  1. Hi ya all, this case is still rumbling on!!!! We need some urgent help as i have just got back from holiday and the old fella didnt want to bother me but has has the letter sitting at his home re Allocation Questionaire...... At the top right corner of the form it says " in the county court then underneath Claim Number..... Underneath that it says Last date for filing with court office ! what date do i put in there ? Really need help today as time is running out...... Thanks a million SPK
  2. Thanks you both so much for your replies. Steve did you succesfully claim the charges back from the woolwich via moneyclaim to clear the debt owing to them (unpaid bank charges)?
  3. Hi I am helping a work colleague to claim money back from the Woolwich. We have succesfully claimed back from the Nationwide but this case is not as straight forward as that one was. All the bank charges in total amount to £1278.00 without interest. He has paid some of this but not all of it. It was a case of him getting one or two charges then getting charges on top of charges that have made him overdrawn, then they have slapped the interest on top. Although he hasn't paid the full amount above in charges yet, only some of it his account is overdrawn and they are threatening court action against him to recover the monies. If I file moneyclaim...which is the stage we are at now can I list the full total of charges that they are trying to recover from him? Including the ones he hasn't paid them yet? I really hope this makes sense to somebody. Thanks for any help. Its quite urgent as we have to file the moneyclaim before they do basically..he has fourteen days!!

  6. Could somebody post the link for me please as to how I take Nationwide credit card to court for non compliance of the data protection act. I am familiar with money claim and have claimed back charges succesfully but I really don't know where to start on this one. I have searched the forum but can't find how I actually take them to court for my statements. Any help greatly appreciated. Thank you.

  8. Hi I have been trying to get Nationwide to send my credit card statements to me since before Xmas!! I sent the SAR with my £10 cheque along with my account number etc. They cashed my cheque on 22nd January. When the 40 days were up I still hadn't recieved a letter or my statements from Nationwide CC. I then sent the non compliance data protection letter from the library giving them another seven days to comply before court action. It is now 10 days since they recieved this letter and they still haven't sent me anything. Please can somebody advise me what to do next. Can I estimate my charges and go ahead with the claim of getting my fees refunded? Thanks for any help.
  9. Hi, I am hoping somebody can give me some advice here please. I sent my cheque off to Nationwide credit card which was cashed on 22 Jan along with my data protection letter for my credit card statements. The 40 days expired and still no statements so I sent the template letter saying I would start court action against them if I did not recieve my statements in the next 7 days. They have ignored this letter too and it is now 10 days since they would have recieved this letter and still no statements. Can I estimate my credit card charges and start the process, seeing as they won't send me my statements! Or do I need to wait and keep writing until they do send them? Any help very much appreciated.   11. Hi, right I will try to explain a bit better than my husband has!! The old man is his work colleague, who we have just managed to get bank charges back for him from Nationwide. Nationwide passed on a £1500 debt to a debt collecting agency whom my husband has been dealing with on behalf of his colleague. He had just managed to do a deal with the debt collecting agency to pay them back £1000 instead of £1500 which they accepted and are putting in writing (in post). When the person who's account it is went into nationwide to draw the money, he was told that he can only have £500 to draw out and that they are keeping the rest as he owed them!! But they had passed the debt on to the collecting agency that have already made a deal to just accept the £1000!! How can they aquire the debt back like this? It doesn't seem very ethical to stitch the old man up like this!! He's 62 and doesn't have a penny to his name:( By the way this all happened in the course of two days. Money went in bank, debt collecting agency agreed to amount offered the same day the money went into the account, next day nationwide said the debt is theirs again?? Oh and the other thing is he got £2000 back and nationwide are saying he owes them the £1500 and not the debt collecting agency. Oh god I hope somebody understands my ramblings!!

Re: Old Fella vrs Nationwide Hi, right we have a problem! 1: Nationwide have paid his charges back but...... Before they paid him back they gave the debt to Moorcroft debt recovery ( no problem) i rang them and negoiated a deal so he didnt have to pay the whole debt! like 500 pound less! they have put this in writing. 2: Old bloke hasnt a card for his account and goes into the branch to see how to get money and was told with no card you can draw 50 a day till your new card comes through. 3. They ring him today to say that he can have 500 pound but they are keeping the rest as that was his overdraft ( but they gave the debt to Moorcroft) is this illegal? What do we do now please.
