  2. Thanks, jonni2bad. I will send a SAR (do I need 2 as there is a credit card there too, also Halifax but they seem to operate in complete ignorance of each other). Is there a mechanism for taking them to court without actually coming to the UK? I am living and working abroad and a visit of who knows how long to the UK to make court appearances would be ridiculously expensive and would negate the point of all this. The same thing probably applies to them as they will find it difficult and expensive to pursue me through the courts until such time as I return to UK to live/work - but that might be never.
  3. Hello, I have been having problems with the Halifax since 2004. I have looked around on the forums but not spotted any similar cases. I worked in UK until Aug 2003. I banked with Halifax and had one of their credit cards. There were some standing orders on my current account for savings schemes. I also took out a loan and was paying it off monthly. In Aug 2003 I went to Thailand after the school in Scotland closed. I gave the Halifax my new address and carried on paying into the account so that the comittments could be met. No problems. In December 2004 I moved to Swaziland and things went bad. I made a couple of big payments into my account to keep it in credit (not entirely successful due to timing problems) and in March 2004 sent them a letter giving my new address and requesting they review my monthly payments as my new salary (African wages) was much less than I had been earning before. They didn't answer that or two other letters sent to the branch and Head Office. They admitted later they had failed to amend their records. I was getting no statements, no confirmation that monies sent had been received, no communication and no feedback. They even stopped me accessing details of my account online - so I stopped sending money. Not until mid 2005 did I get anything from them and then it was threatening letters from their debt collectors. They have never acknowledged or answered the points and questions in my original letter or the subsequent two letters. I took them to the Financial Ombudsman service but although he did judge the Firm to be at fault for not replying and not amending their records, did not uphold my claim for losses due to lapsed payments on my savings plans. The FO told me the Firm had agreed to send backdated statements and refund charges of 480 pounds and carry out a financial assessment so we could agree a monthly payment to clear my debt. This would all be done before I had to pay anything. To date I have not had these and am now being harrassed regularly by 3 separate debt collection companies and their associated lawyers. They send letters, often with UK postage and incorrect address details which take a long time to get here. (I have today recieved one sent on 8th August) demanding responses in ten days from the dat of mailing. All refuse to answer e-mails. I have lots of documentation of correspondance but no records of what they have done with my account or the many charges I believe the original (2004 debt) has been inflated by about 3000 pounds through interest and charges. Also that the Halifax had a contractual obligation to keep me informed of how they were managing my account once I sent them my amended address. Any suggestions??
