  1. having said that do I need to send the LBA letter or can I just go staight into the N1 claim form? other websites go directly from initial refund request letter to court.

  3. Hi all, On 31st May 2007 I sent a letter through to Lloyds TSB to request my bank charges back in full. Today I have received their response which states that default charge guidelines only apply to default charges that people pay when they break an agreement with them, and that this doesnt apply in my case as the charges on my account were for dealing with my request to go over my agreed overdraft limit and are therefore not default charges because I havent broken an agreement. they later state that the charges are merely prices for the service that they provide in these situations. Does this mean that I am unable to claim back the money I beleived I was entitled too? Your help would be greatfully appreciated. Regards
  4. Hi all, I am just about to resend my letter before action as I have delayed putting in my court claim due to insufficient finances. Should I just start the court claim or should I carry on as I am? Cheers

  6. Hi all, Have been strapped for cash the past few weeks and have therefore been unable to start my court claim against Lloyds TSB, is there a timescale to which I must adhere in relation to starting this claim?

  10. Hi all, I am new to the site and would like to keep you informed of my progress to date... Sent off 'Request for Payment of Charges' letter. Received letter to confirm that they had received the above on 7th October 2006 giving them 2 weeks to respond. Received a standard response letter as posted by various forum users on 11th October stating that Lloyds TSB were sorry to hear that I was unhappy with my account charges and that like any business they do have to charge for some extra services etc etc. The crucks of this being that they believed that these charges are fair and that they disagreed with the OFT thinking on default charges. This letter was stated as being the banks final response on the matter and if I remain disatisfied that I could refer my complaint to the Financial Ombudsman Service. On 24th October 2006 I sent my 'Letter Before Action' stating that I was unhappy with the automated response I had received and requested again the reimbursement of the charges obtained by them. I await their response.......!!!
  11. Hi I have just wrote to Its4Me to reclaim £75 worth of direct debit default charges. Within 4 days I received a response informing me of the following: I would firstly like to state that all our charges are lawful under statute and they reflect the costs incurred by the finance company (who process the loan on our behalf) in order for them to be able to get the direct debit mandate reinstated after a default. The OFT report on 5/4/06 mentioned in your letter was in relation to the costs levied by credit card companies for late payment and did not concern direct debit defaulted payments. All our procedures and fees have been approved by the FSA (who acts as our governing body) and they were outlined to you when you sent the pre contract information at the inception of the policy. The £25 reinstatement fee was also only applied on three occasions because when you paid the the remainder of the policy in full on 29.09.06 we did not require this additional amount as there was no need for the direct debit to be reinstated. I would like to thank you for your continuing business and I hope that you will remain a customer as you will find that the fees that we levy are standard throughout the industry..... Does anybody know what my next move should be with regards to this letter? Thanx
