  1. Good evening fellow members, have many claimers succeeded in getting paid out by A & L beyond six years? And if so could they reply or post a link for me please? dp
  2. Hi Claim, its [edit] cheek that [edit] charge you to take cash out of your own business but that is what they do where I work. If I want cash instead of a cheque - because I can't afford to wait for the cheque to clear. I used to have to pay a handling fee which was 49 pence per £100 of cash withdrawn. It has now gone up to 53 pence in the pound. Cheers dp>
  3. Hi Dave, I'll be watching with interest as the same has happened to me with Direct Line Financial Services who are part of RBS group. Good luck dp
  4. Well two weeks since I sent my fiver and still waiting.................... Anyway, it will give me time to research compound interest, commercial interest etc. Is there a compound interest spreadsheet available anywhere please? Can anyone suggest what sort of interest I should be claiming - particularly on a claim going back this far (1987/88)?? As the amount given the time elapsed will be enormous HEE HEE HEE.
  5. If you look at the increasing number of posts that refer to paypal's inflexability or their dogmatic attitude to complaints regarding Ebay transactions that have failed. I would question their ability to deal fairly with their clients. My experience with paypal left me out of pocket and "out of time" to receive a refund after making a valid complaint. I also think that their charges are too high, so I voted with my feet and stopped using them. We readily and usually justifiably criticise banks, credit card companies etc on this site. However we are not invited to donate to the CAG using their services.
  6. I've seen quite a few threads and posts regarding Ebay and Paypal, where CAG members are unhappy with the lack of help or support offered by Paypal when something goes wrong. So my question is, should the site be using this company as its means of accepting donnations from successful claimants? I for one would be pleased to donate, but would not use Paypal due to their shoddy treatment of me in the past. Your comments would be welcome - let the debate begin. Regards dp
  7. Sorry to crash this thread, but NIGHTMARE4BANKS can you empty your inbox as I'm trying to PM you and the in box is full. Sorry everybody for this off thread enquiry. Regards dp
  8. Hi Bert, I've always taken the form in to the court office the day after the defence was due to be filed. You need to complete the section on the right hand side near the bottom, seperating the claim from the court fee and any 8% statutory interest that you may be claiming and tick the box on the left hand side requesting payment. The court staff look on their computer to check that the defence hasn't been submitted. In which case they will take the form from you and the judge will order that judgement in default be registered. In my court - Tunbridge Wells - they get these out the same day or the day after. I know that one court I used in Bromley took up to a week to process paperwork. Cheers davidp
  9. Hi Fendy, I've just seen your thread about the tatty inadequate envelopes NatWest use to send bundles of statements out. I complained to NatWest that mine was split down the length of both sides - so bad in fact that Royal Mail had put the contents into a strong plastic envelope for onward travel to my abode. The bank's response to my complaint about quality of envelope was to blame Royal Mail. Saying they had stated on the plastic envelope that the brown envelope had became damaged in transit. So, by their reckoning, if I sent some raw eggs to someone in an ordinary box - not a moulded egg container from a shop - and they arrived broken that would be Royal Mails fault, not mine, for not packing them carefully inthe first place. I made a valid point to NatWest, that in this age of identity fraud, I could easily have lost some sensitive information from the split envelopes. Needless to say they were not concerned! Regards DAVIDP.
  10. Does a MOD or a HELPER have any information on this one? DAVIDP
  11. Did you request a copy of the executed agreement under the CCA section 77(1)/78(1)? If so and they cannot provide a copy they are in breach of the act and cannot enforce the agreement without a court order. Furthermore they will commit a criminal act if they continue to withold a copy of the agreement. There is a v.long thread dealing with the CCA 1974 and its worth a read if you get a moment ( or a few spare days!!). Here's the link. http://www.consumeractiongroup.co.uk/forum/general/33174-consumer-credit-act-agreements.html?highlight=consumer+credit+agreement You can stop paying these guys any money twelve days after the request for a copy of the agreement if they fail to comply with your request as they will be in default of the agreement. Will they go to court to enforce an agreement that they cannot produce? I don't think so. Regards DP
  12. Hi all, can anyone tell me the answer to this question - or where to look to get the answer? When PPI is sold/mis-sold can the loan provider include interest on the insurance part of the transaction? In other words can they show the capital sum + the insurance amount = the total loan amount and then add interest to show the total to be repaid before dividing by the number of months to create a monthly repayment figure? In my example I am referring to a fixed term personal loan NOT a credit card agreement. Thanks in anticipation Regards DP
  13. Thanks AC. Your link confirms that RBS and NatWest paid a bonus on PPI sales. I'm trying to establish if another member of the same group - Direct Line -also paid a bonus or commission on PPI. I am cause my wife says I am.... DAVID P.
  14. Hello good folks. I am having a battle with Direct Line, trying to convince them that I was not informed at the time of taking out two seperate loans that the sale of PPI was optional. They are adamant that no miss selling took place and I had the opportunity to cancel the PPI when I received a copy of my agreement. Blah !! I was told that as my credit rating was poor I could not have the loan unless PPI was taken out at the same time. However if I could find evidence that their staff received incentives for pushing PPI I might stand a better chance if I go to court on this one. So, I would like to know if Direct Line personnel were paid commission or a bonus for the sale of PPI like RBS and NatWest who are part of the same trading group. Can anyone help please, as I feel that I'm banging my head against a brick wall when dealing with Direct Line. Cheers DAVID P.
