I would send it again, and state at the bottom that it is their duty to comply with your requests under the law. Mind keep all correspondance with them, Just do as the link says if they ignore it again, state that in your next letter. Good luck ive not treid this yet but ive read lots of post by people who have and been successfull. I must get my finger out and do my one i just keep forgetting to get the postal order. Please HELP. Abbey defaulted my acoount on January 2006 £195. I received 6 charges of £30 on november 26 and a further £20 charge on 26 Dec exceeding the £195. I dont recall receiving any letters informing me of an impending default but i could be wrong, i do recall receiveing a phone call where i paid the outstanding amount. Since then i have recalimed all my charges back from this account totalling £610 when i received all my statements there was no mention or letters regarding the default. I have sent the s10 letter the reply i got was the usuall i agreed to them sending data to third parties etc, i replied to this letter saying that the processing of the default is in breach of data due to the fact that the default was soley based on unlawful charges that were added to my account. I have heard nothing from them for over 3mths where do i go from here, amy advise will be greatly received. Thanks in advance. joanne x -
wonder if you could help me, mr udy hasnt got back to me in time after i sent him a refusal letter so its time to file in my claim form, so here goes with all my questions, is it form 1 for small claims i fill in, and send them 3 copies along with my breakdown of charges and the 8% spreadsheet? can i use the capital one PO box address? and could you please tell me if this is correct, total charges comes to £256, 17.47% interest on this come to the total of £290.53 now that im at the court stage i can now add 8% bringing the total to £306.38 do i add the £39 court fee to this or does the court do that for you?
