  1. i have a secured loan with welcome finance:( and pre xmas i was 2months behind. the repayments are only small now that they have removed the ppl (which is another story) and therefore i have been making small but regular payments to get arrears down. my first complaint was that my "account manager" had an over familiar manner with dealing with my account texting my mobile with reminders of payment and popping to my address to collect the money if i didnt answer his call?? as xmas was upon us i advised welcome that i wouldnt be making any more payments till mid jan when my husbands work started again. as there is no direct debit in place ( i make debit card payments each friday) and arrears down to 400 i was confident that by feb all straight. on new years eve my debit card had £148 taken from it by POS by my "account manager" who said it was in my best interest to keep me up to date??? he had used old debit card information to do this. i went skits and insisted he had nothing further to do with my account , made a complaint and they refunded my money. i now have a new account manager who is using his own tactics. he said the £400 arrears are to be settled by end of this month which is relatively ok by me but he wanted initially £195 today 16/01/09 which i cannot do. he popped round to my address? said he should charge me £25 for his unannounced arrival but said will let me off he asked for £150, and said he can make the £400 arrears go down to £350 if i complied and he would refund my bank charges (£80) i said i would have to see what money i had on fri but stressed to him i thought it was very unlikely. since then he has rang from his mobile to mine 11 times since weds afternoon. this morning i told him i cannot meet his target although i could make a payment and will have arrears settled by Feb as agreed. he then accussed me of making promises i cannot keep, asked me to get a sub off husbands boss!! when i finally lost it on the phone he said he is now charging me £25 for his visit, arrears back upto £400 and will not be refunding my charges back. what the hell is all that about and where do i go to get all this stopped? i have told him not to call again and to put all communication either in an email or letter. i will make my payments to a different department.
  2. thanks guys. i think may look at the charging order. im sure its aroung 8% a year interest which i guess is a better rate than what i would get a loan for good credit is just not gonna happen for me! will probably sell or remortgage in a few years so it would keep the hounds a bay. thanks again sue
  3. thankyou for your reply. have sent a i/e they said havent recieved one although only sent it 7 days ago and they give you a 2nd class post envelope which can now take upto 2 weeks to get sent anywhere! so sent a 2nd one. i have 5 children ageing 8months to 9 years & recieve working families tax credit. it shows on my means statement i do not live in the lap of luxury they think i do. i have continued to pay 40/mnth they have said that this basically isnt enough ? they have enquired as to where the money went in the divorce/ me buying the house. my ex recieved a pay out of 11k and it cost me £4k to defend his actions. leaving me with the house title in my name and a co-owner whom without his help couldnt of bought in the first place. i do recieve a relief of £120/ annum on my council tax. basically 1 month free i suppose. as the house is a co ownership situation will that give me more or less benefit? finally there isnt any equity in this property although from reading other posts it doesnt seem to make that much difference. i could at a great push raise the £3k needed but then putting myself at further risk . Any further comments appreciated. thanks
  4. hi guys yet again i find myself dealing with this situation. i am having trouble finding the correct place to put this so if its not here please excuse me. Council tax are trying out their scare tactics with banckrupcy. i have heard of a few that are going through and i am wanting to know more info on how i can get this debt over a long term period. ive been in court when ex husband tried to repo the house and i won much to abbey's disgust but how does the land lie with council tax? i admit i have not had a pot to .... in since divorce and i do keep overlooking this bill when i do my budgets. i can arrange a payment plan but nothing like what they require. welcome any advice or links to info. Ty.

  6. Hi guys! Fab idea i already feel more confident in taking this on. Ive successfully done my personal account and now its the business:grin: . Great to see im not in this on my own this is a case of many heads being better than one. i,ll keep you posted, claiming on a ltd company account against RBOS.
  7. I successfully got my money back off scabby abbey last year:) and i am now helping my mum and dad get some of their hard earned cash back. Mum and Dad have been self employed all their life now retired cash is as abundant and looking at their spending over the years and account management i figure they are owed a pretty penny. Mum and Dad cant do this on their own as its just too confusing for them so i wanting to know if they can legally appointment me to act on their behalf???? I know getting the ball rolling can be done without this but when it comes to actually chasing things up on the phone does it have to be one of them? and if a court date was to be sat in the future can i attend and speak for them ? All advice welcome!

Have just got their defence through in todays post and your quite right they have offered a final settle ment of 50%. if you dont mind can you help me out responding to this. this is how its gone... initial claim £1545 that total was sent when i first started all this with my LBA. Abbey then paid me £710 GOGW I incurred more charges filed N1 for £1075 this amount in my schedule reflected the GOGW already recieved and the additional charges leaving my claim at £1075 Abbey have offered me £535.00 . 50% of £1075.00. I spoke to them and they have said that this amount is aside from the £710. I need help in writing a letter to confirm that if i settle with this figure that i will actually recieve that amount. I have not had to pay legal fees due to my circumstances, and although if i sat this out i would probably recieve all monies, timing is bad at the moment... xmas...baby due 2 weeks.....3 children already... to have got back over 75% is a good result for me. Donation will be sent as would of had zilch without this site.....

  13. hmm.. its now apparent to me that there are lots of defence cases now going on. mine included. its good to know its not just me tho. id also like to hear about the time periods from abbeys acknowledgement to when you have actually recieved your defence ( should it be within the 14 days given?). Also there seems to be a trend with regards to 2nd offers being made at that point when you recieve their defence... how many have recieved these 2nd offers when you got your defence? cheers
  14. thanks Lula, I wrote to the court last week and followed up with a phone call all is recieved. Ive also read what Bookworm has put up which is MEGA info i really do hope it doesnt get to that but if it does i will go well prepared! I guess doing it on your own is a bit daunting and Abbey are counting on the fact that you may buckle under the pressure...its tempting but ...nah.. not this time. cheers again
  15. Abbey lodged an acknowledgement that they are preparing a defence and the deadline for that is the 14th of this month. My claim was for just over £1600 of which i have already recieved a GOGW for £710 and the outstanding amount is now what i am persuing. As i have never done this before im not too sure as to what happens after the 14th? The last letter i had stated they were not going to give me any more money but that was before they recieved my N1. Can someone please reply if this has been the same for you. Are they likely to go to court? How long before a date set for that? Many thanks
