  1. Hi, thanks for replying. No, there wasn't any PPI on the loan. I will be paying this months payment of £100.79 on the 20th, so 19 days late, but they have already put 5 charges on the account, £20 when repayment was 1 day late, £7 for being 5 days late, another £7 for being 10 days late and £20 for letters sent to myself and my Dad, so a total of £74 in charges in 13 days! They have said that legal action will be taken after 21 days. I didn't realise they could proceed so quickly!
  2. Hi, About a year ago I had no choice but to get a loan through FLM with my Dad acting as guarantor for me. I have been managing the payments fine, but this months payment, due on the 1st July, wasn't paid because I just couldn't afford it with other priority payments having to be made. Since the 1st July, I have received at the least 2 texts and a phone call every day, as has my Dad. I phoned them on the 1st to explain that I wouldn't be able to make the payment until the 20th of July but they still keep sending these texts and emails and making phonecalls. For example, today I have had, so far, 3 texts, 2 phone calls (1 to home phone, 1 to mobile) and an email. My Dad has had 3 texts. He also received a phone call last week saying that they will repossess his house if the loan payment is not made. My Dad laughed at this but it worries him that they've threatened him like that. He hasn't made the payment because he has been made redundant and is now on unemployment benefit. I've asked FLM to stop contacting us by phone and mobile but to communicate in writing only. It hasn't made any difference though. Is there anything I can do to stop them? Thankyou for reading! Charlotte.
  3. Cheers dx, will do! The £5 charge is for a letter which, as myself and my husband are both named on the account, we get 2 of, so £10 a time. The £20 is for a returned payment, direct debit, debit card etc. The £200 charge is for a repo agent being contacted to get the car, which has never happened! So can I claim all of these as unfair charges? Thanks Charlotte.
  4. Hello We are 22 months into a 36 month car HP agreement with First Response Finance. We had some trouble meeting payments a couple of times last year but made them late and only now that we've received our statement have we noticed that there are charges of £651.50 and late payment interest of £25.39! They are all noted on the statement as 'tallyman charges' and range from 50p for a debit card payment to £200 for god knows what! Can I claim these charges back from First Response while we are still in an agreement with them? Thanks in advance! Charlotte.

  6. I've had a similar problem; NatWest defaulted my joint account and are in the process of closing both that account and my sole account. I have now had refunds of £1618 and £541 respectively but I have to wait 28 days until they will send me a cheque for the balance after my debt of £890 has been paid! WHY???!!!!
  7. Hi, I am new to the Abbey forum, having been successful with reclaiming my charges with NatWest. I had an account with Abbey about 7 years ago, but due to their charges, I managed to get £494 overdrawn and they closed the account. Shortly afterwards, we moved house and Abbey never chased us up for the debt. I sent off my SAR letter to Abbey about a week ago, asking for statements for the duration of the account so that I could start my claim. But what turned up in the post today?!! 2 letters from 2 different debt collection agencies chasing the debt!! Cheeky b******s!!! Do I carry on with my claim and ask Abbey to send my statements out ASAP?!
  8. Thanks Parky. I only have 2 step acounts with NatWest so there is no overdraft on them. When I get my offer letters I'll make sure I ask them to remove the default before I stop the court action.
  9. If I wasn't so mad, i'd start laughing at all this! NatWest have now defaulted my account as I am £1000 overdrawn wholly made up of charges. I telephoned the Customer Complaints Team on Friday and was told that I'd been offered the full amounts on both of my accounts, £1618 on the overdrawn account and £541 on the other. Letters had been printed and should be with me this week. This morning in the post, what should turn up but a defence from Cobbetts!! DUR!! Do NatWest and Cobbetts not stay in touch with each other?! It sounds like Cobbetts are told to automatically defend each court claim, no matter what! Do I continue with court claim until I've received the refunds? Thanks
  10. I ring 0208 236 8295 and say that I'm enquiring about my claim, they put you through to an automated recording where you choose option 1 and the phone never rings more than 2 or 3 times before someone answers it, they are very good at dealing with my query every time!!
  11. I had this on my own thread but it's not getting seen for some reason so I'm reposting. I have currently got a claim with NatWest, it's at the stage where they have not responded to my N1 so I have now put in a request for judgement. Anyway.... I'M FUMING!!!!!!!!!!! I have 2 accounts with NatWest, one is a joint account with my husband and one is just in my name. The joint account was accruing a lot of charges when my husband was made redundant in 2005 and then we he started working again 6 months later, the account was about £800 overdrawn, just from charges! We agreed to pay the bank £100 and they arranged an encashment where we could withdraw the rest of his wages over the counter as his wages were slightly less than the overdraft! Eventually, what with more charges etc we got my husbands wages put into my sole account and left the other account to fester, just paying in a small amount each week. Now the account is about £1000 overdrawn, as despite us cancelling the direct debits they have continued to try and pay them! This morning I went to withdraw my family credit from the sole account but my card wasn't authorised! I went into the branch and they said that both my accounts had a stop on them and I would have to ask for access to my money this time. Even though my sole account is in credit and has been run without a problem, Any future payments made to the account will be kept to pay off the other account! What the F*** are we supposed to live on?!! Does anyone know what I can do?? Help will be greatly appreciated!!

