  1. Ok. I was half expecting that I think. Do you know how defaults are removed in the long term? Is it a case of when its paid off it is removed or is it 6 years after it is paid off it drops from your credit rating? I am just trying to get my head round everything now while it is relevant and looking to make sure I never end up in trouble again. Looking to improve my rating and finances as much as possible.
  2. Thank you for that. I think I may need something different as I am still paying the debt off. Will this mean I can't remove the default? The account has been closed and the debt has been moved along with a couple of others to a collection agency. I pay the agency and they pay the banks. I am confused hehe
  3. Hi, the charges are no where near the default amount but I wasn't sure If I could try to remove it anyway? I guess the charges made it a lot harder at the time and it all snowballed out of control. If there is nothing I can do then so be it but I thought while I am in a pro-active phase I will try to give myself the best chance of correcting my past mistakes.

  6. Hi. I have succesfully reclaimed my charges but I have now realised that the default remains on the account. Is there any way I can get the banks to alter this and improve my credit rating? My account was closed about 3 years ago as I owed them £3,500. We came to an agreement and I pay £50 a month towards this figure which I have been doing and never missed a payment. I recently obtained a credit report and could see that the default notice is still there. I am looking to strike while the iron is hot and give myself the best chance of correcting my finances once and for all. To do this I want to explore the chance of having the bank remove the default. Is there any way I can achieve this?

  10. Is it not easier to keep going on this thread as my HSBC claims have been settled? She has 1 bank account with HSBC and a credit card with Nat West that have defaults on. Both accounts have been closed and an agreement that where they have frozen the interest and we are paying a minimal amount every month. Details are below HSBC £13,500 outstanding. We pay £150 a month Nat West £2,400 outstanding and we pay £25 a month. Is there anything we can do?
  11. Hi, I have informed the court that payment has been received. It is my girlfriends accounts that have the default so when I started my claims I didn't need to add the default removal part. When we moved onto her accounts I didn't add it back in as we were unaware of the default notices. She has 1 bank account and 1 credit card with defaults on. If possible we are looking at ways to remove these to improve credit ratings etc
  12. Good news. HSBC have paid and I have the money safely in my account. Nat West sent a cheque which has been banked and should clear any day now. One last question if I may. Is there any way of getting banks to remove the defaults on a credit reference agency? If so how can I do this? Cheers in advance
  13. I crossed out the relevant details and sent of the forms so hopefully I will get payment soon. On a slightly different note. I have a claim I am doing for my girlfriend and they have offered the full amount. The problem is this account was transferred to a debt collection company a few years back and she currently pays about £15 a month which was agreed with Nat West. What I would like is a cheque for the full amount so we can benefit. I dont want them to knock it off a big debt that we are happy paying £15 per month for the next 10 years or so. Does that make sense? I s there any way I can get them to send a cheque so we can bank it and put it to some good use now??
  14. I have just been home to check the post and I have a letter from DG. It is offering to pay in full my credit card claim which is fantastic. I just dont know whether to sign the form which says i cant claim on anything else relating to the charges claimed and keep the facts of my payment confidential. Does it matter if i sign this? if not what should I send? Thanks for all your help during the course of this claim

  16. Thank you for that. I may well do that as I have all my charges back plus court fee and some £25 of my £100 interest. I am getting more than a little confused regarding court bundles though. I cant seem to make any sense of what I should be doing or need to do
  17. Ok, I will have a look into that. If I was to accept the offer on the table how would I go about it without agreeing to it being final and never being able to claim anything else on that account etc
  18. I have received a letter this morning in relation to my bank account claim. It reads as follows We refer to your letter dated 21/3/07 and note that you have declined our clients offer of settlement but have provided no reasoning behind this. Our client will not consider your claim in respect of charges which are statute barred by virtue of the Limitation Act 1980. If you continue to pursue your claim in this respect we invite you to prove this portion of your claim by referring to the relevant legislation upon which you intend to rely on. For the avoidance of doubt we confirm that our clients offer of payment in the sum of £523.07 remains open for your acceptance. We look forward to hearing from you shortly. Any advice would be very welcome. The total amount is £605 and the court date set for 26th April.
  19. I cant remember off the top of my head. I think I recall something about 7 days prior to the date in question. What is the best way about preparing? Would it be possible to prepare it digitally and only print it if the time is getting nearer?
  20. Right all, I am begining to feel nervous about this. I rejected the bank offer of £523 on 23/3/07 and am holding out for £605. Court date is 26th April. My Credit Card claim is for £206 and they offered £95 which I rejected on 25/3/07. They then asked for a reason which I sent to them yesterday. The court date is also 26th April. Is there not anything I can be doing to prepare for court. Will I have to submit a court bundle to DG and the courts? I don't want to mess up now. What should I be looking into or preparing for?   21. Only me! Right I have the following ready to print and send if it reads ok. If not any comments would be appreciated. Thank you for your letter dated 29/3/07 asking for a reason I respectfully declined your previous letter offering £95.42 as settlement, and requested that you return to me all charges imposed on this account, now totalling £206.27 due to interest and court costs. I would like to bring to your attention that although your charges were reduced last year following an OFT bulletin, until you provide me with evidence of the actual cost these alleged breaches cost you, any amount you charge is unlawful. The OFT bulletin advised that it would not get involved in complaints where charges were £12.00 or under, not that that amount was a true reflection of your costs. Any attempt to use the OFT bulletin as a defence for any amounts you charge will be completely ignored until you provide the relevant evidence. Yours sincerely, Lordbadger
  22. I had another letter yesterday in relation to my credit card claim. The letter simply said that I had given no reason for declining their offer and I should enter into contstructive discussions to solve the problem. If you read a couple of posts up they offered £95 saying that this was the amount I was entitled to. Of each £20 charge they say £12 is legal so have only offered £8 per claim. I rejected this saying I require full payment. They are now saying I have to give a reason to reject it. Is there any way I can word the reply to satisfy them? I noticed you said the OFT suggested a fee of no more than £12 not that it actually cost that much. Should I include that? Any help would be appreciated. Cheers

  24. I received a letter from my local court yesterday. The hearing date has been set for 26th April. What do I need to do now?
  25. Well more developments. Yesterday I received a letter saying they would pay in full, interest, court fee and all and it would be in the account within five days. Just as I was about to reply saying I will only stop court procedings when the money was in my account I checked on line and it was already there! Victory is mine!!!!
