  3. Yes,its great to get our money back! I got knocked back at the last day at each stage,so these letters Nat sends to you ARE NOT PERSONAL..take them with a pinch of salt!! Keep to scheduals Don´t talk to ANYONE..just letters to respond!! If we can do it..so can you!! 2,730.00 back in my account when the cheque clears
  4. Just to update,I´m living in spain looking for work here. I recieved a 50% settlement offer from Cobbitts,this i turned down,saying i would accept this only as part payment to a full settlement. On monday I received a cheque for all my claim plus court fees and 8% interest. Thank you everyone on here for your support,Lynne,Rob and all the Moderators I GOT PAID (Cheque to clear in 10 days)(will make donation asap) Keep at it..you´ll get paid too!!!
  5. Hi mate,I had their AQ on the last day too!they love dragging things out..this is to make others think twice before they make a claim...dont know what happens next? I guess a court date!!
  6. Hi Lynne,Ive been looking for work in spain,logged on at a friends house now.. Cobbetts very quiet but now have a local court in cumbria to take my claim.Cobbetts are DEFENDING...LETS SEE IF THEY ARE ..? maybe they will have a breakdown of their charges to show the court! keep going!!
  7. Hello all,Ive now received a local court to continue my fight,Cobbitts have said they will DEFEND this case...ok..bring it in !!!!!!!!!!!!!!!! hope they can reply on how their charges are made up!!!

Ive just sent an email to northampton cc,to say Ive not had my AQ form but Ive replied directly to cobbitts... ...still waiting for something from them..they have paid out a couple of people 7 days behind me,Rob,Lynne etc...no idea why??...I have to be out of my house by friday,so im stuck!! ...seems like Nat west are in control now!!!!cant we push them along?? although...they are/will be paying interest on £2700 at 8% if i win my claim. I wondered if we could charge a more realistic (bank speak) charge in interest like 29.99% and a late fee(naturally)

Here is the reply from cobbitts,this seems to be another standard reply.Asking for account details(they are written TWICE on the letter) and wanting details of each charge(but thanks me for the schedule of charges??) ..anyhow..It is for the court to decide whether to ask me for further infomation not Cobbetts. ----------------------------------------------------------------------------- We refer to your letter dated 6th July and thank you for your schedule of charges(the letter i sent regarding the CPR part 18 request detailed in message 8 ) We note yout comments on out request for further information. Please note that part 27.2(1)(f) applies subject to paragraph 3 of part 27.2, which states that the court of its own initiative may orser a party to provide further information if it considers it appropriate to do so. It is our client's contention that your particulars of claim do not properly particularise your claim. for example, our client cannot properly defend a claim where you have not given your account details and the details of each charge you claim is disproportionate and unreasonable. The court is bound by an overriding objective to deal with cases justly and ensure that parties are on an equal footing. it is clearly the case that our client cannot respond to your claim where you have not provided sufficient particulars. Our client objects to you allegation the the request is intimidating. Accordingly, on allocation of this matter, we will be suggesting that the case management directions cannot be proposed until you serve a full and detailed reply to out request.

Hi Rob,Ive had word for word same letter this afternoon...from cobbitts oh..it says thank you for your schedule of charges...the only difference! it says..i have not given account details..actually ive given them TWICE on my letter...so..looks like another standard **** off from them!!(sounds like ronnie cobbitt and its p off from me as well ) [MODERATED: Mind your language please]
  14. Im still waiting for the AQ form,although i wrote the letter above to cobbetts it says i must reply to it by 11th july.Do i need to tell Northampton cc ive not received it yet?Time seems to be running out!

  21. HI mate,dont worry,I couldnt download excel to my computer either..pulled my hair out in frustration..now i'm in the last days of my claim and giving advice myself:) this is what i did!!!!!! There is an online interest calculator on here,dead easy to use..no downloads etc when you log on..under the banner "make a donation"...a calculator at 8% instead of clicking on "foram" go past homepage..to the right of the screen down...down... about 7 circles.... like this 0 you'll see Online interest calculator this is how i did all my sums:) hope this helps Tim

Additionally it has now been confirmed that these particularly high level of penalties are considered to be unfair by the OFT whose report that has been in preparation for nearly two years and concluded on the 5th April 2006.In the report the OFT criticised the unfair current level of bank charges under the Unfair Terms in the Consumer Contracts Regulations 1999. and therefore presumed to be unlawful in the absence of specific proof to the contrary. signed xxxx

  25. Couldn't say but if the email gets lost? it may knock out all your timescales/deadlines etc? IMHO I'd let things run as they are.
