  1. Have you got to send an acceptance form back? If not accept the cheque that they are sending & then take it to FOS, that is what I am thinking of doing with mine.
  2. I'm in about the same position as you with my claim against M & S through the insurers Allianz. I have already received a cheque for £1630 which comprised of just over £1500 premiums & a flat 8% interest, but am now awaiting another cheque for the balance of the interest. I am still trying to get the 19.9% contractual interest as my complaints officer got the information on premiums paid from M & S, now claims that the premiums stated when my card was a chargecard were incorrect so that I will have been over paid???? I have now escalated my complaint to his manager & am pressing for compensation, I reckon I am due to around another £1500. I don't want to involve FOS if I have to due to the timescales involved.

I have had the same problem with Allianz who insured for M & S credit cards, they have admitted mis-selling the PPI & up to now have received two refunds for the same account as each time they have made a final decision, they have messed up on how they have calculated the refund. I am now fighting for the compound contractual interest which they are trying to wriggle out of paying by saying that they have refunded me too much from when the account was a chargecard. The figures were supplied by M & S, not by me, surely they must have to stand by the amounts stated. I have complained to the manager of the complaints officer who has dealt with my complaint at Allianz as he admitted to me that he had never done a PPI refund before. I have had to find out from the technical department at FOS all of the information on how to calculate it, get him a named contact & even give him a link to the compound interest calculater used on here. I am now seeking compensation as this case has been dragging on for over a year, if M & S had admitted liability in the first place, all of this could have been avoided.
  4. I sent my complaints officer at Allianz copies of the case notes from the PPI section of the technical notes from FOS. After having spoken to him this week, I think that the biggest thing is that they don't know how to calculate the compound interest - he admitted to me that he didn't know where to start in working it out. I am giving him until early afternoon tomorrow to email me with an answer due to the postal strikes & then I am going to escalate my complaint to his manager.
  5. M & S/Allianz Partial Victory after a year. I first wrote to M & S to reclaim my PPI at the begining of November last year & after 8 weeks received the usual Bog off letter stating that as they were not members of the GISC when I took out my card in 1998 & therefore not regulated by FSA I had no comebacks, they said that it was a non advisory sale & I had known what I was taking out. I replied stating again my points & after a further 8 weeks received another get lost letter stating that this was a final response & that no further correspondence would be entered into. On first enquiring to FOS I was told that they could not help me as M & S were not regulated at the time I took out my card, so I started to look for the insurer of the policy, trying Hamilton who were stated on the M & S Website & then Aviva who now own Hamilton but had no luck. After a couple of months I read on a consumer website that FOS were now considering complaints that they had previously rejected & resubmitted my complaint to them, the wrote back to me asking me to complain to Allianz as the insurers at the time I took out my card & to start the whole procedure again, after 7 weeks I have received a letter from Allianz admitting that I was mis-sold my PPI, refunding the premiums but only with the flat 8% interest, after speaking to FOS I have stated that I will only accept the payment as partial settlement as I require the contractual compound interest on the payments as well as the 8% per year on top. I am still awaiting an answer at whether I will receive this, I have given my complaints oficer the number for the technical deparment at FOS who will put him right on the interest refund. Still after not thinking I stood a chance at least I am on the way to getting my money back.

I found out yesterday that I had won my claim against M & S which was referred through FOS to Allianz as the insurers at the time when I took out my card, like you it is only including a flat 8% interest, but after speaking to the technical department at FOS & giving their telephone number to my compliance officer I am pushing for the contractual interest too. I have got to wait until Tuesday for my compliance officer to speak to his manager & FOS Technical Advice department. The Technical advice deparment are very helpful & will advise you on what to do. Have you received your cheque yet?
  7. Allianz Insurance PLC have just rung me after FOS wrote to them on my behalf & I have been able to email them copies of all my complaints correspondence from M & S. The person I spoke to could not believe that M & S have admitted that their staff aren't trained to sell the Financial Products. He is now going to contact M & S for their complaints file to consider his verdict & issue me with a final decision.

I was mis-sold the PPI on the basis that I have a pre existing health condition that means I can never claim for sickness cover, I am a Civil Servant with over 25 years service & if I was made redundant would be paid far more in redundancy than my debt with M & S, am paid full pay if off sick. I was never told that this insurance was optional & if I had known that the staff selling the card & insurance weren't trained I wouldn't have taken out the card. I am prepared to take it all the way but as I am the sole breadwinner for my family I can't afford to risk losing & having to pay massive costs.
  9. I am totally stuck in how I can take my complaint re my Credit Card PPI forward. I first complained to M & S in November 2008, who sent me the usual letter saying that as M & S Financial Services weren't regulated by GISC when I took out my card I had no comeback on reclaiming. I sent a further two letters & got a final decision stating that they would not enter into any further correspondence about my complaint but that I could complain to FOS. After FOS looked at my complaint they said that they were unable to deal with it as M & S weren't regulated at the time I took out my Policy but that I could complain to the Insurance Underwriters who are Allianz Cornhill which I have tried to do but they won't accept any complaints & just refer the matter to M & S who refuse to communicate with me. How can I take this forward & get a satisfactory result?
  10. Was this a card or a loan & when did you take it out please? I'm now having to complain to the insurance underwriter as FOS can't deal with my complaint directly with M & S as they weren't regulated when I took out my card in 1998.

