  1. thanks sea side for the reply. unfortunately I cant claim hardship, just lack of organisation and poor self discipline. having read some other posts i am concerned about the imminent decision early 2009, and the backlog of claims that will be prioritised - would it not be in my interests to continue my stalled prelim claim now, as this dated back to march ? thanks
  2. hi I successfully claimed last year for £2000 against halifax for overdraft and unpaid items. since i have incurred a further £900 or so and as i havent kept up to date with the banking situation i have a few questions: 1. does the lloyds/halifax merger/government intervention change the process of claiming back fees ? 2. i sent a prelim for half the 900 back in march and didnt follow up at the time... can i just go straight to LBA now and ask for the additional money that has been added ? do i need a bespoke LBA for this ? 3. anything else that might have changed since i claimed march 2007 ? many thanks in advance Ozymandiaz
  3. Hi I succesfully claimed for my current account 2 years ago. since then i have incurred some charges and submitted another prelim in Jan 2008. I received a standard response and didn't follow up. I have now received some more charges. so, can i add these to my letter before action ? is it just a matter of updating the spreadsheet ? also, have things changed since the recent rulings and should I change the procedure i used two years ago - LBA, Court claim,etc ? thanks, any response appreciated Ozy

Im getting a bit impatient, and trying to predict when I may be able to get my new motorbike the bank have till the 21st [this friday] to submit a defence to my claim for £1900, so; what is their standard response at present, do they submit a defense and then pay up after a week ? then, should I respond to an agreed settlement [full, no less] by letter before I spend the money that they will deposit ? Finally, is there any use in calling them this week to start a dialogue ?

Ive got a claim served now, which the bank must deal with before the 21/4, but I have incurred three charges recently that I did not list on the schedule I sent to the court and would now like to add... 90 pounds... When the bank gets in touch to settle nearer the final date, am I entitled to say I want these charges reimbursed on top of the amount claimed ? am I allowed to ask for more or must I amend my claim with the N244 - which may delay everything ? thanks
  6. as it happens I was emailing the MCOL people and they said they have corrected my address in the court system. No need to send the amendment form and fee thankfully which may have delayed things... The actual court claim when i download it still says the wrong address - this is what is issue to the defendant - but I am guessing Halifax cant use this against me now.
  7. So the statements finally arrived on yesterday - the 41st day - and I was a bit disappointed. For 6 years from two accounts I only found about 6 charges. [my current account halifax for the last two years ive claimed about 1900 pounds]. Yet I recall many more. in fact both accounts were closed quite suddenly 3 years ago [after 14 years with bank] because I had not addressed my overdraft. Also, I could not find any indication of staff interventions [i sent the standard SAR letter]. This was what I was interested in as I am sure the closing of accounts affected my credit score. What should these look like ? should they be seperate to the statements ? Barclays also returned my cheque with the bundle saying they did not want to charge for this service. Am I being too suspicious in thinking barclays did not send everything, and returnd the money as a distraction ?

  10. I have yet to send my schedule of charges and cover letter, I was going to do that tomorrow morning via recorded delivery
  11. I filled it out on fri evening as MCOL and the claim was issued this morning at 10am - I can see that on the website. After speaking with an adminstrator at the court by telephone today I realise that had I called before 10am the claim could have been cancelled and money refunded. As it stands it seems I may as well proceed with this claim, and just hope the error doesnt affect the bank or courts judgement of me. What do you think ?
  12. I know...I filled it out late at night in a bit of a hurry as I was going away for the weekend. I gave two addresses, as is offered, one for my main address, and another for postal correspondence with the court and payment. For the main address I put the wrong house number, 23 not 24. All other details on the claim form are correct.
  13. Please help... I have issued a claim but put the wrong address for myself. Fortunately I gave my work address correctly for correspondance, but Im concerned the bank may decide that I am not who I say I am ? Is this a problem ?? its too late to change or cancel the claim, which cost me 120 quid
