  2. Hello all, I have used this site in the past to claim credit card charges back, and it has been very useful. Unfortunately one of the cases I was pursuing was delayed and only recently got a court date for small claims court. I have returned to this site to get the advice on how to proceed, since it used to have all the details on here before. However the site has changes somewhat, and many of the attachments regarding court bundles etc no longer link to anything, and many of the pages to do with credit card charges also no longer exist (from here for example). I realise that a website cannot change all of its existing links when it changes but I can't find the relevant pages and was wondering if they no longer exist since the focus has moved onto PPI in recent times. I could look elsewhere but this site always seemed to have the best advice, which is why I was always so confident whenever I approached any of the stages of claims I was involved in. Any help please? All the best and thanks for looking.
  3. hi guys, to date i have made all of my claims for friends and family for credit card charges, so all of my knowledge is in that area thanks to this site. with bank charges able to be reclaime again i've now requested statements from halifax for a friend, and am not sure whether i have misinterpreted the charges on her account. the charge she seems to have paid is the 94d. the reason i am a bit confused is that for the credit card charges, they were reduced by virtually every credit card company around 2007, in response to the growing number of successful attempts to reclaim charges. in my friends halifax account these charges continue at around the same rate, and even sometimes being charged £105 at a time (even after 2007). this seems incorrect to me and i cannot imagine that halifax would put themselves in a position where their customers would be able to reclaim their money after they knew that people were starting to reclaim. have i misread something, or do i literally reclaim all of the 94d charges?
  4. are there any people who have claimed from credit card providers not on the list? the two weeks limit from my lba expired early last week and i would like to get this court claim started. i would really appreciate any help.
  5. hi guys, i have taken credit card companies to court before using this site, but sometimes i can't find the ansers i'm lookin for on here even though i've used this site a lot. what i'm looking for are the particulars of claim to be used for marbles. there are many offered on this thread which i've used with success before: http://www.consumerforums.com/resources/templates-library/48-bank-templates/120-zootscoot i have used many of them in the past, but it is the first time the people i need to claim against are not there. could anyone provide me with some advice please? is there a generic poc we can use? i have been unable to find one.
  6. thanks tedney, you have mentioned that you have limited experience so are you sure that i would be able to do this? how do i make the application? i've been lookin online but i can't seem to find a form or anything. i know nothing regarding this matter so would really appreciate some help please.
  7. i was wondering if anybody can give me some advice regarding a court case i started regarding non compliance with the data protection request. i was really stupid and forgot to include any evidence with the particulars of claim when i sent it off. unsurprisingly the decision was to strike out. in the letter i received it says 'the particulars of claim showing no cause of action the claim be struck out', however it does say 'if you object to this order you must make an application to have it set aside, varied or stayed within 7 days of receiving it'. i have no idea about what any of those are. would i be able to change this decision by sending my papers and correspondance, or does this mean that this case is finished? if it is over would i be able to reapply for the same thing?

  9. this is only a minor question. i have recently started a claim against gemoney for failure to comply with a data protection request. after sending off the allocation questionnaire, today i received a copy from their lawyers, asking me if i could send them a copy of mine. i dont actually have a copy, since i sent it to the court. do i have to provide them with one? cos i havent read that anywhere. is it important?
  10. i'm afraid i don't know if there is one for ppi. i would have a look in some of the other sections of the site, i'm prett sure there is one for ppi somewhere.
  11. tilerdon, yes that is correct. you will need to enter even those months which you did not have a payment for. this is because the spreadsheet needs to calculate how much of the interest is still due to previous charges which have not been fully paid off yet. i feel i should say, you honestly do not need to fully understand how the spreadsheet works to claim the money back. i can assure you that as long as you enter the information i have told you to put it, the spreadsheet will calculate the correct figures for you. then all you need to do is to write the credit card company the letter before action, ask for the interest charged total (yellow box at the top), interest on penalties total (yellow box at the top again). if they dont respond within the allocated period, you add the 8% interest. fill in a few rows and you may start understanding how the spreadsheet works. i remember thinking it was overly complicated but it really isn't. try filling in some of it and i think you will feel a bit more confident.
  12. there are only six columns you need to fill in. statement date - obvious detail of penalty eg late payment charge / over limit charge penalty charged eg £20 £25 interest charged, which you have statement balance, which you have as new balance amount paid, which is payments thats it. the spreadsheet does the rest. i hope that helps.
  13. tilderdon, you literally put in the figures as they are in each statement. there are notes in the spreadsheet itself. then when you send your letter before action to the credit card company you request repayment of penalty charged + interest on penalties. if they refuse to pay this, when you apply to court you add on the interest in the 8% interest section. hope that helps.

  15. i wrote to citibank at the canary warf address, and i phoned them but their calltakers were useless and didn't know what was going on. they owe me a hundred pounds. how do i get them to pay this money? i have an agreement for several hundred pounds. they have only paid 3/4 of it, and still me a hundred. any help please? i can't seem to find any info on this site about companies not paying up when agreements have been made so i don't know what to do.