I have already explained my situation to FOS & they have supposedly passed this information to Tesco, but I'm not getting any communication from either, my caseworker at FOS screens his calls by answerphone & rarely rings back. I feel like making a further complaint & charging for my time & distress that they have both caused me.
  12. On 19 February I received confirmation that RBS/Tesco were going to refund my PPI on 2 loans as "a goodwill gesture" after complaining to FOS & during April received 2 cheques for the refunds. One of the loans was settled after only 10 months of the 5 years duration. The refund that I received didn't seem anywhere near enough considering the settlement payment I had made & I questioned this with my Caseworker at FOS who agreed & also said that she didn't think that they had made the refund in accordance with the guidelines issued by FOS. After several weeks of ringing both FOS & Tesco I was allocated a new Caseworker who told me that there were high level negotiations going on between Tesco/RBS & FOS as it seemed that all of the goodwill refunds hadn't been made along the right guidelines, at the end of May he told me that the negotiations were near to reaching a conclusion & I should be due to hear something soon. I have been contacting them every week & am no nearer getting this extra money than I was the day I found out about it, I have now been transfered to one of the PPI team managers presumably because I am constantly hounding them as I really need this money due to being a sole breadwinner for my family. Can anyone help me in this matter?
  13. Is your claim for a credit card or for loan PPI? How long has it taken for your claim to be dealt with as I have been waiting almost the full 8 weeks & am wondering about ringing FOS for a complaints form ready for the 8 week deadline.
  14. I am in the process of fighting M & S to repay my PPI & they are trying to wriggle out of it by saying that they were not regulates by the GISC. On checking the FSA register I have found that they were regulated by the Personal Investment Authority which was taken over by the FSA in 2001 when I took out my card account. Does this mean that I can now take my complaint to FOS?
  15. I have recently claimed my PPI back on a loan that I took out in March 2007 which I settled early in February 2008, the loan repayments did not commence until 1 July 2007. The amount of the PPI refunded was £500 which seems very low to me. Could someone please check me the figures for the settlement? Loan £7500 PPI £1237.00 Term 62 months Interest £1692.20 inc £240.20 for PPI Total payable £10429.20 inc £1477.20 for PPI 60 payments £173.82 main loan £ 149.20 PPI £24.62 Interest rate 6.72 per annum Loan settled after 8 payments - settlement figure £7138.92 Any input would be greatfully accepted. If I have posted in the wrong place, please move to right one.
  16. I have told RBS that as I am off work & the moment & the sole breadwinner I need this money asap.
  17. I received a goodwill offer from Tesco/RBS through FOS on 19 February & accepted the same day. Conveniently my acceptance form went missing when being sent from FOS to Tesco/RBS & a second copy had to be sent from FOS which Tesco/RBS only received on 17 March. How long should it take for me to receive my cash from them & is there anything other than ringing weekly that I can do to hurry it up?
  18. I have just been reading the complaints procedure on the M & S website & it states that if you are not satisfied with the response for PPI complaints you can contact Hamilton Insurance. I am going to send a letter to them, has anyone got any ideas of what to put in the letter to put my case across as I want to try to be polite & non threatening to appeal to their better nature.
  19. I rang FOS when I got my rejection letter & after taking details they said that they couldn't help me.

It is a Marks & Spencer Credit card taken out as a chargecard in 1998, I have been given a final response from M & S but as they were not regulated by FSA until 2005 FOS are unable to take up my complaint. I need to move this complaint on in the near future as my final response letter was dated 24 December 2008.
  21. Has anyone had any success reclaiming their PPI when the provider was not regulated by FSA or a member of GISC & so not able to pass complaint on to FOS? I have a claim & they appear to be taking the P**s as they were not regulated by the above when I took out my card, they think that they are untouchable. Any advice please.
  22. So has anyone got any ideas/opinions in how long this investigation will take & when will the hold on refunds be lifted?
  23. I am thinking of writing to the Chief Executive of M & S Money re my PPI on my & More credit card before I start all the legal stuff, does anyone think that it will help & any ideas of what to put in it? I am hoping that this approach will help if I am polite & non threatening.
