  1. Been concentrating on some other matters lately, so have let this one slide down the list of priorities. So, to update: Sent LBA and received no response. Am preparing to fill in court forms but have a couple of similar cases where the charges are with finance companies/service providers who haven't responded. I'm going to try to get them filled in over the weekend, but am thinking of sending them copies of my filled in court forms & telling them they will be filed in 14 days if they don't respond favourably. Most of these claims are for smaller amounts that wouldn't justify their costs if I took them to court. Obviously it'd be great to get a judgement against them in court, but I think they'd be unlikely to let it get there anyway. Has anyone else done this?

  3. LBA expired 6/11 but according to Royal Mail website hadn't been received. Checked over the phone & found it was delivered on 25/11 & royal mail sent me proof of delivery + signature. So their time's up. Just wondering about whether to take them to court or not...
  4. Hi, Has anyone got a template or a letter requesting a breakdown of the charges. As you can see, I've been sent the usual fob off letter. There is one charge I'm not sure of being able to reclaim as it was for a home visit they charged £50 for despite also sending 2 letters (totalling £35.50) just before & on the same day as the visit. I know they'll be able to 'explain' this away with travel costs etc, but I would hope to be able to dispute the necessity of it. Not sure DSAR would be necessary as I've had statements of charges from CMF so am aware of what's been charged where. Just thinking of trying to get them to do the impossible and explain why they charge so much. However, if not this one, I will be seeking to claim back the other charges - £10 for a phone call!!! Preparing to send LBA when 14 days are up. Can anyone tell me if it's 14 days or 14 working days?

  6. Hi, was charged £82.24. Looks like subscription charge. Still nothing by email though & don't know if he's been charged the £50 but would guess not as they've said nothing. Many thanks for your help
  7. Just been reading through Fasthosts terms & conditions and found this: Fees charged on a prepay basis are non-refundable. Once the initial trial period has expired customers are not entitled to receive a refund unless the service is cancelled by Fasthosts. In addition some accounts incur set-up fees, these charges are also non-refundable. Any customer withdrawing payments via bank or credit card (a "chargeback") may be subject to a punitive fee of £50, should the company deem this chargeback to be unfair. The company also reserves its right to defend such chargebacks and recover the original monies from the card issuer. As far as I know, there hasn't been a £50 charge on the account unless the account stands in debit. However, we haven't received any notification of this and when my partner telephoned, they did not ask for it to be paid. So assume it does not apply. However, the service was cancelled by fasthosts when the payment was withdrawn & before it was 'recovered' by fasthosts. Does anyone know if this will affect my right for a refund? Would it be deemed as unlawful to withdraw the service but still take the money even though fasthosts says it can recover the money in the T&Cs? Also not sure if I should follow the escalation procedure given by fasthosts before I send LBA or should I just go ahead? Had no explanation from fasthosts, so not exactly sure what I'm dealing with although on the face of it I think I have a right to the refund as services were not provided. Just not sure of the legal stuff...

I would draw your attention to the terms of the contract which you agreed to at the time that I opened my account. It is an implied term of that contract that you would conduct yourselves lawfully and in a manner which complies with UK law. I am frankly shocked that you have operated my account in this way as I had always reposed confidence in your integrity and expertise as my web host. I require repayment in full of this money. If you do not comply fully within 14 days then I shall begin a claim against you for the full amount plus my costs and without further notice. Yours faithfully, XXXXXXXX enc. My partner paid off Close Motor Finance when he sold his bike this year & while I was looking at reclaiming bank charges, we realised he'd been charged a total of £176 for Default letters etc when the bank had returned the S/Os. Do not want to send off S.A.R - (Subject Access Request) as haven't got the spare cash at the mo, but have a Transaction History sent out by Close Motor Finance on 27th Feb 06 which shows the charges etc. I know all the payments after that were made on time until it the bike was sold, so am going ahead with Prelim letter adapted from that for banks. Am including spreadsheet & charging interest at the rate of the agreement until close of the account.

  11. I hope someone can help with this... 2 years ago, my partner susbcribed to a website provider Fasthosts to enable him to set up his own website. He paid from our joint account for a year's subsription. Last year, a payment I didn't recognise went out of our account which I queried with the bank. The bank paid the refund back into our account while it was being investigated. When we received a copy of the agreement stating it was a yearly payment (an agreement my partner had lost), I took it no further as he'd obviously agreed to it & the payment went out again. We did not use the web account as during the first year, his situation had changed & he no longer had his business. When he rang to cancel the account for the third year (a few weeks ago), he was told the account had been closed since September last year (when I queried the payment). He then wrote to Fasthosts to request a refund for the money that was paid last year for a year's subscription we didn't receive. They didn't respond to his first or second letters & I finally sent a copy by recorded delivery to make sure they received it. They did and still haven't replied although he stated he would 'appreciate a response within 7 days' Any advice on our next course of action?
  12. Hi, I hope someone out there can help me as I'm faced with a stack of statements, charges and changing interest rates. I've been trying to work out the contractual interest due to me as well as the interest on top using vampiresses spreadsheets on google but have come unstuck somewhere. At several points I've managed to get myself out of my overdraft either by paying in lump sums or taking out loans to consolidate. On top of this, my bank also changed it's interest rate a couple of times. I know it went down from 18.3% to 14.9%, but now I've been told by the bank on enquiring, that it's currently at 15.9% & I don't know when it changed again. Firstly, can I still claim contractual interest on bank charges and interest on interest on charges even though I've managed to get into the black again a few times? Secondly, how do I calculate for the changing interest rate? Can I calculate from my bank statements when the interest rate went back up to 15.9% from 14.9% & if so, how? Would I then need to work out an average interest rate for the last 6 years? Thirdly, as I paid off my overdraft more than once by consolidating to a loan (finally at the bank's insistence to a managed loan), can I charge the interest on the portion of the loan taken up by charges levied against me to that point & do I have to as it is at a lower rate than the overdraft? Finally, can I do all this in google spreadsheets as I do not have excel? Many thanks in advance for any help I receive. I started off clear headed, but got a brain block when I started thinking about it. Although I'm experienced in basic maths, when it comes to spreadsheets and formulas, I'm lost...
  13. I'm new to the forum, but was directed to it by a friend who said I could get back all the charges my bank has levied against me. I was just wondering if the same goes for finance companies and store cards? & would I still be able to claim against agreements I've paid off? Many thanks in advance for any help or advice you can give
