  1. he should apply for other jobs. if he gets one he can tell the boss to match his new wage or he's off. he doesn't need to wait for someone else to decide whether he should make future plans. plus it always seems much easier to find a job when you have one already. always seems harder to find one if you are out of work.

  2. you should call the courts and ask if the judges here have adopted a standard approach to this. in my experience the judges here had agreed to put all cases on hold until a local test case was heard. my has been adjourned generally on this basis.

     

    on the subject of a good barrister being able to argue a point..... of course they can but the solicitor will have to prepare a case before you get a barrister and he will of course want to be paid for that. solicitors are no different to any other business. they will tell you whatever it takes to get your money......

  3. i wouldn't waste your time. having many years experience in the mobile phone world i have seen this happen many times, in fact i predicted this to many customers who couldn't understand why i wouldn't match the amazing deals they had seen in the papers. should you go down the road of legal action, the company will close their doors. they will mysteriously have a new sign erected and re open as a new business, luckily for the staff they will be employed by the new company......

     

     

    now there is an old saying.... if it sounds too good to be true.....

     

    free phone, free accessories, free line rental, free minutes, free texts.....for 18 months and you only pay for 2 months...... surely alarm bells were ringing.... weren't they???

  4. dave, my case in craigavon was adjourned, the NI judges have decided that a test case will be heard in belfast before any others will be heard. they will try to adjourn the case to wait for the oft report. my judge told me that judges had decided to proceed without the report so argue against that, you will likely succeed. don't expect them to settle outside, they may do as they know the judges want a test case and have specified belfast for this. please let us know what happens, pm me please my case is posponed on this basis if they settle that will give me something to write to my judge about.....

     

    good luck, don't panic, the judge will want to make a judgement and will help you through the trial to make your case. they have more to lose than you. they are in the wrong, be confident and smile when the ft solicitor speaks to you.

  5. i just called the solicitor representing first trust next week. he intends making an application to delay the case until the oft report. he asked me if i would oppose such a motion. it told him about this case and that i expected it would be heard on monday and i would use the outcome to decide if i would oppose the motion but i expect to wim and 8% interest will accrue all the time it is delayed. he told me he is very familiar with the BOI case on monday and that they are watching too to see what happens.

  6. i had a case in the small claims court in craigavon this week. we were told at the opening of the court that we must exchange documents we would rely on at that point. the documents did not have to be produced days before the case. essentially you would have only a few minutes to look at any documents that become available at that time.

     

    she suggested that we should all try to settle without her ruling and sent us all out to try to resolve our disagreements. most cases don't make it to trial.

     

    she was right only 1 case went to trial. mine ( not a bank ). just like judge judy, a bit nervous to begin but once things get going it is surprisingly straghtforward.

  7. i have a date with the first trust and a judge in craigavon court on 19th april. i had heard of other cases being delayed until april. i have a civil suit against another individual, not a bank which i processed at the same time. the court date for it was about 3 weeks earlier so i believe the bank case was held off until beyond this deadline. even if there is a reccomendation for a max of £12 i will contest the charges as unfair as they are above the banks costs. i have already paid the court fee so will fight them in the courtroom no matter what ruling appears.

  8. i am in process woth first trust. they have offered nothing and refuted my claim. i have a court date for 19th april. ulster bank made me no partial offer but paid made an offer of full payment within 2 weeks of filing with court. paid out about 2 weeks later
