Ok guys......it's the 13th of June - 14 days before the court hearing - and according to the orders on the order of allocation DG should have sent me (and the court) documents they intend to use in court. I have received nothing from DG. Sent them the court bundle 10 days ago by special delivery. I intend to contact the court tomorrow and see what they say........fingers crossed.

  4. Hi all, Well the court bundle was sent last week, and I sent the bundle to DG solicitors today. One question to anyone who can answer it. DG have until the 13th June to send me a copy of the documents they intend to rely upon, if they don't what action can I take? Dub
  5. Hi Sar, I think I'm right in thinking that the £37.50 Overdraft is charged the first time you exceed your limit and the excess overdraft is the charge per day thereafter. I've claimed for both on mine. Dub
  6. Personally I would bite their hand off. The choice at the end of the day is yours. If you decide to go for adding the interest and chasing you will have to wait and work hard to reclaim your money, with the possibility of court. But the money at the end of the day is yours or You can accept their offer which is only £50 short. Good luck whichever way you go. Dub

  8. Yeh, sorry Damjef, a bit of a misreading of the orders by me. You're absolutely right, I need to have the detailed PoC, latest Sched in by this Wednesday and the bundle in two weeks before the court date. All this paperwork, trying to read law and Wednesday's judgement has my brain shredded. Best thing to come is that I now have all three bundles done and dusted. I'm tempted to submit the lot on Monday to get it all out of the way, and it might have an effect on D&G. Take it easy and here's to a couple of quid for a pint.

Hi Ecb, As long as you have afforded them the 28 days since the initial letter (whatever the format) so you have allowed them time to consider and settle the claim before court action you should be fine. I would (I did) amend the letters so they make sense. So if you are about to take action state that in your refusal letter, they have the opportunity to settle right up until the court date. I would have thought that you could have only threatened them with the information commisioner if they hadn't complied with the SAR to get your statements.   10. Cheers mate, Yup my hearing's in Nuneaton, I'm just up the road from you in LEICS. I've altered my witness statement slightly i.e. section 11 I refer to the Terms and Conditions 5.1.3 which state that I should not exceed my overdraft limit. I need to have all the bundle with the court and FD by Wednesday so I have a horrendous weekend. Haven't really altered the PoC just used the template for the hardcopy from the Library of templates. looking at the site some people are still having offers from other solicitors. Good luck as well - have you got a court date?

Hi guys, And the thanks is to livelylad for providing the internet site that archived the pages but the T&Cs for First Direct are here first direct legals - principal terms and conditions - relates to 2003 I managed to get 2001, 02, 03, 04, 05 Good luck... And found the (hopefully) magic line........ 5.1.3 states "You should not exceed any agreed overdraft limit unless you get our agreement first. " Would that be because you would be breaching contract and be subject to a penalty charge if you do Mr. Direct...???

I may have some good news - thanks to livelylad I have T&Cs from 2003 from FD... first direct legals - principal terms and conditions and the magic line 5.1.3 You should not exceed any overdraft limit unless you get our agreement first.... I hope this will do the job because it's going into my court bundle right the hell now....
