Advise. In the letter I received they have requested a need to send back a signed copy of their letter, and Notice of Discontinuance. Looking through the paper work I have received I have 2 copies of the letter and then their defense. There is no paper work headed up "Notice of Discontinuance" for me to sign. Have they forgotten to send it? Or am I missing something? Regards PG

Good morning People I have received an offer from YB this morning for the full amount. The letter doesn't include the cheque so I'm going to write them a nice letter saying that I will accept the offer when I have the funds in my account. At which point I will send their letter back signed. Does that sound about right? pg

So I'm presuming that they have until end of business tomorrow! I'm looking forward to seeing what they have to say. Their communication with myself has been a little quiet. Which has got me intrigued! Something else I have noticed. I received a letter dated 20th December 2006 (in response to my Prem) saying the normal stuff and that my complaint would be left open for 8 weeks from the date of this letter and if they didn't receive a response within that period they would consider the matter closed. I then received a letter dated 29th January 2007, saying I refer to your recent letter (pre court letter). We have now re-opened your complaint. My understanding is that my complaint should have still be open (my calculations 8 weeks from 20/12/06 is 13/02/07). Is this a slip up on their behalf. Is this something I can report to their governing body? PG

Thanks caro. I issued the claim on the 31st January 2007 and they acknowledged it on the 1st February. Does the 28 days start from 31st Jan or 1st Feb? I'm presuming the 31st Jan as that's when I filed the claim. If they fail to supply a defense in the time, what would be my next step? I had a look at the money claim website last night and there's a facility to select to say they haven't responded in the 28 days. After the 28 days has passed I presuming I would just click on that? I'm thinking of phoning the Court today just o check that YB haven't done anything sneaking and I haven't been told. PG

Hi Foxy. Good luck with your claim. I also have a very keen interest in this case! I'm a local lad. I submitted my online claim on the 1st February so am awaiting a reply from YB very soon with an offer. PG -
Update...well update on nothing really. It's now the 27th February and I have heard nothing. They have accepted knowledge of the claim but as normal they are leaving things right to the last minute. Keep expecting to get a letter through the door with their resonse but nothing yet. What happens if they don't produce their defence? Is it automaticaaly awarded to me. Getting nervous now! till l8r PG

Acknowledgement received from the courts on 31 January 2007, it's official! And YB acknowledged the claim on the 1st February 2007. Pretty fast for them, which they did all business that quick! lol. Response signed by Kirstie Ann Ross. They've now got 28 days from the date of service of the claim. I'm guessing that means end of February before I hear anymore then!!!!! Regards PG

ok. just doing my online case and need someone to check over the text. ---online reads--- 1. The Claimant has an account MY ACCOUNT with the Defendant, opened May 2000 2. Since 19/06/2001 the Defendant debited charges and interest in respect of purported breaches of contract. 3. Defendant is aware of all details as a list of charges has already been supplied. Another copy will be sent. 4. Claimant contends: (a) The charges exceed the Defendant's losses caused by the breaches; (b) The Term permitting the Defendant to levy such charges is unenforceable under the Unfair Terms in Consumer Contracts Regulations 1999, Unfair Contract Terms Act 1977 and at Common Law. 5. Claimant claims: (a) return of the amounts debited of £1095; (b) Interest per S.69 County Courts Act 1984 of 8% - 318.92 continuing at 8% until judgment or settlement at a daily rate of £0.30; 6. Alternatively, if the charges are a fee for a service, then they must be reasonable under S.15 of the Supply of Goods and Services Act 1982. 7. Costs allowed by the Court. --- end --- Also, looking at the form online it request the following: Amount Claimed £1413.92 Court Fee: £120 Solicitor's cost: £?? I'm guessing that these will be zero as I'm represented myself. Total amount: 1533.92 Could somebody just confirm that the above is/looks right? Wouldn't want to mess it up at this stage. Regards PG
