  1. I see from the Comsumer Action Group the Group assited in challenging the Hull Stikeout Orders. I very interested in how this is done as I was informed by a High Court Judge in Exeter that he would not allow my application for Stike Out or allow the case to go forward as his decision was based on that of HHJ Iain Hughs QC – Heynes v HSBC & Alliance & Leicester 7QT04849. I have a claim of around £5000 which would most useful to have return. LloydsTSB has recently closed my account and is starting court action to recover the overdraft charges they have taking from my account. I would be most gratful for any help anyone can give me in this matter.
  2. Hi, I am looking to find someone that can give me some advise in respect of my up coming date on the 5th of December. I have a number applications in play one was for the stay to lifted on grounds of hardship incurred by the bank but this has been denied on the basis of some judgement. The second is for the claim increase which i understand is a formality but the third is to deal with the strikeout of the defence. I am unsure how to handle this as the courts seems to have a, lost track of this paperwork and b, how does this work if the stay is not lifted. Should i win the case if the bank doest turn up to defend or am i on a losing run??????? I would appreciate anyone time on the telephone to give me some pointers as it is starting to get confusing. If you can spare the time and advise please PM your number and a time and i'll call you, alternatively any advise anyone can give me is greatly appreciated. Thanks
  3. The claim is respect of a personal account. The court missed the fact I had application of motion in place and stay my case. So my date of 30th October was canceled and now moved to 30th November 07.

Hi, It's nearly been a year since i was here last.To update all, The Court has finally seen fit to hear my applications for strikeout and increasing the claim value, which have now exceeded £5000. I have been inform that this may go to full trial if the the other parties turn up on the day. So I am preparing my court bundle tonight. This should be fun as i have already level 2 forests with the paper i have used in printing. Maybe i should ask the judge to make the bank pay an environmental penalty for waste of paper. I am looking forward to court as it should finally get Lloyds TSB off my back from their constant phone calls to give them money for a debt they created.
  5. Hi, I need some help here to understand the process of how to ask the court to strike out the defense on the abuse process. My court date is still along way off and i would like to settle this. Also my bank has stuffed me with a further £500 of charges what is the best way to amend the the documents to get this added. Saul.

  8. Here the Letter received this morning - "Thank you for getting in touch with us again. I am sorry you are still unhappy about your account charges. We've already explained that we believe it is fair to charge you for extra services you're requested, as long as you know about the charges in advance. When you didn't have enough in your account to cover payment you'd asked us to make, we had agreed to make it by setting up or increasing your overdraft, or tell you we couldn't agree it. We feel it's only fair to charge for our services in considering and implementing this. It's easy to keep a running check on how much is in your account. You can get an up-to-date balance at any of our cash machines, over the phone, on line and by weekly text to your mobile. If you know a payment is going to take you over the limit we've agreed, you're welcome to see if we can raise it - and we can usually give you an answer straight away. Again we can do that for you by phone, on line or at any of our branches. There's no charge at all for this. Generally we don't agree to adjust any of these charges, but I can tell you that on this occasion we are prepared to reduce the charges by repaying you £750. It is not LloydsTSB policy to refund interest. You may have read that we and the other banks are discussing overdraft charges with the Office of Fair Trading. Meanwhile we do consider each customer's postion individually, and we are making you this offer as a gesture of goodwill because we might face that cost in dealing with your complaint if you took it any further. I need to let you know that this does not mean we consider we have any legal obligation to do so. This sum will be credited to your account in the next few days. As I've explained, these charges are avoidable and we would strongly urge you to keep within the limit you're agreed with us or to ask us now to see if we could increase it for you. This letter is the bank's final response, which means that if you remain dissatisfied you may refer your complaint to the Financial Ombudsman Service. If you decide to pursue your complaint through the Financial Ombudsman Service you must do so within 6 months from the date of this letter.   9. Hi, Yesterday LloydsTSb deposited an EX-GRATIA payment of £750 into my account which is way short of the £3098 i am suing for. What should I do?
  10. Update - I filed the Court Proceedings last Friday as the deadline for the Bank to reply to my second letter passed. The total claim value is £3098.28. I get the feeling as a Première Customer of LloydsTSB they may take this further, I hope I am wrong or maybe they have not got the second letter!! The first letter was sent to the Chairman's Office and the second letter to the Recovery Unit which sent me my first reply. Now as the correspondents came from the Recovery Unit I guess that I am talking to the right department. Lets hope they sort this out soon.
  11. Hi, Here goes today I am sending my second letter out to Lloyds. I was especially encouraged to pursue this cause after my Bank manager told me it was hard luck and I should get over it and not get into debt. What these bank mangers don't get is some people's lives are sometimes in the balance and the charges they present can cause such hardship and worry. It's okay for them in their cosy little offices behind a glass wall with their belief that they are right and we are always wrong. They forget they are a business that should support business and people, not penalise those with less and reward the rich. What sense is there in charging 30% to people with no hope in repaying something and then people with money get 6%. The balance must be restored, we can not let this madness continue it is time to pursue these monsters of our society and take back the hope that has been so quietly smashed on rocks.
