  1. Well SAR sent Saturday to the Edinburgh address. Response in post yesterday from a Southend address acknowledging and promisng data within 40 days. A start!
  2. Het BankFodder a thought. The "Today" prog on Radio 4 runs a man/woman of the year competition around the end of the year - maybe we should put you up for it. Get all the forum members to vote for you you might get it. Great publicity and the Banks would hate it!

I came accross this today in Wikepedia CONTRACTS UBERRIMAE FIDEI Contracts uberrimae fidei (contracts of the utmost good faith) impose a duty of disclosure of all material facts because one party is in a strong position to know the truth. Examples would include contracts of insurance and family settlements. A material fact is something which would influence a reasonable person in making the contract. If one party fails to do this, the contract may be avoided. See: Lambert v Co-Operative Insurance Society [1975] 2 Lloyd's Rep 485. Where there is a fiduciary relationship between the parties to a contract a duty of disclosure will arise, eg, solicitor and client, bank manager and client, trustee and beneficiary, and inter-family agreements This is interesting in view of the Banks reluctance to disclose there true costs! One might argue that the contract is as above. How about embezlement, missrepresentaion, fraud,deception, theft or larceny? If it could be shown that they knew that their charges were far less than those that they were levying and that nonetheles continued to misrepresent them as only covering their actual costs it does seem to me that their may be grounds for a criminal investigation.   5. That seems like a very good point! Fraud is of course a criminal offence and the prospect of a few CEO's in the dock is a very pleasing one! I suppose that if it could be shown that there was a deliberate attempt to conceal the nature of the charges and to missrepresent them as actual costs rather than as a the penalty which they so clearly are, then I suppose it might be possible to claim fraud. It is interesting that the Banks are so keen to avoid having to give a detailed costs breakdown in open court! Conspiracy to defraud and obtaining a pecuniary advantage by deception would be interesting charges! If fraud could be proven, or what about misrepresentation, then I guess we could go back more than 6 years as you point out. Any of m'learned friends out there care to venture a pro bono opinion! What about a class action or a complaint to the SFO!

  9. Thanks a VGP Jimbo I guess that I shold probably go after HFC Bank but I posted the letters to the Box No before I read your post! Still they have gone recorded so thay cant claim they didnt get them! Will let you know!

  12. Some advice please! I had an account with MBNA for just over 1o years from 95 to 2005, I still have all the original statements [Yes sad I know!] and I am thinking of trying to reclaim all ten years illegal charges or should I just stick to six? I am not quite clear as to wear the six year figure arises from? I will go straight for the prelim letter as I have the documentary evidence but do I go for six or ten years?

  15. There was a credit card company called The Associates. I closed my account with them 5 years ago but want to go after them! The address was PO Box 54 Salford Quays Manchester. Are they still going have thay been merged or taken over? Does anyone have an address for them? I have no contact details Bicester1
  16. i have all my bank statements and have calculated the charges also noted the fact that several times they have debited interest when they should have credited it! Given that I have all the statements is it woth sending an SAR or should I just send them a prelim letter? Do I need to confirm the level of manual intervention? Bicester1
  17. Hi Thanks guys. What a fantastic set up! Like many I was vaguely aware of the OFT ruling on bank charges but unsure as to what to do. Now I know! I am well paid but hopeless with my financial management and over the years have been well and truely screwed by my Bank and Credit Card companies. I foolishly believed in the old fashioned type of Bank Manager who had my own interests at heart! Ha Ha! With the help of this forum I am now about to get even! I will keep you informed. My banks are The Nat West and Halifax ccs are Barclacard, MBNA, MINT and GM card. I have all my statements for the lasst 10 years as I am obsessive about keeping things like that. Little room then it seems to me for obstruction by our revered finacial institutions! So as Marc Antony says in "Julius Ceasar" " Cry havoc and let slip the dogs of war!" PS I will certainly donate a % of anything I get back to the site and will keep you informed Bicester 1
