  5. Thanks for your reply. After I sent the letter I got a letter from the solicitors saying they had been instructed not to take any further action and that my file was closed, which I took to be of a result of my letter asking for it to be written off. But yes it did not specifically say it was written off. It is for £811.

Hello everyone, hoping someone can help with this I rent a top floor flat and back in january I notified my landlord that there was some leaking from the roof near the bay window on to the wall to which she said she would notify the factors. About a month ago we had 5 days notice that repairs would need done to the roof joists to correct rotted beams. We were told by the company that it would take 5 days maximum but on the 4th day one of the builders said that the rot was deeper than they thought and that they needed a couple of days to discuss it with their bosses. They didn't return for 10 days, leaving the living room a pile of rubble, thick with balck soot/dust and the kitchen which is part of the living room completely out of bounds as all out furniture was in it/blocking it. It cost us a fortune in takeaways We were struggling to breathe/wheezing all the time esp in bed at night aswell perhaps cos of all the dust? We both still have horrendous coughs. After 10 days they jsut turned up one morning as if nothing had happened and took a further 3 days. So all in all we had no use of the living room or kitchen for 17 days. We pay £500pm for rent and our parents and neighbours have mentioned that we could get some money back as we didn't have full use of the flat? Anyone know if that is true? I am a bit wary about asking, don't want to damage our relationship with the landlord as we understand the work did need doing...perhaps she should have known about it before we moved in last year through surveys or something though? Any help would be great
  7. Hi everyone, I am just looking for a bit of advice. I have debt from an old overdraft that the bank tried to force me to pay when they closed my account because I reclaimed charges back from them. I am not in the position to pay this and told them this but they passed it on to debt collectors and a solicitors. I used nationaldebtline to write them a budget sheet showing I have no money left over and a letter asking them to write it off. I recieved a letter from the solicitors saying that nationwide had intructed them to take no further action. This was about 3 months ago. Today I recieved a letter from a different debt collection company chasing the same debt ..... They let me believe that they had written it off ! What should I do? Keep sending letters?
  8. Hello! Back in november I recieved £1100 back in charges from Nationwide which left my O/D at £-700. They promptly closed my account and told me Lending Control would be in touch....they never did get in touch. Whilst my case was going on, prior to winning, Moorcroft were appointed to recover the full amount of the O/D- £1800 They mentioned "their client" in the letters so I assume they were acting on behalf of Natiowide. Recently I recieved a final demand before we take you to court letter from Moorcroft - claiming i owe them the amount BEFORE the charges were deducted. I know this because it is the exact same figure down to the penny. What do I do in this situation? Phone Moorcroft and advise them the amount is incorrect or phone Nationwide as in effect I actually haven't recieved my charges back?! Any help would be appreciated
  9. Hi all, I have a credit card debt for capital one for £590.67 that was passed on to capquest/HL legal. So far I have made no contact with them on the phone but have drafted a letter of settlement I was about to send to them after I have divvied up the money I have available between them and my other creditors natiowide. I was going to offer £232. Today I recieved a letter offering a "one time only offer" of £310.10. I don't want to pay more than £250 as this would stretch my budget for my other debt. None of this is my own money - I am using the remains of my o/d to pay them off. It says this offer is conditional on me contacting them by the 15th to discuss payment meyhod and date ...I am also worried about paying them then them asking for the rest... What shoudl I do? Phone them and offer a lower amount and pursuade them by saying I can pay that day? Help me please! ETA - I can't really pay them off monthly as my income is only £500 student nurse bursary (which I use all of) and I just left my part time job as i couldnt work a total of 50hours a week between that and my trainng anymore!

  11. I have recieved a full refund from nationwide after submitting a summary cause claim. Does anyone know what form it is from the scotcourts website that I send to the court to dismiss the claim?
  12. Woohoo after putting it off for too long (for reasons I cant even remember) I toddled down to glasgow sheriff court and issued a Summary Cause against nationwide. I got the forms back and sent them to a sheriff officer witha cheque for £15. 2 days ago recieved a letter from nationwide dated 21st November confirming they paid me the full amount of £920 charges, £86.04 in pending charges, £39.00 for expenses and £67.44 to cover lost interest!!! Wooooooohoooo!!!!! That was 2 days before I got the letter from the sheriff officer saying summons were served by next day signed for on the 17th!! Which basically means antionwide paid out as soon as they recieved it! Sooo chuffed but cant get on my account through internet banking as they removed it so will need to phoen and check the balance so i can pay them the restr of the now substantially smaller overdraft. To everyone thinking of claiming - go for it! Don't put it off like i did!
  13. Hello this is my first post in the DCA forum so be gentle! In the last year and a half I got into some debt trouble because of depression/gambling addiction out of control and bank/cc company throwing money at me even though it was blantent the number of gambling usage on my accounts (you can tell I am bitter!!). I stuck my head in the sand unfortunatley and being a student moved out my parents address not telling CapitalOne into a new flat then from there to a new flat without telling Nationwide. 2 weeks ago CapitalOne sent a default letter to my parents address and i paid the 200 plus an extra 50 to stop it going through which brought the balance down to 590 - below the 600 limit. Now my mum tells me that a big red letter came saying I owe 590 within a week or the house will be blacklisted etc etc!! I got a message left on my moblie today from a woman claiming to be from The Telegraph Office. I googled a bit and found it to be CapQuest a DCA. I could prob pay this and I am currently fighting Nationwide (who probably have a DCA on my case too...) to get over 1000 of charges back. My income is 750 - 500 student bursary and 250 part time job. All outgoings apart from debt and going out/clothes etc is about 500 a month. So I could afford some payment. However I've read posts and sites about full and final offers and negotiating - obviously I would like to pay as little as possible if possible! Any advice? Am also a bit scared about dealing with these people - I am a 5ft1 20 year old female and aren't exactly assertive. It also makes it difficult that to communicate by post I'd really have to tell them my current address... Any help would be appreciated. Recieved another letter a few days ago - to my current address!! Poses as a TELEGRAM..and asks me to phone for a buniness message. Pretty sure it is Crapquest. After reading grumbletext about them I am still unsure what method to take with them. Should I phone? Should I send them a prove it letter? Do I actually HAVE to pay these cowboys anything? Should I open back up negotiations with Capital One? If I did that how do I get Capquest off my back? Arghh its so confusing
