  1. I was sidetracked for a few days by starting a new job, but my letter has now been posted.
  2. Return date for the court hearing was 22 March. They settled in full on 21 March. Case closed!
  3. Ok. I'll send a LBA, saying I'll take the offer as part payment but restating my claim for the rest and giving them 14 days or court action.
  4. Statements arrived yesterday! Charges total £274
  5. Very swift response to the prelim letter. They don't agree with my legal analysis, but will credit £123 to me, as the difference between my charges and the current £12 charge. Should I pursue further? I would with a current account but is it the same for credit card?
  6. I have had a Barclaycard since 2000. When I took it out I was young and naive about financial matters. I don't remember anything being said about PPI - so it was clearly an opt-out system rather than opt-in. Therefore I clearly didn't know that I didn't need to have it. I wised up and cancelled the PPI in 2005. Going back over old statements, the premiums for this total a substantial three-figure sum. Is it worth firing off a letter suggesting it was mis-sold and asking for that money back? (Incidentally, when I recently requested statements for a charges reclaim, the accompanying letter with them said they had enclosed all the information they held on me - which implies they don't have the original credit agreement)

  8. Looks like the bloke on the phone was wrong and they did get my letter. Package arrived today, dated 9 March - 2 months since the SAR was sent. It says they don't believe microfilm is a "relevant filing system" under the terms of the data protection act, but as a gesture of goodwill, they're supplying all the statements going back to 2001. My charges total £315, so I'll send a prelim letter off for that. However, here's something: I cancelled my PPI in Aug 2005 as that's when I first realised it was optional. The cost over the years preceeding that totals many hundreds. Should I send another letter asking for that back, suggesting it was mis-sold as I was young and naive, didn't realise it was optional etc etc?
  9. Not heard anything yet, but I'm furious! I'd move everything out of the account and switched all direct debits to another account in preparation for closing this one. However, ebay debited £14 for their fees - as the card for this account was still registered with them. Result - a fresh unauthorised overdraft and a new £30 charge being applied. Aaaaaaaaaaaaaaaargh!

  12. It's Gordon, but I'll put that down to a slip of the finger too! The court fee you need to pay for a summary claim is higher, (although you'll get it back from Lloyds when you win) - have a look in the Scotland section of this website for full details.
  13. They always refuse at first. Send them a letter before action now - you'll find details in the templates section
  14. £750 is the small claims limit, not £250. You could bring a summary case against them though
  15. No sign of statements or charges list - phoned again today as it's now 41 days. "We do comply with the Data Protection Act, but the 40 days doesn't take into account our procedures" She said the colleague last week shouldn't have said they'll be with me in days - and she couldn't give me any timescale.
