  11. OK. They tried that one with me too! I was well over my limit (mainly due to charges). They wrote to me and said 'You are a naughty boy, you owe us £1300. How are you going to pay it back, return your cards & cheque books etc' My reply was 'When you give me back the £5000 you took from me,that's when'. They wrote back and said 'We've already told you to sod off so how are you going to repay it?' So I went to moneyclaim and filed on their a***s. That cost them nearly £1000 more in interest btw. Needless to say I was able to comfortably pay off my overdraft shortly afterwards.
  12. Yep, I'd say it's highly likely - they did with me. They will place any repayment of fees into your account. If you owe them money (as I did) then fair enough I s'pose. Set up a parachute and move all financial affairs to there. HTH
  13. Hmmmmmmmmmm. Really not sure about that. I know that Dave demanded how he required payment to be made but really don't know about the legalities seeing as you owe them money - sorry. I like the without prejudice bit as well. So if I agree to your confidentiality clause and then breach it - how do you prove I signed it to a judge?? Maybe someone will be along soon to advise.

  16. You do not need to send the letter recorded although I did - it is deemed delivered 2 days after posting. So it's up to you. Costs a quid for recorded. For encouragement read my thread, Monkey's thread, all FD threads. You think your letter's heavy handed?? They've had their hand in your cash - That's heavy handed. Go get 'em.

  18. Absolutely. Read Monkey's thread which is very well documented about what to expect and your response to it. There are others in the FD forum similarly documented. It is worrying when you receive bully-boy letters from banks or their solicitors but reading how others have responded and what then happened helps loads. You'll be just fine.
  19. Hi Bev, I don't think it will - you are simply reclaiming money taken from you unlawfully. They might close your account so set up a parachute. Closing accounts does not affect credit rating (I read here but do check). Good luck and keep us posted.
