  1. Me vs Northern Rock http://www.consumeractiongroup.co.uk/forum/showthread.php?310619-Northern-Rock-Single-Premium-PPI Recieved a letter from them dated 02/09 stating they will refund £4316.90 and £1370.21 in 8% simple interest. I asked them for a refund of £4182 so mustn't have done my sums properly. I must point out that NR did exceed the 8 week deadline by about 2 days but they investigated thoroughly and even looked at another loan I had prior to this one. Just waiting for the money to appear in my account now. Its been 3 weeks since I returned the agreement and getting a little impatient.
  2. Gotcha, Thanks again. There was 1 late fee added for 30 quid in 2008. They changed the monthly payment to add the 30 quid on so I was effectively paying it back over the remainder of the loan period. Will check with them again though before I pay up.
  3. Thanks dx but I dont understand what you mean. Can you explain further? You have me a little confused.
  4. Just a quick update. Success. NR responded eventually and just outside of the 8 weeks. They have agreed to refund £4316.90 in PPI payments made and also £1370.21 in respect of 8% simple interest. Total refund of £5687.11. I returned the response 3 weeks ago today and am still waiting for the cash to arrive. The letter states normally within 28 days so hopefully will have it by next week. As soon as it does arrive I will be straight on the phone to clear the outstanding balance and be rid of it.
  5. Hi all, Have decided to take this up now and I'm confusing myself trying to work out what and how much claim. I have a loan with Northern Rock which was taken out in March 2004 for £8000 @ 9.9%apr over 120 monthly payments. PPI was applied at a cost of £3696. The total loan amount on my statement shows £18,174. If I've worked this out correctly this is 8000+3696=11696. £11,696 @9.9% apr over 120months comes to 18,144 - I think I may have had one late payment charge of £30. Am I right in saying this would be a single premium ppi? the loan will complete in March/April 2014 so is still ongoing and as of now I still owe 5327.85. I'm at a total loss as to what I need to ask them for. Do I ask for a refund of the amount paid plus the interest I have accrued on the ppi part or do I ask for a cancelation of the PPI? I'm more than happy for them to wipe any refunded amount off the balance to reduce the loan. I told the lady on the phone that I didn't want PPI and was bullied into taking it with tactics such as "you cant have the loan without the PPI as its over a long term" and the best one of all "dont worry, its a great product and covers any and all other future credit agreements you take out with any other lenders for the life of the loan". I was desperate and gullible and signed up. I now want my money back. Thanks in advance.

    MarkyT vs Cahoot

A pretty teriffying experience tbh. I should have gone to court earlier to sit in on a small claims case beforehand - I think it would have prepared me better.
  7. Thanks for the kind words. I must say I really dont want to have to go through this again. I am quite a nervous person in situation like this although now I do have a little bit of a better idea of what to expect if I have to go back next year.

Bad news. Judge stayed the case. As soon as I introduced myself to the usher, he then introduced me to Cahoot/Abbey's Barrister. I almost collapsed at that point. Young lad (said barrister) who looked no older than 21 took me into a room and explained that they would be applying for a stay and asked if I would object the application. I said no as I had already heard a barrister for HSBC talking to the guy next to me and he explained that Newcastle County Court are now staying all cases in light of the test case. We went into the court and the judge explained straightaway that he is staying the case until the test case is heard. He also explained that I should follow the case very closely as if the banks should lose then I need to contact the court again within 28 days of the ruling to have a judge direct an order for me to be refunded. I was quite suprised as there were a lot of barristers and the guy from cahoot explained that all of the banks were being represented today.

  10. Well, I'm in court today - 2pm and bricking it. I got a letter on wednesday from the court saying that it is up to the trial judge wether or not to hear any evidence from the defence following my request for the defence to be struck out. Please all can you wish me luck. I'll post back this afternoon.

    Harvey v Cahoot

You will have to pay the court allocation fee - the one you paid for MCOL is for a different court to your county court so you have to pay both.
  14. That looks fine. It was the one I sent my SAR to and they came back with the list of transactions and uncashed cheque just within the 40 days
