Today i have received a full settlement letter from barclays of £2750.50, this is my actual claim sum including 8% apr, however they have left out the £220 court cost which was included in my final defence and total sum required. Should i accept this offer or still ask for the £220 court cost to be included, a complete total of £2970.05??? My court date should be/is 27th Nov in Harlow, as you can see im on a bit of a tight deadline to conclude what to do... also does anyone have any suggestions, even in letter form. The letter from Barclays states "should you decide to reject this offer, then we reserve the right to disclose this letter to the court" STUCK!!!
  4. having.....gone into o/draft without having agreed with the defendant to increase the overdraft facility and/ or his failure to make payments to bring the balancre of the account back into credit. Dont worry i had the same crap on my transfer of proceedings. i think yes we will all expect the same defence! I also saw my local CAB today for there advice also, always try to settle out of court for it to be in your favour was there advice so i went along but they werent having any of it.....onwards court!!! Hope this helps.
  5. Just an update, have received letter finally. Barclays have offered me £955- only half of what id due, will refuse/ accept part payment.....will keep you updated.
  6. so the visa and mastercard would stand as one claim and the barclays account seperate. am i correct in saying this? Also.... how would she be able to differenciate these claims as they have all been stated on her bank statement as paid referral, not noted where they came from in the 3 divisions. ie, barclays account, mastercard and visa.

I am confused.... i am trying to help a friend who doesnt have access to a pc (she wants to start the process of getting money back) she is with a Barclays branch, has a barclays account and 2 credit cards- barclaycard, a visa and a master card, do these all come under the same claim as it is all barclays or are they indiviual claims?
  8. ok letter sent....along the lines of.......i hope this is ok. Please disregard information on my preceding letter stating an 8% APR imbursement of £435.50 (sent 07/04/06- recorded post). I now state the full payment required is £2,195.0. However, I understand I am entitled to interest charges upon the referral charges made at the time of the offence. The 8% APR allege of £435 is legitimate by the County Courts Act (1984) if this instance indeed becomes a claim in the courts. The residual information of my preceding epistle nevertheless stands, and your counter deadline is 21/04/06 of when your 14 days terminate and a claim alongside you will commence. Yours Faithfully
  9. ok guys, have sent my second letter (recorded post) advising i want my paid referal charges back with 8% apr using the standard letter in the library....will let you know how i get on, deadline 21st apr!!! Also sent with all charges since mar 00 using the excel spreadsheet in libary also. Tip for people who do not have excel, microsoft are offering a 60 day trial for excel, word, powerpoint etc if this helps... a total of £2600, a lot of charges for a 25 yr old i know....
  10. Hi, I just have to say im so excited about this forum, so thanks to all you that run it so well and with a great back bone for all us unsurers!!! Today i recived a big bundle of bank statements ova the last 6 yrs, i have worked out with the interest i am owed £2,235....my first step to decreasing debt..wow. i do have a question though to anyone that knows, i have included all 'unauth o/d fees' but i also have some standard 'overdraft fees' of just £5. Do i include these or are they a reasonable admin fee?? Regards & keep up the great work. Krissy. x
