  1. OK, so I'm doing my MCOL now. I'm at the particulars of claim page and i've copied, pasted and amended the particulars i found in the library on this site. It then asks me to put in my total amount claiming. I'm not sure whether to include the interest figure into this box or not? Then i looked at the letter i have to send to MCOL (found it in the Library also) and it says to put in how much you are claiming for. Am i caliming for the amount of charges including interest and court costs (by the way £120!!! Couldn't believe my eyes!) So anyway, i'm just feeling a little confused and getting upset because i don't want to spend £120 cos i feel like i'm never gonna get that back either! Someone give me some inspiration and a little help with my depressing difficulties! Please please pretty please! Lots of Love. Givvynarna. xxx

  4. I think waiting one more day is perhaps a good idea as it will give you a chance to cool off from yet another setback to your claim. I can imagine this all must be very frustrating for you, but if you give them another day, you are at least being more than fair before you can speak to the nice people at the bailiffs again. So i would say wait, and then bring in the big guns tomorrow if there is no sign of your money in the post. Don't forget that it is you who is completley in the right here. You have already won your case, just keep telling yourself that. Chin up chicken! xxx
  5. I'm going to send that letter today by special delivery so my 7 days notice starts tomorrow. Unfortunately i am going on holiday at the end of the month so when the time comes to file my MCOL i will be a broad, so that leaves the scoundrels 3 weeks to send me something other than the 'fobbing off' letter that i've seen so many others have recieved on this site. Do they think we're all stupid or something? Anyways, i'll see if i get any other form of response in the next week before i go away, if not, MCOL will be filed at the start of June and then they can't run away anymore! Does anyone think that it will look bad on me if i'm not sticking 100% to deadlines? Has this come up in anyone else's case? Thanks, xxx
  6. wow! I am so impressed by your bravery! I can only hope that when i get to this stage i will be as strong willed. I have had a few problems and will have a few more as i have booked my summer holiday for the end of this month which will bugger up all my timetables. I will have to give them extra time (against my better judgement) before i can file my MCOL at the begginning of June. Keep going Kand! You're amazing! x
  7. Hello peeps. Just back from my holiday and am just about to go to the post office on my lunch break to send my final letter before i issue my MCOL. Just wondering if any of you have time to look it over before i send it? Here it is: Thank you for replying to my previous letter. I am sad to hear that you are still refusing to refund the unfair and unlawful bank charges that have been placed on my account over the last six years. Please accept this letter as notification that I will be beginning legal proceedings against Alliance and Leicester to reclaim the full amount as laid out in my previous schedule of charges plus interest and any incurred legal costs if I do not receive a full refund of the charges (or notification of your intention to issue a full refund of the charges) on my account within the next 7 days. I now calculate that you have taken £1,093.00 I am enclosing a copy of the schedule of the charges which I am claiming. I have already sent you a copy of this in my original letter of the 23rd April 2007. However, since then there has been further charges applied and I have now included these charges into my schedule. I am sure you are aware that every previous case of this kind has resulted in the full amount being returned to the claimant. I therefore, respectfully request that you save us both a lot of time and effort and refund the charges to me directly without court intervention. I look forward to your response. What do you think?
  8. oooh, this is so exciting Kand! Can't wait to find out the outcome of all of this. I have been watching your thread really closely since i began my own claim and i've really appreciated all of yours and blimeyboys advice, it really keeps me going. I'm so happy for you that your money could be only days away, and you've really struggled through like a true warrior.   10. oh right, and which address do i send it to? I've been sending things to: Alliance & Leicester PLC 2nd Ops TCU3, Bridle Road Bootle Liverpool L30 4GB What happens if i've been sending things to the wrong address? What do i do?

  12. I checked online today and my LBA was recieved this morning. I'm not worrying about my prelim as i have the original reciept/proof of sending so really it doesn't matter whether it got there or not. So they now have 2 weeks till i have to issue my MCOL, but i'm not expecting anything from them at all in the mean time. I have seen a post on this site, stating that someone sent another letter prior to issuing their MCOL, giving the bank a little more time, but that person recieved their money without even having to issue a court claim. It looked like this: Dear Sirs, I am sad to learn that you are still refusing to refund the unfair and illegal bank charges that have been placed on my account over the last six years. Does anyone think this is worth sending? I think it's a good ides, but i'm not sure about giving them another 14 days to respond as i would like my money asap! Any thoughts?
  13. Just as a prcautionary measure i thought i'd check out whether my prelim letter definitely was recieved/delivered. It turns out that Royal Mail have lost my letter!!! Can't believe it!!! I've just sent my LBA by Special Delivery this afternoon, and my pre lim letter never got there. Does this mean thatr the bank are going to think i'm an idiot for sending the LBA before even sending the Prelim??? What do i do now???? HELP!!!!!!!!!!
  14. I'm not pretending to be an expert on this, but not hearing from A&L seems to be a common occurence so i wouldn't worry too much about it. I would suggest to wait until tomorow and try hitting the judgement button again, if it still doesn't work then call/email MCOL to see what's going on. Chin up chicken, 1 more day won't hurt and just think, with each day that passes, your money is getting closer. :) :) :) Givvynarna. x
  15. I know, I'm such a blonde at times. If this was the only thing i had to concentrate on in life i would do it perfectly. However, other things just seem to be getting in the way and my claim just seems to disappear right out of me head! Nevermind, i'm off to the post office in my lunch hour today to send it.
