UPDATE!!! After a long chat with Litigation i managed to get just under half my interest and all charges back!! I got sent the agreement letter signed it and sent it back. That was around three weeks ago. I called today as i still have no money!! Apparently they have not got my signed agreement back and the court date is on friday this week!!!!!!!!! Litigation thought the hearing was last month!!! They are trying to get me to sort the letter by fax today. Does this mean i have won all my interest and charges by default as Barclays have not sent in a bundle, (one of the conditions of the directions give by the judge) Where do i stand ? cheers JS1

They said they cannot pay me back my contractual interest! This is a large amount of money. 1. Is it a blag? 2. I have a court date, if it goes to court will i get conractual back? 3. Wow! That was interesting, spoke to a lady in the litigation and she said to call back mid july to settle! She apologised that she could not settle this very moment due to them only dealing with this months claims. Thanks trucker. oh and i have found the OFT summary. cheers JS1

Ok, it says this the papers in the claim were considered by district judge ***** who allocated the claim to the small claims track to be heard at ***** county court. 17th Aug estimated time 15 mins The following directions apply 1 The Claimant shall within 21 days of service of this order send to the Defendant and to the Court: a) A schedule setting out each charge repayment of which is sought, showing the date, amount, and reason given (if any) for that charge being made; b) A statement of evidence of all matters relied upon as tending to show that the charges are irrecoverable as penalties or otherwise; If the Claimant fails to comply with this order, the claim will be struck out without further order. 2. The Defendant shall within 21 days thereafter file and serve a response to the Claimant's schedule, stating in respect of each item claimed; a) Pursuant to what contractual provision such charge was made, producing a copy of the contractual document relied upon; b) Whether such charge is accepted to be a penalty, and if not why not; c) If such charge is alleged to be a pre-estimate of the Defendant's loss incurred by the Claimant's actions (whether or not such action is treated as a breach of contract between the parties), all facts and matters intended to be relied upon as showing that such was a proper estimate of such loss, and all evidence to be adduced at trial as to what the true cost of dealing with the matter was; d) Any witness statements. e) Copies of decided cases and other legal materials to be relied upon. If the Defendant fails to comply with this order, the Defence will be struck out without further order. i'm not sure who the legal team will be, do i call or send in the court bundle. I registered my claim in January at my local court, its since been in referal with the judge since the 24th of march. I called today to find that they have transfered it to a court in the next city!!!!!!!!!!!!!:o Eh !!!! I spoke to the lady at the court to ask why this had happened she told me that she didnt have all the info yet as they were waiting for my file. Then she said it would be refered again!! :o Can anyone cast any light on any possible reasons to why it will of been transfered? Can anyone tell me if i can complain about this and who to? Would it be my old or new court. Should it take this long?? cheers JS1
