    i'm looking for the same answers.. email or letter?? I am in the process of a bank claim against hbos but thought i might as well do my egg card? So where to start, is it much different from a bank account claim???
  2. Thanks for the advice.... This is torture counting down the days till the 17th! I have a plan.. If it comes back that they're going to pay out or if i win by default.. whichever im going to pick up the phone to them and say i intend to file another 3 small claims (all at the max limit) it would save hbos time & money if they paid upnow..... and prey they do otherwise with the back log at the court it could take me the rest of this year to see the other 3 through (though i certainly would)

  5. Im currently going through Edinburgh Sheriff court too against BOS. If you fill out your forms and head up there the sheriff clerk will read over them and check for any mistakes etc.. Mine was okay'd but sent back to me a few days later as another sheriff clerk who was checking it found a mistake.. i was annoyed at the delay but its reassuring to know that any mistakes you make are sure to be picked up by the court... so dont panic. I kept putting off filing my case as i was 'scared' i would mess it up and get into deeper water.... worst mistake ever... once you get started its easier than you think and the sheriff's clerks etc... are on your side! p.s how much did nationwide charge you for your statements? and did you have any problems? my partner is trying to get his statements and they want to charge him £5 per statement coming to £190!!
  6. Hi i have my own seperate case with BOS but was looking here for info for my partner who is with nationwide. He phoned them yesterday asking for statements and they fobbed him off with ... oh theres a problem we cant verify your address... so he said .. eh wait a minuite ive been here for 4 years receiving my statements no problem. Nevertheless they asked him to come into branch to 'verify' his address after me saying they were 'at it'. So today he came back saying the nationwide woman said they would charge him £5 PER STATEMENT coming to a total of £190! He protested that surely it doesnt cost that much to print off a few statements... but they were adament. So i was on here rooting around to see if anyone else had such problems? I think they are taking the p**S myself.
  7. I phoned BOS telephone banking and received mine fairly quickly. They did come in about 3 packets and some were actual statements and some were what looked like old ones where you could see the changeover to halifax. They did all come within a week though. My partner phoned Nationwide today asking for his statements and was fed some garbage about he had to go into his branch as they didnt know his address... he was like, ive been here for 4 years and have been receiving statements etc.. your talking rubbish... to which the call handler said well you have to go into your branch to clear it up and do this that and the next thing. Total CRAP! Mt theory is they are trying to make every stage of this process as difficult as possible for the pursuer in order to try and put them off. Well it wont... so off he is going to nationwide tomorrow! Idiots!
  8. JUst a quick update.. Received all my forms back from Edinburgh SC stating there were a few things they wanted me to change. I knew it... the clerk who received it hadn't advised me correctly and missed some mistakes. So i was to correct it and send it back to them. I did and went back in the same day with it... i was then told i was looking at a return and hearing date two weeks after the one originally assigned to me as they had given it to someone else while mine was corrected. REALLY ANNOYED! Nevertheless im glad they flagged it up to me before the bank received it! Phoned them today and looks like it was served this morning. The clerk did say to me the last lot of bank claims he's seen go through Edinburgh... the banks have been ignoring them completely and therefore the pursuer wins by default. This is all very well but im still left in limbo till what looks like a return date of May! Hopefully with all the press attention today on bank charges the banks will back down a bit and pay up sooner to save them any extra expenses?? Anyway anyone else gone through Edinburgh SC recently and had a good outcome??
  9. Congrats!! Great news for you. I think the fact there has been a lot in the news today about bank charges has given the banks a kick up the backside! my first small claims has been served on HBOS today... i have roughly £2500 and was only offered £600 which i rejected... but i was told to shove it by the bank...or words to that effect! So i have filed with the sheriff court. Im hoping that the bank think im serious and offer me the lot after the first case... fingers crossed! Anyway looks like you got them told! Good for you!
  10. Ok i'd hate to think it would be turned over for a minor mistake. I had no clue on all the legalities involved with filing a summons untill recently and its all been learned from sites like this. I'm really grateful for all the advice on here... as i'd never have managed without it! Good luck with your case... fingers crossed!
  11. If Shetland's officers dont seem to have a scooby, what about filing in Edinburgh or something. I'm sure you could email them your forms and mail them a cheque. If worst omes to worst and you have to turn up to court..Edinburgh is not a million miles away from Shetland. I filed with Edinburgh today and they were really good.. seemed really clued up on all the bank charges stuff??
  12. I finally got my act together and filed the 1st of 4 small claims summons against the Bank of Scotland today. I followed procedure through correspondance with the bank resulting in a partial offer of £608 which i refused. They then wrote back to me saying £608 was their final offer and i was to take it up with the Financial Ombudsman.. blah blah.. seems like Bos's usual reply having read most of the posts on here. So today i used 'vampiress' spreadsheet (Scotland) and calculated the grand total which including interest etc.. just stops short of £3000! Man how thats slipped through my fingers over the years...i was astounded! Using 'Scotia's' template i completed my small claims form ( im splitting it into 4 claims) and headed up to Edinburgh Sheriff court. The young guy on the desk seemed familiar with bank charges claims but sought advice from another colleague to double check my handywork (reassuringly). I asked him if they get a lot of people claiming bank charges to which he replied... well your hearing date wont be till April time so work it out for yourself... charming:rolleyes: Anyway... ive to wait a couple of days for confirmation in the post which will have my return date on it. Fingers crossed it'll be a smooth ride from now... but who knows. Just thought id post it on here in case anyone else in Edinburgh is claiming and wants to see how i'm getting on so ill keep it updated... p.s... i put the branch i opened the account with (Dunfermline) on the claim form and have since read in other threads your supposed to put the mound address.... will this affect my claim adversely... Any advice?????
  13. Out of interest Texel what court was this?? I filed with Edinburgh Sheriff court today... im hoping for a smooth ride but im certainly prepared to turn up for my day in court if needs be. The judge sounds like he has no time for 'charge claimers'.... typical.... on his salary its unlikely he'd be in our shoes though! Good luck keep us posted!
  14. im not sure what im going to decide as to the best way to proceed with this. Tomorrow is the banks deadline for getting back to me so ill see if theres any correspondance from them first??
