  1. The bank's 'bundle' did not arrive by the 4pm deadline on Friday, but by normal post saturday morning. Is this normal - can I do anything about this?
  2. Hi all, well tomorrow is the final day for the delivery of my court bundle (will arrive in the morning by guaranteed signed delivery) am I right in assuming that the bank also have to provide me with a 'bundle' showing their defence? Any help appreciated as always
  3. A question for any of you experts out there; I would like to include in my court bundle the ruling that PPI can not be sold as 'obligatory' with a loan or credit card and that APR can not be charged on top of it. - Any ideas on where I can find this? Thanks as always:D
  4. thanks, I will include copies of emails sent and my statement. to be honest I didn't feel I would get a court date, but I wrote an accompanying statement explaining what happened and hey presto off to court we go! Will keep you informed.

  6. Hi there, sorry to hijack, but my bank are doing the exact same thing. They continually send me copies that you can not read and that do not detail the amount of PPI. I have a complaint pending with the Financial Ombudsman, so I'll let you know what he says. Good luck
  7. Thanks I have read through the bits on the 'court bundle' and I need to send it by 20th July, so I am working on it now. Have had a little luck as well, they have sent me all of my account notes and it clearly states on an email sent by them that although I could apply online, I would still have to call them (this is when you are 'forced' to take their insurance) so fingers crossed Will keep you posted.
  8. Hello there, well the Judge has given me a court date in September and I have to prepare my bundle. What happens next?
  9. Thank you. I am thinking about bankruptcy. What happens though? I have read so many conflicting stories, some say the judge will order payments for three years, others say you will be discharged after a year, what exactly can I expect and what is the first step? Also as I made an arrangement with the banks a few years ago and they continued to charge me interest so in the end I have made loads of payments but the debt has not reduced, will the judge take that into account? Any advice appreciated

  12. Hi, I have a pretty complex situation here. I have 16000 odd debt with my bank and 20000 odd with a credit card. I work in the UK, but live abroad. I am considering filing for bankruptcy. Here are a few questions I would like answered if anyone can help. 1. If I were to declare bankrupt and move abroad, when I finally manage to get straight and buy a property there could they come for any assets I have? I would be moving within the EU. 2. When/if I file for BAnkruptcy, do I have to provide proof of what I pay for rent/food/bills etc,.? As none of these things are in my name (for obvious reasons). 3. I am taking the bank to court to mis-sold PPI and have lodged a complaint with the FO about the credit company (basically they gave me a consolidation loan and should have closed my credit card but instead sent me personal reserve cheques a few months later, leaving the credit limit as it was before, they have since apologiesed for this - fat lot of good that is now) - should I wait for the outcome first as it could drastically reduce my debt or go ahead now? Any advice appreciated

  14. Thanks for the advice. Wow! I can't believe it takes that long. They have also stated in their AQ that they want the case thrown out - any ideas if the judge rules on that fairly quickly? Ta again

  17. Hi, well a quick update and a few questions. I have just completed my Allocation Questionairre. The bank is denying all knowledge of mis-selling my PPI as the application was made over the internet. What actually happens though, is they ask if you wish to continue without insurance, I stopped the application and phoned to ask if it would make a difference not taking the insurance as I already had my own private policy, they told me that due to my financial circumstances (bad:eek: ) they strongly advised me taking the insurance to ensure my application was accepted. As they had already told me this when I took out my loan with them, I felt I had no choice. Anyway, will wait and see what happens. Would like to know the following though, if anyone has any idea. a) I have sent them a Data Protec. letter twice trying to get a breakdown of my loans and how much the PPI was. They sent me illegible copies and are refusing to send anything else - what can I do? b) If I lose in court do I have to pay their costs? Any advice appreciated.
  18. :o That is shocking behaviour, they have had it good for so many years now. I will be claiming back over 7000 from one company and the other one does not even have the courage to tell me how much PPI I have paid them! Will keep an eye on your thread - keep us posted and good luck

  21. I have logged one of my claims today and will keep you posted. With regards to the other one I have a quick question. I will be claiming back two amounts, one for PPI forced on my loan and the other PPI forced on my credit card. Here is my dilema though, the loan PPI totals 2963.59 + 8.906%APR which equals 263.93, now do I times that by the amount of years that I had the loan? Many thanks for any help
