I'm trying to claim £160 from Norwich and Peterborough mainly accrued in one incident where they applied a charge on my account which then resulted in not enough funds for other things etc the usual snowball effect. I've just received a letter now saying that I obviously cannot manage my account with them and they will close my account in May as part of their T & C's and give me back half the charges as a goodwill gesture only. What do I do? I only use the account as a cheque account as I don't have a cheque book with my other account so don't want to close it. Do I send a reply to the person who sent me this letter or do I send one to someone else, is there a template for this sort of thing???? Arrghh!!! xx

Had a letter today offering me a full refund of my charges £145 to settle providing I sign their letter stating that's the end of the matter...but....they won't refund the interest on the charges, which is around £30 I think. So I reckon a rather nice thanks but no thanks give me all my money back style letter is forthcoming. Quite pleased now, a bit of spends for my hols! Mads THREADS MERGED

They've come back to me and basically said they'll only give me £24 back out of the £96 I am claiming as they only owe me £48 as they've already refunded the others in the past (which I have yet to confirm as I haven't checked but don't remember it. However they have said that if I basically go ahead and sue then it means I don't want to be bound by their terms and conditions any more and therefore it would mean closing the account which means I am responsible for the outstanding balance. I can't afford that and I'm assuming they're just playing scare tactics but can they do this, could they close the account? Mads xx

Back 10 years ago when I was a student I had 2 barclays account plus a barclaycar which incurred horrendous charge due to bad info given by so called student advisor, defaulted on all 3, barclaycard paid back but other 2 account still making pitiful payments to debt collection agency. Question is all this occured before 2000 can I try and make a claim on these or is it not possible now? I'm absolutely gutted this site wasn't out a few years ago otherwise I would have had them for a few thousand really, but now I think I've missed the boat plus I don't have any of my old bank details or anything.   11. Sent my LBA to Cap 1 and Monumennt. No reply as yet from Monument but after standard £40 refund from Cap 1 I have now checked my balance and they've refunded a further £75 after receiving the LBA. I can now only assume the letter's in the post due to arrive. What now? Do I proceed with the claim for the remainer (roughly £170) or do I give them one final chance as a 'gesture of goodwill?' Nice of them to give me the money to pay for the court case though!! Mads xx
  12. Ordered my statements, Natwest very forthcoming, only £5 for the lot no questions asked. Anyway it occured to me, I know you claim for the last 6 years but how do you define that? I mean do you take it 6 years from the date you first send them the letter or order the statements. I have ordered from beginiing of April 2000 as I know I had a lot of charges at the start of that period (illness issues, bank v uncooperative) but what if it came to court and they tried to say I was claming past the 6 year mark? Am I making sense or gibbering again???? Mads xxx
  13. From Mr Udy, blimey he should get employee of the year the no. of cases he deals with!!! Basically said what I expected, wouldn't refund me, gesture of goodwill, I signed for their charges and they disagree with OFT and would not supply me with a breakdown of charges etc etc. Next letter due to go on Tuesday then. Should I just write the lba on the template or specifically try to address his points or would that be a plain waste of time given the generic nature of his reply and the fact that I seriously doubt he actually even read it anyway??????   14. No response to my letter yet but checked my cap one account online and lo and behold £40 refund of overlimit fee and late payment fee in my account. Just waiting for the bog standard letter then shall tell them where to shove it and pay me back my £286 quid!!! (240 charges plus interest they charged me at 29.9 apr!!) Is there a letter in the library as to a response to their 'you agreed to our charges' tactic that I assume they'll be employing as I couldn't find one. Mads xxx
  15. If you apply to Norwich and Peterborough building society even their basic bank account has a cheque book so that may help you. Mads x
  16. Sent off a claim to Monument and Capital 1 2 weeks ago on Friday. Said they had 14 days to give me cash back or else. Anyway no reply from Cap 1 as yet but Monument have sent bog-standard letter saying sorry to hear of complaint blah blah blah and will reply but no later than 18th May. Do I wait until then for reply or do I get medieval on their ass and send second letter Friday, bang on 14 days after they received the first? Mads xxxx
  17. Basically I have a personal loan payments of £36 per month through my catalogue, reasonable interest. Anyway through error my bank cancelled my direct debit and the comapny refused to reinstate. Payments were due on the 25th of the month with last direct debit payment being 25th Feb, so on 17th March I sent a cheque for that months payment. A few days later they started calling me demanding payment, around 10 times a day each time I told them the payment had been sent and they apologised for phoning me. Anyway cheque cleared around 5th April, all good or so I thought. Today I receive a letter saying that as the payment was late then they had put late payment charges as per my loan terms and penalty interest totalling £56 payable by return post!!!! I know that's unlawful and plan to tell them where to stick their penalties but could do with some advice as to the actual point of law about it. Or at least who I could threaten to report them to should they insist on pursuing this. Maddie xx
