I would say if you feel you have been a good customer, and had money in the bank, then if approached nicely you may be able to sway them that your business with them is worth more to them than a petty overdrawing.
They wouldn't admit liablity of course and may ask you to sign away any future claims, for this matter, but for this sum is seems of little value anyway.
Now might be a good time to have a friendly chat with one of their Customer Advisers about your money in their bank, and quietly discuss what they offer, versus other banks (you may want to research a few other banks rates). In time mention that the only thing that made you even look at other banks was this piddling matter. If you can get their attention then explain it briefly, like it isn't a crusade, then they may shift the balance in your favourite.
A non-legal course of action, with no technical details, but it could work at the human level.
