  1. I negotiated with her to £160.00
  2. Had another email from Inga, now negotiating £160 costs. Will probably accept this as it will save me the hassel of going to court, and will more than cover my costs for postage
  3. Yes recieved money on internet banking on 11th, cleared on 14th
  4. So Inga has started to reply to me with the following: We refer to your email below. We note that you have accepted our payment in full and final settlement of your claim. This does not entitle you to now raise a further claim for costs. The claim, as agreed, having been settled in full. Should you proceed with your proposed costs order we shall be bringing your email below and this response to the attention of the Court. We trust in any event such action is not necessary. Kind regards, Inga Kirkman. In which i replied: Thanks for replying. If you read my letter and email, i have stated the following: I can confirm that, subject to costs, I am willing to accept your offer in full and final settlement of this claim, and will contact the court to discontinue proceedings upon receipt of these costs. I have calculated my total costs to date to be £320.48, as detailed at the end of this letter. Therefore untill you award me costs, then i have not accepted the payment as full and final settlement I shall attend court on thursday to claim my costs, which in turn will rise as i have to take leave from work. I hope this clarifys my postion. She has now replied with: "Without prejudice" Dear x, I am not prepared to pay additional costs in addition to the £220.00 already provided to you. The Court bundle is in one and the same form as that precedent provided on various websites. It can not therefore be the case that you have spent 30 hours printing off what is largely pre-existing material. Printer ink and postal costs are likewise not recoverable. Should you wish to reconsider your position, I am happy to continue discussions with you. Kind regards, Inga Kirkman
  5. Will update my thread now, once i received their offer i replied with a letter confirming i will only accept if they award me my costs
  6. Yes 220 costs were in my settlement amount, sounds like she is saying thats all the costs they will pay
  7. Sorry for hijacking your thread clarion, just wondering what i should now reply to this! The £220 additional costs she talks about is the court fees.
  8. Now have a reply! "Without prejudice" Dear XX, I am not prepared to pay additional costs in addition to the £220.00 already provided to you. The Court bundle is in one and the same form as that precedent provided on various websites. It can not therefore be the case that you have spent 30 hours printing off what is largely pre-existing material. Printer ink and postal costs are likewise not recoverable. I think its more scare tactics from them really!
  10. haha, i speak to soon! Just got this email from Inga: Dear XXXXX, We refer to your email below. The thing is my email clearly states : I can confirm that, subject to costs, I am willing to accept your offer in full and final settlement of this claim, and will contact the court to discontinue proceedings upon receipt of these costs. I have calculated my total costs to date to be £320.48, as detailed at the end of this letter. I have also put at the top Without Prejudice!
  11. Hi Clarion, Looks like ill be going to court too. Abbey have refused to respond to countless emails and letters regarding costs, so i shall have to go to court on thursday to claim my costs. Will also have to claim costs for a loss of days pay too.
  12. Abbey settled in full for my case (funds received 14th June), i have since wrote them a letter demanding full refund of wasted costs. I have not had a reply for them yet, and i have not let the court know abbey have settled yet. My court date is the 28th June, but i am definately unavailable to attend on that date now. If i submit a wasted costs order to the court, will they make me attend on the 28th still?
  13. Hi Clarion, Got same dates as you! My bundle was due 14th too, with a hearing on 28th at guildford court. I sent my bundle to abbey, which they received on 29th May. I received a settlement letter a week later. I have wrote back to them now claiming costs, obviously if they do not pay i will still turn up on 28th.
  14. Thanks brownie, will make sure i post off the courts bundle tomorrow! Have PMd you my email
