  1. Thanks for the links everyone. @MaxxPower - just because agencies try to get away with calling staff self employed or agency employed contractor doesn't mean it's correct in law. This link /w w w.employmentsolicitor.me.uk/definitions-of-worker-employee-employment-law-rights/] explains that there are different rights for a 'worker' and 'employee'. Under the definitions provided on both this link and in the HRMC website my friend is an 'employee' of the agency an is entitled to paid holiday
  2. Hello, I'm trying to help out a friend who has been shafted by a local job agency in the South last week. Essentially he worked as agency from January 2011 and was told on Monday by the company (not the agency) that he was no longer needed. As it was Easter it was effectively 4 days notice, told Monday - last day Thursday. The agency had no other work lined up so he didn't go in for the last 3 days as he was trying to find other work. Between Jan - April he's had no holiday and after discussion with the agency staff today was told they don't 'do' holiday pay. I believed nearly all workers are entitled to 5.6 weeks pro-rata and was going to help him draft a letter to the agency pointed this out and requesting the holiday pay to be paid within 2 weeks. If they don't then issue a small claims notice. The advice I need is can he legally take them to court to claim holiday pay? Can someone point me in the direction of any law or something to quote to help? Many Thanks Os
  3. After several months of requests and no response from BOS asking for a true copy of my CCA, the attached arrived today. I now haven't paid for 2 months so need some advice on whether to pursue this avenue further or start repaying. Please can someone give their opinions on whether this is enforcable or not ? I have another account with BOS so wouldn't be surprised if the signature has been photoshop'd but for now assume signature and date is original For a credit card I understand the prescribed terms to be B Repayments C Rate of interest D Credit limit My intital thoughts/questions are 1. Does it matter that there is no bank signature? 2. The APR in 2.1 states 13.9% APR but in 3.2 it is 13.94% pa 3. There is no credit limit stated. Unless 3.2 statement "This is based on a credit of £1500 being borrowed..." applies? Also. the debt is £11k; way beyond any stated limit Any help with this would be greatly appreciated.   4. Hello, I have requested twice now for Barclaycard to send a true copy of my agreeement and have received their standard response on both occasions. I have drafted together (from other posted) the letter below Please can someone let me know if this is ok to send? Thanks O
  5. I have a few questions regarding recent developments I have filled in the AQ questionairre at my local court but did not take a copy. SHould I have sent a copy of this direct to LLoyds or will the court do this for me? The judge has ordered that the claim is stayed to enable both parties to settle. Since then I have received 2 seperate documents form SC&M 1.A copy of their AQ 2. A letter marked "Without Prejudice" stating that in the banks opinion there is no merit in my claim. But are prepared to settle in full due to costs of resolcing the dispute but with conditions. Should I accept the conditions an take payment or how do I proceed to push for settlement unconditionally?

  7. I have just filed a claim with Money Claim this evening and have a pdf download stating the details of the claim. Just to be sure - Do i now need to send this together with the schedule of charges (including interest) to BOTH Money Claim & LLoyds? Is there anything else I need to send (eg copies of previous 2 letters?) Also, is there a specific Moneyclaim address I should use? Many thanks, O
  8. I'm new here and have started proceedings on behalf of my brother. I'm about to send the 2. Preliminary approach for repayment letter with schedule of charges by recorded delivery to Customer Care Lloyds TSB, 125 Colmore Row, Birmingham, B3 3SF Do I need to name someone on the letter or is the above address sufficient? On a side note, when the bank sent the last 6 years of statements they arrived opened by courier with a large rip in the package which the courier company attempted to tape back together. It was still wide open though. My bro complained and the bank offered to close his account and transfer to a new account. Possibly a cheeky way of avoiding any claim perhaps? Total claim is £1509.50 for charges only without the interest Keep up the good work people! Os