  13. Well, it's June 11th and nothing from Natwest or Cobbetts in the post here or at the court! Do I just send in the request for judgement now? I know they'll probably file a late defence but it's worth me keeping to the time schedule I suppose!
  14. Just to get this thread back on track....an update! I submitted my N1 claim form on 24th May and Nasty Vest have until June 11th to reply. Can't imagine what will happen next, but I'm sure they'll dig their heels in for a few weeks at least!
  15. Hi Mariette Basically, I told them that I wanted to see a court order. I told them that I knew they were not baillifs and they had no right to take the car. We had paid all of our loan back, they were told to take the car back just on the arrears of the late payment charges and repo charge from the first time. I hope you can get your problemw ith them sorted then take them to court for the money they've charged you! Good luck!

Yep, the cheque cleared today, I was sort of expecting it to bounce but I noticed that the cheque was made out from the account where all the payments are sent when you have a loan with them so I imagine there's a lot of money in there most of the time! I hope that this will encourage people to keep trying with them!!
  17. cocococo, I have just managed to claim back over £1600 from Log Book Loans! Last year they tried to take the car away twice because of the arrears on my account due to late payment charges. The first time they were succesful and took the car to an auction pound but my Dad bailed us out by paying the costs the next day and we had to travel 30 miles by train to get it back! The next time they tried they weren't so lucky, I had read up on Log Book Loans on this forum so I read them the riot act! But LBL still charged me for the visit. I took them to court, they failed to reply, so I was given judgment on the 10th May. A cheque was delivered by hand this morning for the whole amount! If you need any advice, pm me.
  18. As you may have read in another thread, I asked LBL to refund the late payment fees and repossession fees in March of this year. They didn't !!reply to my prelim or LBA so I sent in my court claim about 4 weeks ago. They didn't respond to that either, so I was awarded judgment in default. Today, what was put through my door by hand? A big fat cheque from LBL for the whole amount! Just over £1600!!! YIPEE!!! So if you're fighting LBL for whatever reason, keep trying, they'll pay in the end!!

  20. I got a letter from him this morning, just the usual 'we are currently investigating your claim and will respond to you as soon as possible' codswallop! Only a fax number for his department I'm afraid...020 8236 8010
  21. I sent in my claim for a refund of late payment charges and repossession charges on the 19th April 2007, LBL had until 8th May to respond, they didn't, so judgment (in default) was given on 11 May. Obviously now comes the difficult bit, enforcing the judgment and getting our money back!!
  22. Thanks JonCris; The order just says 'You must pay the claimant £***** forthwith'. I take it that means immediately, but how many days should I wait to receive payment? Should I contact LBL at all or leave it to the court bailiffs?
  23. Well, in the post on Saturday came the Judgment for Claimant (in default) from the court ordering LBL to pay me the total amount! I'm not sure whether LBL will apply for a hearing to have the judgment set aside but does anyone know how long I should wait before I enforce the judgment? Many thanks. Char.
