I could really do with some help over claiming with HSBC. We have sent off asking for statements got back, sent letter asking for refund the bank wrote back for 1st account offering approx half of what we claimed for, so we accepted only as part payment ( followed template letters). We hadnt heard anything about our second account so sent them the LBA. Whilst we were waiting for a response we received a letter from METROPOLITAN COLLECTION SERVICES asking for the full amount that we owe HSBC even though 90 percent of it is charges that we are claiming back. Spoke to them and told them that the amount was in dispute and that we were trying to claim charges back and they told us that we would have to speak to the bank as only they can change it. HSBC CUSTOMER CREDIT SERVICES refused to take our calls.
Since then we have had letters saying and i quote
The bank does not agree with your contention that the charges have been inposed constitute a penalty and are therefore unenforceable. The contract between the bank and its customers is governed by Personal Banking Terms and Conditions. In respect of overdrafts I would refer you specifically to clause 7.11 in section 2. goes on to say that there fees and charges are clearly stated in price list. Said that they accept that the letter is not the response that we hoped for and if not satisfied can refer it to Financial Ombudsman Service.
As with the 1st account they are saying that there offer is final.
So I am now not sure how to deal with the DCA and how to find out which vampress calculation sheet and how to work out the interest at 8 percent as going to court is the only thing left opened to us.
Sorry to have gone on a bit but am really starting to worry over everything, even though i knew it could go to court we are at our wits end Any advice will be gratefully received.
