bet if you can not get the funds elsewhere. Just do this as a one off otherwise your life will spiral into misery.
