  1. Hi, I purchased a wrought iron second hand bed surround from Ebay. I live in Orkney I arranged my courier AJG parcels to collect the item from Leeds and deliver it to me. They used another courier APC to collect the item and deliver it to their Inverness depot. It arrived there damaged. AJG delivered it to me and I signed for it and it was signed for as damaged. The driver told me to ring AJG in Inverness. I have just rung them they have told me that APC do not cover second hand items and so I have no claim. I was not informed this when I arranged for the collection and was not aware that AJG used different couriers. The bed is very well made from forged steel and it was bubble wrapped particularly the brass and ceramic finials on the bed ends. But despite this they have managed to damage both the top and bottom ends of the beds on the same side even managing to bend a thick screw about 6 inches long that held a finial in place. Both of the ceramic large balls were smashed, the brass finials are dented and one is missing along with its 6" screw and brass finial cap. It was an £800 bed originally. Do I have any rights as this is very careless almost deliberate mishandling by the courier?

My husband and I took out a loan with the AA on 11/01/ 2 005 for 12000 over 60 months at 6.8% APR monthly payment on credit agreement was £238.21 a month it was to start 2 months from the date of agreement though the 1st payment taken was actually on 11/04/2005. The amount of interest on the credit agreement was £2292.60. Giving a total repayment of 14292.60. We paid installments regularly until we got into difficulties in June 2007. The AA got Blair,Oliver & Scott after us who said they were collecting on behalf of Bank of Scotland? We joined the CCCS and made reduced payments to B.O.& S. until Jan 2009 then we took over paying them monthly payments of £85.00 until September 2010, when I lost my job and we were thrown into deeper financial difficulties They then got Moorcroft after us collecting on behalf of Bank of Scotland, continuously phoning all day, I sent a letter asking them for an original copy of the agreement which worked and also an harassment letter. Though now the AA have got Westcot who again are bombarding us with phone calls and threatening court action. We get annual statements from the AA showing us our payments and arrears on this it states that the loan was taken out over 62 months and at 6.85% APR. I made a point of not taking out PPI though also on the statement it says original amount of credit*** is £12,000.00 then lower down it says this ***inclusive of Loan Insurance where appropriate. My questions are who owns the loan Bank of Scotland or the AA? Have they added PPI onto the loan? Why has the interest changed from the agreed 6.8% APR and had 2 extra months added on to it. Altogether we have paid £9276.12 off the loan which leaves £ 5016.48 owing they have added on interest and say we owe £5191.17. We are currently two months behind in our mortgage,one in our electric bill and owe about £55,000 in personal debt and a mortgage of £43,000 and a poor credit rating thanks to all the defaults so we cant increase our mortgage. What do I do now? Please advise:???:

  4. Also we cant remortgage yet because we have arrears that we are paying an increased monthly then the rest will be added on to our mortgage at the end of May.Only after that can we maybe remortgage.

Hi, I'm sure we didn't have PPI on the loan.The man that always phones said that if there was equity available on our mortgage then they could get a court to release it to them by making us remortgage, so to avoid it going that far I should remortgage now.He put me on hold and made out he spoke to their team and that they would only be able to hold off the litigation til the end of May, as long as I kept paying £150 for April and May.Do I still keep paying this while I'm waiting for the CCA?
  6. Hi, my hubby had an Egg card which Egg converted to a loan of £14804.00 back in Oct 2004. We paid monthly instalments of £221 until Oct2007 when we signed up with the CCCS and paid reduced amounts of £60 monthly.This stopped Jan 2009 when we had more financial difficulties.Egg kept passing the debt to DLC, and other collectors and solicitors.Finally Cabot contacted us in Dec 2009,saying they had bought the debt and we had to make payments otherwise it would be escalated to Litigation,we paid £150 in Jan,Feb & Mar. But they are still not happy and want all the loan paid its about £9000. Though if I pay it off in one go they will knock a whole £1000 off! :roll:The same guy keeps ringing endlessly and sending threatening letters, he says that we have until end of May to remortgage so they can be paid.We vejust received another letter saying its escalated to pre-lit dept and they will either go for a warrant of execution, charging order,attachment of earnings or order to obtain information. Because we made payments does that mean we cant go for the five year (we live in Scotland)claim. What do we do next ,do we ask for a copy of the original agreement?
